HORNE Terms of Service

Welcome to HORNE. These Terms of Service (“Terms”) govern your access to and use of shophorne.com, any related websites, mobile experiences, communications, and services operated by HORNE (“HORNE,” “we,” “us,” or “our”), and your purchase of products from HORNE.

By accessing our website, placing an order, creating an account, communicating with us, or otherwise using our services, you agree to these Terms, our Privacy Policy, our Return Policy, our Shipping and Damage policies, and any additional policies or terms posted on our website or communicated to you in connection with a purchase. If you do not agree to these Terms, you may not use our website or place an order with HORNE.

1. Online Store Terms

HORNE is an online retailer of furniture, lighting, decor, and related goods. We do not operate a public retail showroom. By placing an order, you represent that you are at least the age of majority in your state or jurisdiction, or that you are using our website with the consent of a parent or legal guardian.

You agree not to use our website or products for any unlawful purpose, to violate any laws in your jurisdiction, or to interfere with the security or operation of our website.

2. Product Information, Colors, Dimensions, and Availability

We make reasonable efforts to display product information accurately, including descriptions, pricing, availability, dimensions, finishes, materials, colors, lead times, and imagery. However, product information may contain errors, omissions, or changes supplied by manufacturers or vendors.

Colors, finishes, wood grain, stone, leather, textiles, and other natural or hand-finished materials may vary from images shown online. Dimensions may vary slightly due to manufacturing tolerances. Lifestyle images may show products in settings or configurations that are not included with the purchase unless expressly stated.

Lead times, availability, shipping estimates, and delivery dates are estimates only and are not guaranteed unless expressly stated in writing by HORNE. Many products are made to order, special order, imported, or shipped directly from manufacturers or distributors. Delays may occur due to production, transit, customs, manufacturer backlogs, weather, carrier availability, or other circumstances outside HORNE’s control.

3. Orders, Acceptance, and Right to Refuse or Cancel Orders

Placing an order does not constitute acceptance of the order by HORNE. We reserve the right to accept, decline, cancel, limit, or refuse any order at our discretion, including after an order has been submitted or payment has been authorized or captured.

We may refuse, cancel, or limit an order for reasons including, but not limited to: product unavailability; pricing or product information errors; suspected fraud; unusual order activity; payment risk; prior chargeback or dispute activity; violation of our policies; inability to verify payment or shipping information; shipping restrictions; manufacturer discontinuation; or any other issue that may affect our ability to fulfill the order.

If we cancel an order after payment has been captured, we will issue a refund to the original payment method unless otherwise required by law. HORNE is not responsible for any costs, losses, project delays, contractor fees, installation costs, financing charges, or other damages resulting from a canceled or delayed order.

4. Pricing, Promotions, and Errors

Prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, discounts, product availability, and shipping offers are subject to change without notice.

We reserve the right to correct pricing, typographical, product, shipping, or promotional errors at any time, including after an order has been submitted. If an item is listed at an incorrect price or with incorrect information, we may cancel the order and issue a refund.

Discount codes, promotional offers, gift cards, store credits, and sale pricing may be subject to additional restrictions and may not be combined unless expressly stated. Promotions may be modified or discontinued at any time.

5. Payment

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize HORNE or its payment processor to charge the full amount of your order, including product cost, shipping, taxes, and any applicable fees.

If payment is declined, reversed, disputed, or otherwise not received, HORNE may suspend or cancel the order, delay shipment, refuse future orders, or pursue any remedies available under these Terms or applicable law.

6. Chargebacks and Payment Disputes

If you have an issue with an order, you agree to contact HORNE first and provide us a reasonable opportunity to review and resolve the issue in accordance with our policies.

By placing an order, you agree that you will not initiate a chargeback or payment dispute for issues that are governed by HORNE’s published policies, including but not limited to shipping delays, special-order restrictions, return eligibility, freight damage procedures, inspection requirements, product lead times, or cancellation limitations.

If a chargeback or payment dispute is initiated, HORNE reserves the right to submit all relevant order information, communications, proof of delivery, policy terms, product information, and other evidence to the payment processor, card network, issuing bank, financing provider, or other relevant party. HORNE also reserves the right to cancel pending orders, refuse future orders, suspend account access, or require alternative payment methods from customers with prior or active payment disputes.

7. Shipping and Delivery

Shipping methods, carriers, and delivery timelines vary by product, destination, and carrier availability. Some items ship parcel, while others ship by freight carrier due to size, weight, fragility, or manufacturer requirements.

Shipping estimates are not guaranteed delivery dates. HORNE is not responsible for delays caused by carriers, manufacturers, customs, weather, labor issues, incorrect shipping information, failed delivery attempts, customer unavailability, or circumstances outside our control.

Customers are responsible for providing accurate shipping information and ensuring that the delivery location is accessible and suitable for delivery. Additional fees may apply for address corrections, storage, redelivery, missed appointments, limited-access delivery, remote delivery, inside delivery, white-glove delivery, or other special delivery services.

8. Freight Deliveries, Inspection, and Damage Claims

Certain items ship by freight carrier. Freight deliveries require special inspection procedures.

You are responsible for inspecting freight shipments at the time of delivery. Before signing the delivery receipt, you must inspect the packaging and, where possible, the contents of the shipment. Any damage to the packaging or product must be clearly noted on the delivery receipt before signing.

If you are unable to fully inspect the contents at the time of delivery, you must write “Damaged - Further Inspection Pending” on the delivery receipt before signing and notify HORNE promptly.

All damage claims must be reported to HORNE within 5 business days of delivery unless a shorter period is stated on the applicable product page, shipping communication, or delivery instructions. Damage claims reported outside the required inspection period may be denied.

To support a damage claim, you must retain all original packaging, cartons, pallets, packing materials, and damaged goods until the claim is fully resolved. You must provide photos of the product, packaging, shipping labels, delivery receipt, and any visible damage upon request.

Failure to inspect the shipment, note damage on the delivery receipt, report damage within the required timeframe, retain packaging, or provide requested documentation may prevent HORNE, the manufacturer, or the carrier from filing or approving a claim. In such cases, HORNE may be unable to provide a refund, replacement, repair, credit, or other remedy.

9. Lost, Missing, or Misdelivered Packages

If tracking shows that an item has been delivered but you cannot locate it, you must contact HORNE within 5 business days of the delivery date so that we may attempt to initiate a carrier trace or investigation.

HORNE is not responsible for lost or missing packages reported outside the required timeframe or for packages delivered to the address provided at checkout.

10. Returns, Exchanges, Cancellations, and Store Credit

Returns, exchanges, cancellations, and store credits are governed by HORNE’s Return Policy and any product-specific terms stated on the product page, order confirmation, quote, invoice, or communication from HORNE.

Certain items may be final sale, non-returnable, non-cancelable, or subject to restocking fees, including but not limited to special-order items, made-to-order items, custom items, open-box items, sale items, installed items, assembled items, used items, altered items, and items without original packaging.

Approved returns must be received in new, unused, uninstalled condition with all original packaging, parts, instructions, and accessories. HORNE reserves the right to reject returns or reduce refunds for items that are used, damaged, installed, missing components, missing packaging, or otherwise not received in acceptable condition.

11. Special Orders, Made-to-Order Items, and Custom Products

Many items sold by HORNE are special order, made to order, imported, customized, or produced specifically for the customer. Such items may not be cancelable, returnable, or refundable once the order has been placed, submitted to the manufacturer, entered production, or prepared for shipment.

Lead times for special-order and made-to-order items are estimates and may change. Production or transit delays do not automatically create a right to cancel, return, charge back, or receive a refund unless required by applicable law or expressly agreed to in writing by HORNE.

12. Product Use, Installation, and Site Conditions

Customers are responsible for ensuring that products are suitable for their intended use, space, building conditions, electrical conditions, mounting conditions, code requirements, and installation environment.

HORNE is not responsible for installation, assembly, measurement, contractor, electrician, designer, architect, or site-related errors. We recommend that customers confirm all dimensions, specifications, finish requirements, electrical requirements, and site conditions before ordering and before installation.

Once an item has been installed, assembled, modified, used, or altered, it may no longer be eligible for return, exchange, refund, or damage claim remedy.

13. Manufacturer Warranties

Some products may be covered by a manufacturer warranty. Manufacturer warranties, if any, are provided by the manufacturer and not by HORNE. Warranty terms vary by brand and product.

HORNE may assist customers in communicating with a manufacturer regarding a warranty issue, but HORNE does not control manufacturer warranty decisions and is not responsible for a manufacturer’s denial, delay, replacement process, repair process, or warranty limitations.

14. Limitation of Liability

To the fullest extent permitted by law, HORNE and its owners, employees, agents, affiliates, suppliers, manufacturers, vendors, service providers, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of our website, purchase of products, shipping delays, delivery issues, product availability, product use, installation, project delays, or inability to use a product.

This includes, but is not limited to, lost profits, lost revenue, loss of business, project delays, contractor fees, installation costs, removal costs, repair costs, replacement labor, property damage, loss of use, financing costs, or other consequential damages.

HORNE’s total liability for any claim arising from a product or order shall not exceed the amount actually paid to HORNE for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

15. Disclaimer of Warranties

Our website and services are provided on an “as is” and “as available” basis. Product warranties, if any, are provided by the applicable manufacturer.

Except as expressly stated in writing by HORNE, and to the fullest extent permitted by law, HORNE disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be waived.

16. Account Information and Customer Conduct

You agree to provide accurate, current, and complete information when placing an order or creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree not to misuse our website, submit false information, interfere with our operations, abuse our customer service team, make fraudulent claims, initiate improper payment disputes, or violate these Terms or any applicable law.

HORNE reserves the right to suspend or terminate accounts, refuse service, cancel orders, or limit future purchases where we believe a customer has violated these Terms, created payment risk, abused policies, engaged in fraudulent or suspicious activity, or otherwise created unreasonable business risk.

17. Intellectual Property

All content on the HORNE website, including text, images, product descriptions, graphics, logos, design, layout, photography, videos, and other materials, is owned by HORNE or its licensors, vendors, manufacturers, or content providers and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, scrape, display, sell, exploit, or use any website content without prior written permission from HORNE or the applicable rights holder.

18. Copyright Claims

If you believe that your copyrighted work or imagery has been used on the HORNE website in a way that constitutes infringement, please contact us at info@shopHORNE.com and provide:

  • Identification of the copyrighted work claimed to have been infringed;
  • Your contact information, including name, address, telephone number, and email address;
  • Identification of the location on the HORNE website where the allegedly infringing material appears;
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  • A statement, made under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

After reviewing your claim, HORNE may remove or disable access to the material in question.

19. SMS/Text Messaging

If you elect to receive marketing text messages from HORNE, either through our website or by sending a text message indicating your consent, you provide prior express written consent to receive recurring marketing or promotional SMS text messages from HORNE, including cart abandonment messages, using an automatic telephone dialing system or other technology. Consent is not a condition of purchase.

Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any text message. For help, reply HELP or contact hello@shopHORNE.com.

Text message services are provided on an “as is” basis and may not be available through all carriers or in all areas. HORNE and wireless carriers are not responsible for delayed or undelivered messages.

If you change or deactivate the phone number you provided, you are responsible for updating your account information to prevent messages from being sent to a person who later receives your former number.

20. Privacy

Your use of our website and services is subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

21. Third-Party Links and Services

Our website may contain links to third-party websites, payment processors, financing providers, shipping carriers, review platforms, or other services. HORNE is not responsible for third-party websites, services, policies, content, delays, errors, or actions.

Use of third-party services may be subject to separate terms and privacy policies.

22. Force Majeure

HORNE is not responsible for delays, failures, or losses caused by events outside our reasonable control, including but not limited to acts of God, weather, natural disasters, fire, flood, labor disputes, strikes, supply chain disruptions, carrier delays, customs delays, war, terrorism, civil unrest, pandemics, government actions, manufacturer delays, material shortages, power outages, internet failures, or other events beyond our control.

23. Changes to These Terms

HORNE reserves the right to update, modify, or replace these Terms at any time by posting the revised version on our website. The version in effect at the time you place an order will generally apply to that order, unless changes are required by law or relate to website use, fraud prevention, dispute procedures, or operational matters.

Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.

24. Governing Law

These Terms and any dispute arising from or relating to these Terms, our website, or any purchase from HORNE shall be governed by the laws of the United States and the laws of the state in which HORNE’s principal business operations are located, without regard to conflict-of-law principles, unless otherwise required by applicable law.

25. Dispute Resolution

Before initiating any formal legal claim, you agree to contact HORNE at hello@shopHORNE.com and provide a reasonable opportunity for us to review and attempt to resolve the matter.

Any dispute, claim, or controversy arising from or relating to these Terms, our website, or any purchase from HORNE shall be resolved in the state or federal courts located in the state and county where HORNE’s principal business operations are located, unless otherwise required by applicable law.

Each party waives, to the fullest extent permitted by law, any objection to jurisdiction or venue in those courts.

26. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain valid and enforceable.

27. No Waiver

HORNE’s failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Any courtesy accommodation, exception, discount, store credit, replacement, claim attempt, or other goodwill gesture provided by HORNE does not waive our rights or modify these Terms.

28. Entire Agreement

These Terms, together with our Privacy Policy, Return Policy, Shipping and Damage policies, product-specific terms, order confirmations, invoices, and any written communications from HORNE, constitute the entire agreement between you and HORNE regarding your use of our website and purchase of products.

COPYRIGHT POLICY

If you believe that your copyrighted original work or imagery has been infringed upon by HORNE, we ask that you please contact HORNE for any Notice of Claims of Copyright Infringement. Please send an email to info@shopHORNE.com and you must provide the following materials:

  • Identify the work which you claim has been infringed
  • Provide contact information including telephone number, address and email address.
  • Identify the location on the HORNE site where you feel we are infringing upon your work
  • Provide a statement that believe you have a right to make a claim to the use of this work and that the current use is not authorized
  • Declare under perjury that all of the above are true and accurate to the best of your knowledge.
  • After reviewing your claim, HORNE may remove the work in question.
