Abstract

ABSTRACT OF THE DISCLOSURE

A stackable package for protecting edible food product contents is formed by a flexible bag attached inside a relatively rigid box. The box is open on only one side, through which extends a reclosable end of the flexible bag. The reclosable end begins to taper just above the open box edge, so that the box does not impede opening. The package, when placed on its side, is stackable in that it can support other boxes on a side opposing that side upon which the box rests. The flexible bag may be foil-lined to act as a moisture barrier to protect fresh-ness.

BACKGROUND OF THE INVENTION
Thls lnventlon relates to packages for carrylng, dls-playing, and storlng bakery or food products.
This lnventlon relates to containers which may be made and shipped ln fla~ collapsed rorm, and whlch may be readlly opened up and employed ~or the storage~ shlpment, and dlspenslng Or bakery products, cooklesl cracker3, lamlnated food products> ~r any other franglble, or fraglle goods.
In the conventlonal bag-llke package, the welght of the commodlty wlthln the package causes bulglng of the sldes and bottom Or the fllled package so that such prlor art packages are not self-~upportlng ln an uprlght posltion and must usual:y be stacked on thelr sldes on a grocer's shelf, thus conceallng portlons o~ the package and the advertlslng thereon. ~urthel-more, such packages cannot be ~tacked on the grocer'~ shelves ~lnce the welght of the overlying packages would tend to cru~h and break franglble contents thereln ~uch as baked prvducts ln-cludlng cookies, cracker~, and the llke.
Attempt~ have been made ln the prlor art to overcome the dlsadvantages as30clated wlth flexlble bag-llke contalners.
Typlcal of the prlor art attempts to solve the above problems assoclated with bag-llke packages ls the type dlsclosed by Vergobll ln U.S, Patent No. 2,678,768 and Kozlow~kl et al ln U.S. Patent No. 3,896,991.

The Kozlowski et al patent dlscloses a composlte package having a plv o~ flexible sheet materlal laminated lnslde and another flexlble ply out~lde a relatively rigld material layer.

SUMMARY OF THE INVENTION
It is accordingly one object o~ the present lnventlon to provlde an lmproved package which ls lnexpenslve to rabrlcate, requires no extraordlnary equlpment in the fabrlcation thereof, and that ls formed of readlly avallable materlals that can be manufactured by persons skllled ln the package art.

A still further object of the present invention is to provide an improved package having a relatively flexible bag-like member retained within and supported by a relatively rigid outer box member so as to permit stacking of the container in vertical columns on a grocer's shelE, within larger shipping containers, or within a purchaser's cupboard.
Another further object of the present invention is to provide an improved container formed of a flexible bag member attached by only a single attaching point within a relatively rigid outer container so that ease of assembly results as well as economy of production.
A still further object of the present invention is to provide an improved package having a box-like, relatively rigid member which can be folded from a blank and which can receive and be attached to a flexible bag-like member for the support of frangible, fragile food products such as crackers, laminated cookies, and the like.
The invention is directed to a stackable soft-top package having a rigid container with a flexible bag located therein, said container and said bag having adjacent sealed ends, characterized in that the rigid container has an open end opposite said sealed end and said bag has a recloseable end opposite said sealed end, wherein said recloseable end of said bag extends beyond said open end of said container, said bag tapering from said open end of said container to said recloseable end of said bag, whereby opening and closing of the bag is not impeded by the container, said package being further ~29~S5~9 characterized in that said bag is permanently Eixed to said container by an adhesive material connecting a portion of an outer surface of said bag to an inner surface of said container.
The improved container of the present invention comprises a light-weight, flexible bag-like member which is recloseable and which can be supported for stacking by a box-like member which is formed from a flat blank. The box-like member has four upright walls and a bottom, with the top being open so as to receive a bag-like flexible member. The bag-like flexible member, once positioned within the box-like member~ is secured thereto by a single spot of adhesive or glue located at an inner upright wall of the box-like member and attached to an upright outer portion of the bag-like member. The box-like member has two narrower ~ides opposlte one another and two longer sides of equal wldth located opposite one another. In use, the a~sembled contalner fllled with the food products deslred ls placed upon elther of the narrower sldes and other llke containers may be supported vertically atop the opposlng vertlcal slde of the contalner. This results in efficlent use of supermarket ~helf space whlch ls not posslble wlth flexlble bag-like contalners alone.

DETAILED DESC~IPTION OF THE INVENTION
A stackable, soft-top package 1~ shown in perspectlve ln flgure 1. As can be seen, a flexlble bag havlng a front slde lO is retalned wlthln a relatlvely rlgld contalner having up-standlng slde walls. A label 5 19 shown attached to the front wall 8 of the box member. The lower box member ls formed o~
sheet material whlch may comprlse any of the usual or preferred contalner-formlng materlal~, but preferably may comprlse a sheet o~ cardboard, stlf~ paper, plastlc, or other relatlvely strong sheet materials and the lnner bag structure may be con-structed of relatlvely flexlble materlals used ln the food product packaglng art, such as a lamlnated foll-paper ~tructure for preservlng fre~hnes3. However, any materlals may be used havlng the requlred relative stlffness or flexlblllty. For ex-ample, the bag~ may be formed of cellophane, flexlble plastlc, brown paper, paper, wlre mesh, foll, cloth, or any other flex-lble materlal.
The box member may be constructed of cardboard ln a pre-rerred embodlment; however, any other packaglng materlal may be used that 1~ surflclently ~strong to permlt stacklng of the con-talner~ ln a vertlcal colum~. For example, the followlng ma-~z~s~

terlals may advantageously be used for the box member materl-als: stifr cardboard, plastlc, ~heet plastlc having llving hinges to serve to connect the sldes, ~heet metal, wood, foamed plastlc, and the llke. The bag-like member tapers ~ust above the box-llke member, ~o that opening Or the bag-like member 18 not lmpeded by the box-like member.
The box member ls formed by lert-hand ~lde wall 2, front wall 8, rlght-hand slde wall 7, rear wall 13j and bottom 6.
The box memb~er may be formed by foldlng from a blank, moldlng operatlons, or the llke. A label 5 may be attached to any surface, or plural labels may be applied to a plurallty of ~urraces Or the box member. If the box member has been formed from a blank, the bottom 6 wlll be composed of glued or other-wise sealed flap members a~ shown ln r1 gure 8. The box member need not have the up~tanding walls arranged ln a rectangular cross-section, but may be formed lnto any conflguratlon o~
wall~ havlng at least two parallel space opposlng walls such as a hexa~on, octagon, or the llke. In any case, the bag-like member tapers ~ust above the box-llke member, 80 that opening of the bag-llke member is not lmpeded by the box-like member.

Flgure 4 shows the rear of the container of the present i lnventlon, and clearly shows deformable bag fastener elements 12 at each slde of the reclosable end portlon 4 of the bag mem-ber. The deformable bag fastener el-ements 12 are well-known in the art, and may be formed of lamlnated plastlc or paper havlng two reinforcing wlres wlthln for closing and openlng the bag member and retalnlng the ~olded over portlon 4,5 ln closed po-sltlon. The adheslve, which may be anlmal glue, hot melt adheslve, wood glue, rubber cement, pressure-sensltlve adhe~lve, or any adheslve or bonding materlal or element sultable for the materials used, ls shown ln dotted outllne as adheslve 16 ln flgure 4. The shape of the adheslve 16 formlng a bond or connectlon between the rear slde 14 of the bag member and the rear wall 13 of the box member need not be of clrcular or oval shape, but may be of any shape or cluster Or smaller bonds that ls economical to apply and yet retalns the ba~
member wall agalnst the adjacent box member wall. Here al~o, the bag member ls shown both ln upper solld outllne and lower dotted outllne for clarlty.

Flgure 6 i8 a cut-away perspectlve vlew showing the ar-rangement of bottom flaps that form bottom 6 in the preferred embodlrnent of the present lnvent;ion. Short, slde flAps 2,7 overlie wlder bottom flap 8, whlch ln turn overlles wlde bottom flap 6. Preferably, flap 6 and flap 8 are bonded to one an-other by glue, hot melt adhesive, pressure-sensitive adhesive, ultasonlc weldlng in the case of plastic or metal, or any other known bondlng or fa3tenlng method. Flap 4 and flap 7 may be slmilarly adhered to flap 8 or flap 13 although thls ls not necessary and may be omitted. The flaps may be of any deslred cross-sectlonal shape or conflguratlon, and may advantageously be varled in the case of a contalner havlng slde walls in a hexagonal, octagonal, or the like conflguration. The wall thicknesses have been exaggerated for clarlty.
- Figure 7 ls a view from the bottom of the contalner show-lng the ~laps in open posltlon parallel to the line Or sight of the vlewer. The wall thicknesses have been exaggerated ~or clarity. The bottom of the bag member, deslgnated as bottom portion 10 ln rigure 7 ls shown. A sealed bag end portlon 18 ls also shown ln flgure 7, ln the preferred embodiment. None-theless, any bag-sealing means may be used, or in the case o~ a molded bag havlng an open top and lntegral bottom, no bag-seallng means at all need be used.

Figure 8 is a plan vlew of the lower part of the package which can be folded to form the box member. The fold llnes are designated "F", and small flap 17 is ~hown whlch may advan-tageou~ly be used to connect front wall 8 to right-hand slde wall 7 of the box member to form the enclosure shown in the ; preferred embodlment of flgure 6. Flap 17 is preferably ln-tegral wlth front wall 8 and ls preferably adhered to rlght-hand slde wall 7 by anlmal glue, hot melt adhesive, pressure-sensitive adhe~lve, or the llke. The solld llne~ ~eparatlng flap 7 from fla~ 13, flap 13 from flap 2, flap 2 from flap 8, are cut line~. Addltlonally, flap 17 18 connected to front wall 8 along a fold llne whlch ls shown ln figure 8 a~ a solid llne.
Whlle not speciflcally shown in the drawlngs, lt ls con-templated that the container of the present lnventlon may ln-corporate advertlslng locations, such a~ decalcomanla, labels, pockets, or any other accouterments whlch are conventional ln the package art.
'The lmproved container of the present lnventlon 1~ capable ~ of achievlng the above enumerated objects and whlle preferred embodiments of the present lnventlon have been dlsclosed, lt wlll be understood that lt ls not llmlted thereto but may be otherwlse embodled within the scope of the followlng clalms.

Claims (8)

The embodiments of the invention in which an exclusive property or privilege is claimed are defined as follows:
1. A stackable soft-top package having a rigid container with a flexible bag located therein, said container and said bag having adjacent sealed ends, characterized in that the rigid container has an open end opposite said sealed end and said bag has a recloseable end opposite said sealed end, wherein said recloseable end of said bag extends beyond said open end of said container, said bag tapering from said open end of said container to said recloseable end of said bag, whereby opening and closing of the bag is not impeded by the container, said package being further characterized in that said bag is permanently fixed to said container by an adhesive material connecting a portion of an outer surface of said bag to an inner surface of said container.
2. The soft-top package of claim 1, further characterized in that said recloseable end is provided with a tin-tie fastener, whereby said bag may be tighly closed after the hag is opened.
3. The soft-top package of claim 2, further characterized in that the bag is a laminated material having a metallized flexible inner layer and an outer paper layer for maintaining freshness of food products contained therein.
4. The soft-top package of claim 3, further characterized in that the adhesive material is a hot melt adhesive.
5. The soft-top package of claim 3, further characterized in that the adhesive material is animal glue.
6. The soft-top package of claim 3, further characterized in that the adhesive material is rubber cement.
7. The soft top package of claim 3, further characterized in that the bag substantially fills the container and tapers outside of the container with converging front and rear walls, said front and rear walls held in overlapping relation by means of said tin-tie.
8. The soft-top package of claim 7, further characterized in that the package is collapsible to a substantially flat shape for ease of storage and shipping.
