Specification of Letters Patent.

To all whom it may concern:
Be it known that I, Josli VILA FERNANDEIZ, a subject of the King of Spain, and a resldent of Camaguey, Cuba, have invented a new and Improved Cigar and Cigarette Holder, of which the following is a full,
clear, and exact description.

A further object of the invention is to provide an improved cigar or cigarette holder having a self-contained perforating device whereby it is unnecessary to bite off the end of the cigar previous to smoking.
A further object of the invention is to provide an improved cigar or cigarette holder, together with a case therefor, the case co-acting with. the holder whereby, after the butt is ejected from the holder, the insertion of the holder into its case. will cause the ejecting means to be broughtinto operative position for use when again desired.
A further object of my invention is to provide an improved cigar or cigarette holder having means for ejecting a cigar or cigarette but-t, together with an improved perforating device whereby the cigar may be inserted into the holderwithout-the necessity of biting oif the end of the cigar previous to smoking.
A further object of my invention is to,
provide' an improved cigar or cigarette holder having a chamber therein, this cham-, her being provided with a suitable filter whereby particles of tobacco are arrested before they reach the mouth of the smoker.
Reference is to behad to the accompanying drawings forming a part of this speci fication, in which like characters of reference denote corresponding parts in all the views, and in which- Figure 1 is a longitudinal sectional view of my holder with a cigarette in position therein; Fig. 2 is a similar view, showing the holder in position within the case; Fig. 3 is a similar view showing the holder after the ejecting means has been operated. Fig.
4 is a perspective of the holder; Fig. 5 is a perspective view of the perforating device; Figs. 6 and 7 are side views of the disks which'form the side wallsof the filter chamber; Fig. 8 is an end view of the piston member of the ejecting means.
My holder is preferably made up of a mouth piece 1, a cigaretteor cigar holding portion 2, together with a filter chamber 3 therebetween. The mouth piece and the cigar holding portion are held in their proper positions by means of a ferrule 4, annular packingsfi, 6,. being provided at opfit recesses in the ends of the said members, as shown particularly in .Fig. 3, whereby any absorption of air between the ferrule 4 and the members'l, 2, is prevented. The side walls of the filterchamber 3 consists posite ends of this ferrul'e and adapted to preferably of disks 7, 8, provided with openings 9, 10, therein, through which the smoke passes, there being also central openingsll,
. 12, for the passage of the operating rod.
Jach of these disks is positioned closely adjacent the meeting ends of the mouth piece 1 and the" cigar holding portion 2, the proper distance being maintained by means of flanges13, 14, provided on the ferrule 4,
against which the disks rest, a suitable filter element 15 being positioned in this chamber.
' The mouth piece 1 .is provided-with-a longitudinal opening within which is placed a suitable cylindrical lining member 16, this member containing the Ushap ed element 17 having at one of its ends the hook 18 which is adapted to engage the end of the opening in the mouth piece. as shown in Figs. 1 and 2, whereby the ejecting means is held in inoperative position. The closed end of the U-shaped member engages one end of the operating rod 19 having at its outer end the piston member 20 provided with suitable openings 21, 22therein, these openings permitting movement of the piston member longitudinally of the cigar holding portion along the arms of the U-shaped perforating device 23 which ispermanently held in position at its closed endadjacent the disk 8. A helical sprin'g 2-1 surrounds this perforating device. the opposite ends of thespring being in engagement with the disk 8 and the inside of the piston 20 respectively. The piston member is further provided with a number of openings 25, .26, in order topermit the smoke to freely pass -'therethrough.
The closed end of the perforating device is provided with a suitable opening '27 through which the operating rod 19 passes, the position of these parts after the butt has been ejected being shown in Fig. 3; the spring 2i tends to keep the ejecting device in the position shown in this figure and in order to bring this means to inoperative position in order to permit a cigar or cigarette to be inserted in the holder, I provide a suitable case 28 having a hollow cylindrical portion 29 extending for a suitable distance from its lower portion 30, whereby as the holder is inserted into the case in the position shown in Fig. 2, the outer end of the cylindrical n'lember 29 will come into engagement with i the piston member 20, thereby compressing the spring 24 and moving the operating rod 19 and with it the U-shaped member 17 longitudinally bit the holder until the hook 18 on the end thereof engages the outer end portion of the. mouth piece, the operating means bein now secured in inoperative position and the holder being allowed to receive a cigar ,orgigarette when desired. The case :28 is alsopiiivided with a suitable cover member 31 bf any desired form of construction.
From Figs. 1 and 2 it is to be noted that the l'ieri orating device 23, the side members of which are provided each with a longitudinal slot 32, 33, whereby the smoke may 'trcely pass from the body of the cigar or cigarette into the ehan'lber of the holder, does not move with the ejecting means but occupies a single position whereby. after the cigar or cigarette is inserted in the holder as shown in Fig. l, the outer pointed ends of the perforating device will enter the cigar or arettc. thereby forming suitable passages "or the smoke. whereby it may pass on to the chamber of the mouth piece.
When it is desired to eject a butt trom the holder, the user mcrcly presses downwardly on the hook 18 at the outer end of the U shaped element 17, thereby permitting the helical spring 24; to expand and forcing the piston member 20 toward the open end of the cigar holding chamber, whereby the cigar or cigarette is forcibly ejected. Having thus described my invention, I claim as new, and desire to secure by Lettors Patentz--- 1. A device of the class described comprising a mouth piece, a holding portion. together with a chamber between the mouth pie e and the holding portion, the said chan1-- her adapted to contain a suitable filter, and. an operating rod adapted to expel a cigar or arette extending longitudinally of the do .i .c and having a hook at one end thereot adapted to engage the end of the mouth piece whereby it may be held in position within the device.

In a device of the class described a mouth piece, a tobacco holding portion, a chamber between the mouth piece and the tobacco holding portion containing a suitable filter, togetherwith an operating rod adapted to expel a cigar or cigarette ex- 7 tending longitudinally of the said device and having a hook at one end thereof adapted to engage the outer end of the mouth piece in order to hold the rod in inoperative position, there being resilient means within 7 the device for moving the said operating rod to eject tobacco from the holding portion when the aforesaid hook is released.
3. A device of the class described com-- prising a mouth piece, a chamber between 8 the mouth piece and the holding portion containing a filter, an operating rod adapted to expel a cigar or cigarette extending longitudinally of the said device, the outer end of the rod being provided with means 8 for engagement with the inner portion of the said tobacco, resilient means whereby the said operating device is actuated, one end of the rod being provided with a. hook whereby it may engage the end of the mouth 9 piece and be held in inoperative position, release of the hook permitting the resilient means to actuate the rod and eject the tobacco from the holding portion.

A device of the class described com- 9 prising a mouth piece, a tobacco holding portion, a chamber between the mouth piece and the holding portion and containing a filter, an operating rod adapted to expel a cigar or cigarette extending longitudinally 1 of the device, a spring in engagement with the said rod and means at one end of the rod for engagement with the end of the mouth piece whereby the rod may be held in inoperative position, release of the said means permitting the spring to actuate the rod to eject the tobacco from the holding portion.
5. In a device of the class described. a
mouth piece, a tobacco holding portion, an 1' operatingrod extending through the said device and having means comprising av U- shaped member at one end thereof having a portion adapted to engage the outer end of the mouth piece, together with resilient means surrounding the said operating rod and in engagement therewith whereby when the said U-shaped member is released, the said spring will forcibly eject the:tobacco from the said holding portion.
6. In a device of the class described, the combination of a suitable tobacco holding portion having an operating rod extending longitudinally thereof with means at one end thereof adapted to engage the end portion of the holder adjacent the mouth piece, the opposite end of the said rod being provided with means adapted to engage the end of the tobacco within the holder, there being resilient means in engagement with the Q cpm'bination of a tobacco holder having outer end of the said operating rod, together operating rod and resilient means are brought into inoperative position when the holder is inserted within the case.
7. In a device of the class described, the combination of a tobacco holder having an operating rod extending longitudinally thereof with a holding means at one end thereof for engagement with the outer end of the said holder, the opposite end of the rod being provided with a pisto-n, thcre being a-spring surrounding the said rod and in engagement with the said piston, the said piston being adapted for movement within the said tobacco holding portion of the device, together with a casing having a cylindrical portion adapted to enter the tobacco holding portion of the device and into engagement with thesaid piston whereby the piston and operating rod may be moved longitudinally of the holder whereby the said holding means may come into engagement with the end of the said holder in order to hold the said piston and spring in,
inoperative position.
8. In a device of the class described, the combination of a tobacco holder having resilient means therein and movable longitudinally thereof for forcibly ejecting the tobacco, from the said holder, together with a suitable case having a cylindrical portion adapted to enter the said tobacco holding portion and move the said ejecting means to inoperative position when the said holder is-inserted in the said case. ,19. In a device of the. class described, the
means therein comprising a spring for forcibly ejecting tobacco from the holder, together with a case therefor, the said case being provided, with a cylindrical portion adapted to enter the said holder and bring the said ejecting means the said holder is inserted in the said case.
10. In device of the class described, a tobacco holding member having positioned therein a perforatil'lg device, the said membersof which are provided with longitudinal slots, the end of the said members being adapted to enter into the end portion of the said tobacco with-the said slots lying partly within and partly without the said tobacco whereby the holder may be used without biting oil the end of the cigar.

A device of the class described comprising a tobacco holder having a perforating device therein, the said device being made up of longitudinally extending'side members, each of which is provided with a longitudinal slot, the outer ends of the said side members being adapted to enter the said cigar or cigarette with the said longitudinal to inoperative position whenholding member being in communication with each other, together with a perforating device positioned within the holding member and adapted to enter the end of a cigar or cigarette, the said perforating device embodying longitudinally extending pointed members, each provided with a longitudinal slot.
