Statement motivated according to articles 29.6 and 29.7 of the Regulations for the execution of Law 11/1986, of March 20, on Patents on novelty and inventive activity; quotes and explanations in support of this statement El presente informe se basa en la solicitud de patente ES201130357 que consta de 5 reivindicaciones. El objeto de la invención es un cepillo eléctrico para el cuidado del cabello. El documento D01 (resumen, columna 5 líneas 19 a 23 y figuras 7 a 9), se puede considerar el estado de la técnica más cercano. En él se divulga un cepillo eléctrico para el cuidado del cabello, que comprende un mango (12), y un cuerpo tubular (14), que presenta unos orificios (18) a través de los cuales emergen al exterior unas púas (16) dispuestas sobre un núcleo de soporte (24), que comprende un elemento de calentamiento (38), encerrado en la superficie interna del núcleo de soporte el cual, al igual que el cuerpo tubular, puede estar fabricado íntegramente en material cerámico, conectado a un circuito eléctrico (172). No se encuentra comprendido de manera idéntica en el Estado de la Técnica anterior y por tanto es nuevo (Art. 6.1 LP 11/1986) Difiere de la solicitud en que el elemento de calentamiento no está impreso sobre la superficie interna o externa del cuerpo tubular ni está alimentado eléctricamente a través de unas patillas que permiten el conexionado a los medios de alimentación eléctrica. Esta forma de calentamiento es ampliamente conocida y empleada en Estado de la Técnica, y de manera particular en el campo de los aparatos para el cuidado del cabello, como mencionan los documentos D02 a D04. El documento D02 (reivindicaciones y figura 2) hace referencia a un aparato para el cuidado del cabello, que comprende un elemento de calentamiento (26) impreso sobre la superficie interna o externa de la placa fabricada en material cerámico, en donde dicho elemento de calentamiento está alimentado eléctricamente a través de unas patillas (28) que permiten el conexionado a los medios de alimentación eléctrica. Luego, la reivindicación 1 carece de actividad inventiva (Art.8.1 de la Ley de Patentes). El documento D01 muestra una disposición particular de la púas que permite que estas sean retractiles, pero la opción de diseño mencionada en la solicitud es de conocimiento general, como muestran los documentos del D05 a D07, e incluso el propio solicitante tiene una patente, el documento D05, dónde se divulga un cepillo con un mango (1) y un cuerpo tubular (2) que presenta unos orificios (21) a través de los cuales emergen al exterior unas fibras (41) fijada helicoidalmente a un núcleo de soporte (4), donde los orificios presentan forma poligonal, y están dispuestos formando alineaciones oblicuas respecto al eje longitudinal del cepillo y separados. El documento D06 muestra una disposición similar al documento D05. El documento D07 presenta unos orificios circulares que sobresalen de un cuerpo tubular de aluminio recubierto de cerámica. Por consiguiente, la reivindicación 2 adolece de actividad inventiva (Art.8.1 de la Ley de Patentes). Ninguno de los documentos citados muestra un calentamiento impreso sobre un substrato de material siliconado fijado sobre el cuerpo tubular de cerámica, luego la reivindicación 3 presenta actividad inventiva (Art.8.1 de la Ley de Patentes). El elemento de calentamiento (6) (reivindicación 4 documento D02) puede aplicarse mediante serigrafía, por impresión mediante transferencia, mediante fotolitografía u otros medios análogos y (reivindicación 6 documento D02) está realizado en tungsteno, níquel, plata o platino. Los documentos D03 y D04 muestran métodos y materiales similares. Por tanto, las reivindicaciones 4 y 5 no tienen actividad inventiva (Art.8.1 de la Ley de Patentes). El documento D08 (párrafos 37 y 39, figuras 3 y 11) divulga al igual que el D02, un cepillo eléctrico que comprende un mango, una superficie de contacto con el cabello, de la cual emergen unas fibras, que comprende un elemento de calentamiento (40) conectado directamente bajo la superficie, realizada de un material cerámico. None of the cited documents show a printed heating on a substrate of siliconized material fixed on the ceramic tubular body, then claim 3 shows inventive activity (Art. 8.1 of the Patent Law). The heating element (6) (claim 4 document D02) can be applied by screen printing, by transfer printing, by photolithography or other similar means and (claim 6 document D02) is made of tungsten, nickel, silver or platinum. Documents D03 and D04 show similar methods and materials. Therefore, claims 4 and 5 have no inventive activity (Art. 8.1 of the Patent Law).
