This Prohibited Content Policy (the "Policy") is provided by LERK STUDIOS, INC. ("Lerk," "we," "us," or "our"), the operator of lerk.ai and its related AI companion, character-creation, chat, image-generation, video-generation, and other services (collectively, the "Service").
Lerk is an adults-only AI entertainment platform. The Service may allow eligible adult users to interact with fictional AI characters and generate adult-oriented text, images, video, audio, or other media. Adult content is permitted only when it complies with this Policy, our Terms of Service, our other safety policies, applicable law, and any requirements imposed on the Service by our providers.
This Policy applies to:
- Prompts, messages, instructions, character descriptions, persona settings, names, biographies, tags, and other information submitted to the Service ("Inputs");
- Text, images, video, audio, characters, or other material produced through the Service ("Generations");
- Saved, displayed, shared, downloaded, or otherwise used Content; and
- Attempts to request, create, disguise, or facilitate prohibited Content, whether or not a Generation is successfully produced.
The fact that the Service generates, displays, saves, or fails to block Content does not mean that the Content is permitted.
The same rules apply to every companion gender and to realistic, anime, and other supported styles; to SMS-style chat and roleplay; and to every intensity setting, subscription tier, photo request, edit, and video. SMS-style chat takes place within Lerk and is not a telephone text-message service. A more explicit setting changes the tone of permitted adult content, not the safety rules.
1. Permitted Fictional Adult Content
Lerk is designed for fictional adult characters and lawful, consensual adult fantasy and roleplay.
Sexual or romantic Content is permitted only when every depicted or described participant:
- Is fictional;
- Is unambiguously at least 18 years old and meets any higher age requirement applicable in the relevant jurisdiction;
- Is presented as an adult in appearance, language, setting, history, and surrounding context;
- Participates voluntarily and with consent; and
- Is not subject to any prohibited category below.
Consensual adult dominance, submission, power exchange, or other adult roleplay may be permitted when the fictional adult participants' consent is clear and the Content does not involve sexual violence, coercion, trafficking, incapacity, or another prohibited subject. Calling prohibited conduct a "fantasy," "roleplay," "simulation," or "consensual non-consent" does not make it permissible.
Context matters: an affectionate pet name between unrelated fictional adults does not by itself establish a minor or family relationship. Pet names do not permit an actual underage, familial, coercive, or otherwise prohibited scenario.
2. Minors, Age Ambiguity, and Child Sexual Exploitation
Lerk has zero tolerance for Content involving the sexual exploitation or sexualization of minors.
You must not request, create, possess, save, share, or attempt to generate Content that:
- Depicts, describes, sexualizes, exploits, grooms, endangers, or harms a person under 18;
- Constitutes or appears to constitute child sexual abuse material or other child sexual exploitation;
- Presents a character as under 18, age-ambiguous, childlike, prepubescent, or not clearly an adult;
- Uses an adult age label while the character's appearance, body, voice, clothing, setting, biography, relationships, occupation, school status, or other context suggests that the character is a minor;
- Sexualizes childhood, youth organizations, children's settings, or age-regression themes;
- Depicts an adult interacting sexually or romantically with a minor; or
- Uses coded wording, misspellings, euphemisms, visual cues, or other techniques intended to disguise underage Content.
A statement that a character is "18" or older does not override contradictory characteristics or context indicating that the character is underage or age-ambiguous.
Clearly adult 18-year-old fictional characters are permitted subject to applicable law. All appearance and context must remain clearly adult. Anime or fantasy styling and an implausibly old age label do not make a childlike character acceptable.
Apparent child sexual exploitation or other unlawful material may be preserved and reported to the the legally designated child-protection reporting organization, law enforcement, or another appropriate authority where required or permitted by law. Do not email or otherwise send suspected illegal imagery to Lerk.
3. Real People, Likenesses, and Impersonation
The Service is intended for fictional characters, not sexual or harmful simulations of real people.
You must not use companion creation, chat, generation, editing, or animation features to depict, imitate, or sexualize an identifiable real person. A claimed authorization or a label such as parody, fictional, or AI-generated does not create an exception to the fictional-character rule. This applies to:
- Public figures, celebrities, performers, creators, politicians, and other well-known individuals;
- Private individuals, including partners, former partners, acquaintances, coworkers, classmates, and family members;
- A person's face, body, voice, name, identity, biometric characteristics, or other recognizable likeness;
- Deepfakes, face swaps, voice clones, impersonations, or deceptive identity simulations; and
- Intimate or sexually explicit Content involving a real person, regardless of whether the Content is presented as fictional, altered, parody, or AI-generated.
General fictional traits or broad character archetypes may be used only where the resulting character is not designed to identify, imitate, or be mistaken for a real person.
Lerk does not currently accept user-uploaded photographs, videos, or audio files in companion creation or generation. Generation features use Lerk-supplied companion and preset reference images and, where offered, eligible photos previously generated in your own account for the same companion. Selecting a saved Lerk photo as a reference, editing it, or animating it is not an external file upload. These features must not be used to recreate or sexualize an identifiable real person.
4. Non-Consensual Sexual Content and Sexual Violence
Content depicting, encouraging, eroticizing, or facilitating sexual activity without the voluntary and informed consent of every adult participant is prohibited.
This includes Content involving:
- Rape, attempted rape, sexual assault, or sexual violence;
- Force, threats, blackmail, intimidation, coercion, or abuse of authority;
- Kidnapping, captivity, sexual slavery, ownership, sale, trading, or "training" of a person;
- Drugging, intoxication that prevents consent, unconsciousness, sleep, paralysis, or other incapacity;
- Revenge pornography, hidden recording, voyeurism, or distribution of intimate material without consent;
- Hypnosis, brainwashing, mind control, "mind-break," or similar removal of a person's ability to consent when used to sexualize loss of agency; or
- Any scenario in which non-consent, resistance, fear, suffering, or inability to refuse is the sexual appeal.
5. Human Trafficking and Sexual Exploitation
Content or conduct that promotes, facilitates, solicits, advertises, normalizes, or instructs others in human trafficking, sex trafficking, sexual exploitation, forced labor, or the purchase or sale of a person is prohibited.
The Service must not be used to arrange real-world sexual services, recruit or advertise real persons for sexual activity, facilitate exploitation, or conceal trafficking-related conduct.
6. Incest and Familial Sexual Content
Sexual or romantic Content involving persons presented as biologically, legally, adoptively, or functionally related family members is prohibited. Renaming a familial relationship or describing it as "step," "adopted," "not really related," or roleplay does not make otherwise incest-themed Content permissible where the family relationship is the sexual premise.
7. Bestiality and Sexualized Animals
Content depicting or describing sexual activity, sexual contact, or sexualized conduct involving animals is prohibited. This includes real animals, realistic animal depictions, and creatures presented with animal-level intelligence or an inability to provide adult human-equivalent consent.
Fictional humanoid or fantasy characters may be permitted only when they are clearly adult, sentient, capable of consent, predominantly humanlike, and otherwise compliant with this Policy.
8. Extreme Violence, Gore, Death, and Abusive Fetish Content
Content that eroticizes or graphically depicts extreme violence, torture, mutilation, dismemberment, severe injury, snuff, killing, corpses, necrophilia, or gore is prohibited.
The following sexualized or fetish Content is also prohibited:
- Scat, coprophilia, or sexualized feces;
- Sexualized urination or bodily waste directed onto another person;
- Vomit used as sexual content;
- Cannibalism, vore, or consumption of a person;
- Necrophilia or sexual contact with a corpse;
- Mutilation, active bloodletting, or serious bodily injury; and
- Sexualized medical abuse or procedures causing severe injury.
Non-graphic fictional conflict or ordinary narrative violence may be allowed when it is not sexualized, instructional, celebratory of real harm, or otherwise prohibited.
9. Self-Harm, Suicide, and Dangerous Conduct
Content that encourages, romanticizes, instructs, pressures, or assists a person to engage in suicide, self-harm, eating-disorder behavior, dangerous substance use, or other serious physical harm is prohibited.
Supportive discussion that discourages harm or encourages a person to seek appropriate help is not prohibited merely because it refers to self-harm or suicide.
10. Hate, Harassment, and Violent Extremism
Content that promotes, praises, supports, recruits for, or provides propaganda or operational assistance to terrorism or violent extremist organizations is prohibited.
Content that attacks, dehumanizes, threatens, or incites hatred, discrimination, exclusion, or violence against a person or group based on race, color, ethnicity, nationality, citizenship, religion, caste, sex, gender, gender identity, sexual orientation, disability, serious medical condition, or another protected characteristic is prohibited.
Harassment, stalking, credible threats, targeted humiliation, and content intended to intimidate or abuse a real person are also prohibited.
11. Illegal Activity and Facilitation of Harm
Content that violates applicable law or meaningfully facilitates unlawful or seriously harmful conduct is prohibited. This includes Content that provides actionable assistance for:
- Human trafficking, sexual exploitation, or abuse;
- Terrorism or violent criminal activity;
- Illegal weapons acquisition, construction, or use;
- Illegal drug production or distribution;
- Fraud, scams, theft, extortion, money laundering, or identity theft;
- Cyberattacks, malware, credential theft, unauthorized access, or evasion of security controls;
- Doxxing, stalking, or locating a person for harmful purposes; or
- Concealing evidence of a serious crime or evading lawful investigation.
Fictional discussion of crime is not automatically prohibited, but Lerk may block Content that becomes instructional, operational, celebratory of real-world harm, or otherwise creates material safety or legal risk.
12. Privacy, Personal Information, and Doxxing
You must not submit or generate Content that discloses, requests, infers, aggregates, or facilitates misuse of another person's private or sensitive information without authorization.
Prohibited information may include home addresses, precise locations, private contact details, financial information, login credentials, government identifiers, private communications, medical information, intimate information, or other data that could enable harassment, exploitation, fraud, or physical harm.
13. Intellectual Property and Rights Violations
Content that infringes or misappropriates copyright, trademark, publicity, privacy, contractual, or other legal rights is prohibited.
You must not use the Service to reproduce pirated material, imitate protected characters or brands in an infringing manner, remove ownership information, falsely claim authorship, or create Content that you do not have the right to request or use.
14. Deception, Fraud, and Manipulation
Content or conduct intended to deceive, defraud, extort, impersonate, exploit, or manipulate a real person is prohibited. This includes phishing, romance scams, fraudulent fundraising, fabricated evidence, forged documents, deceptive endorsements, and Content used to misrepresent an AI Generation as authentic evidence of a real event or person.
15. Platform Abuse and Moderation Circumvention
You must not attempt to bypass, disable, defeat, probe, reverse engineer, or interfere with Lerk's content safeguards, age controls, geographic restrictions, security systems, or moderation processes.
Prohibited conduct includes:
- Using encoding, euphemisms, deliberate misspellings, translation, fragmented prompts, or indirect instructions to evade detection;
- Repeatedly resubmitting blocked requests with minor changes;
- Asking a persona or model to ignore policies, hidden instructions, or safety controls;
- Attempting to obtain non-public system prompts, moderation rules, classifier logic, or security information for circumvention;
- Sharing instructions or tools primarily intended to bypass safeguards; and
- Using multiple accounts, automated systems, or other methods to continue prohibited activity after a restriction.
Good-faith security research is permitted only with Lerk's prior written authorization and within the scope of any applicable vulnerability-disclosure program.
16. User Responsibility
You are responsible for your Inputs and for how you access, save, use, download, or share Generations.
You agree that you will:
- Use the Service only for lawful purposes and in accordance with this Policy;
- Provide accurate character ages and avoid age-ambiguous traits or contexts;
- Use fictional characters rather than real identifiable people;
- Stop and report a Generation that appears to violate this Policy;
- Not attempt to preserve, distribute, or regenerate prohibited Content; and
- Comply with the Terms of Service and all other policies incorporated into them.
You may not rely on the Service's failure to block Content as permission to create or use it.
17. Moderation and Review
Lerk screens chat requests and checks text during and after streaming. Because text is streamed, part of a response may appear before a later check interrupts or restricts it. User-requested images and videos are checked before release to the user; a result may be withheld while a required check is unavailable and later released, blocked, or marked failed. These processes reduce risk but do not guarantee that every violation will be detected.
Lerk does not manually review every Input or Generation. However, Lerk may conduct human review whenever reasonably necessary, including when Content is flagged by automated systems, reported by a user or third party, associated with repeated or serious violations, connected to suspected fraud or abuse, required for troubleshooting or security, required by a service provider, or reviewed to comply with law or enforce our policies.
Where appropriate, Lerk may place an account, conversation, character, or pattern of activity under targeted or heightened human monitoring to investigate suspected violations, protect users and third parties, and confirm compliance with this Policy. Human review and monitoring will be limited to legitimate safety, security, legal, fraud-prevention, support, and policy-enforcement purposes and will be handled in accordance with our Privacy Policy.
Any Content identified or reasonably suspected as violating this Policy may be blocked, restricted, removed, or escalated for further review. A failure, delay, or technical limitation in any safeguard does not authorize prohibited Content, waive this Policy, or limit Lerk's right to take corrective or enforcement action.
Our handling of Inputs, Generations, reports, and moderation data is further described in our Privacy Policy and Content Moderation Policy.
18. Enforcement
Lerk may take any action we reasonably consider appropriate in response to an actual, attempted, suspected, or repeated violation, including:
- Refusing or stopping a Generation;
- Removing, restricting, quarantining, or disabling access to Content;
- Restricting character creation, chat, image, video, or other features;
- Issuing a warning;
- Temporarily suspending or permanently terminating an account;
- Preventing creation of replacement accounts;
- Preserving relevant records for safety, fraud-prevention, dispute, or legal purposes;
- Cooperating with lawful investigations; and
- Reporting apparent illegal conduct or child exploitation to appropriate authorities or organizations where required or permitted by law.
Severe violations may result in immediate termination without prior warning. Repeated attempts to generate prohibited Content may be treated as a violation even when no Generation is produced.
Enforcement decisions may consider the nature and severity of the Content, the user's apparent intent, prior violations, attempts to evade safeguards, legal obligations, provider requirements, and risk to users, Lerk, or third parties.
19. Reporting Prohibited Content
Use an in-app Report control where shown for a companion or message, or email support@lerk.ai. Email remains available to people without an account. Reporting does not itself request a monetary refund; billing requests follow the Refund Policy.
To report Content or conduct that may violate this Policy, contact support@lerk.ai.
Include enough information for us to locate and assess the issue, such as:
- The account email, if applicable;
- The relevant character or persona name;
- The approximate date and time;
- A conversation, Generation, or transaction identifier; and
- A brief description of the concern.
Do not email CSAM, suspected CSAM, or other illegal imagery. Provide identifiers and a description instead so that Lerk can locate the relevant material through its systems.
Reports involving suspected child exploitation, trafficking, credible threats, or imminent physical harm receive priority review.
20. Changes to This Policy
We may update this Policy to reflect changes to the Service, our safety practices, provider requirements, or applicable law. The revised version will be posted with an updated "Last Updated" date. Where required by law, we will provide additional notice of material changes.
