Unethical company with no regard for the law
I’m a well-established jewelry designer. For the past two years, a seller on Faire has been selling counterfeit copies of dozens of my designs, which she buys $2 a piece from a chinese factory and resells for $24 (wholesale price !) in her store, falsely claiming as handmade by her and ethically produced (in fact her entire store is made of mass-manufactured jewelry from China).
I have filed countless DMCAs to Faire’s legal team - which is very slow and uncooperative - but every time the infringing items finally get removed by Faire, the seller relists them immediately, and despite my many complaints Faire has refused to take any action against this person, letting her continue to sell products that they fully know are counterfeit and definitely not handmade by her. They simply tell me to file a new DMCA for every single item every time she relists, which is highly time-consuming since they do not provide a DMCA form and force you to put everything in writing yourself, with dozens of items to report everytime.
Since the seller refuses to cease & desist, the infringing copies keep getting sold, including to countries where they are not compliant with local laws (since they contain nickel & lead).
This has been going on for 2 years and Faire still continues to ignore my complaints to this day, probably because the seller is a "top shop" on their platform (who wouldn’t be, with 2500 SKUs and unlimited stock).
Furthermore, the seller’s legal info is nowhere to be found on Faire’s platform, so I am forced to only deal with Faire, who simply ignores my warnings.
Faire has invited me many times to sell on their platform, but this whole experience has shown me that they are a shady company that turns a blind eye to IP infringement, false advertising, and product safety as long as they make a profit.
I feel genuinely sorry for the store owners that do business with that seller thinking they’re purchasing legitimate handcrafted goods from a local small designer, and unknowingly lie to their own retail customers about the goods' origin, all because of Faire’s disregard for IP laws, ethics and accountability. As a B2B marketplace, they have absolutely no excuse for making their B&M customers liable in this way.
