Abstract

ABSTRACT OF THE DISCLOSURE A capsule or over-closure of molded plastic material for use with a cork-stoppered bottle and which overlies the cork and bottle mouth and adjacent neck. The capsule has integrally molded skirt, guarantee strip, and upper circular disc with the guarantee strip being joined along its lower edge to the skirt by a circumferential line of weakening. The strip has an upper rad-ially inwardly extending surface meeting the central disc along a circular line of weakening, and the strip has two spaced-apart ends which diverge inwardly providing an inwardly widening open-ing in the radially inwardly extending surface to facilitate removal of the strip or disc.

BOTTLE CAPSULE OR CLOSURE

The present invention relates to a capsule or over-closure of molded plastic material for use primarily wtih a cork-stoppered bottle and which overlies the cork and bottle ; mouth and adjacent neck, and which protects the cork from damage during transit and handling while providing a guarantee clos-ure against tampering prior to final purchase. The capsule in-cludes an integral guarantee strip or band which is readily and simply removable by hand without the requiring of the use of any tool.
More specifically, the present invention relates to a capsule or over-closure for a bottle having integrally molded skirt, guarantee strip and upper circular disc with the skirt and strip being joined together along a severable circumferential line of weakening. The strip has an upper radially inwardly ex-tending surface meeting the central disc along the circular line of weakening, and the strip has two spaced-apart ends providing an inwardly widening opening in the inwardly extending surface to facilitate removal of the strip and/or disc.
The invention also relates to a bottle capsule or over-closure wherein the inner surface of the skirt portion is provided with three spaced-apart circumferentially extending ridges adapted to engage beneath an exterior collar or circumferential projec-tion on a bottle neck, the ridges having upper and lower inclining surfaces, the inclination of the upper surface being greater than the inclination of the lower surface thus facilitating position-ing of the capsule on a bottle and preventing inadvertent removal.

DISCUSSION OF THE PRIOR ART
Bottle capsules having skirts and guarantee closures are generally known in the art, and as representative of such known 30 structures, reference may be had to Canadian Patent 815,366, issued June 17, 1969 - H. Marcel.

~13~579 . The removal of the guarantee strip according to Can-adian Patent 815,366 is facilitated by the presence of a tab se-cured to the guarantee strip. However, the provision of such a tab complicates the molding procedure, and requires precise and rather expensive molds, and the tab end is subject to damage during hand-ling and transport. Any inadvertent damage to the tab may cause the guarantee strip to be partially damaged, thus rendering the final sale to the consumer more difficult.
OBJECTS OF THE PRESENT INVENTION
An object of the present invention is to provide for - simplified construction of a bottle capsule which includes simpli-fied means for removing the guarantee strip and/or a central disc without the necessity of having to use a tool such as a knife to assist in the removal of the closure and which guarantee strip and removal means are not subject to damage during transport and handling, and which is economically produced.
- A more specific object of the invention is to provide ~ a bottle capsule of plastic material comprising integrally molded ': skirt, guarantee strip and upper circular disc, the guarantee strip 20 being joined along its lower edge to the skirt by a circumferential line of weakening, the strip having an upper radially inwardly extending surface meeting the central disc along a circular line of weak-ening, the strip having two spaced-apart ends which diverge inwardly providing an inwardly widening opening in the radially inwardly extending surface to facilitate removal of the strip or disc.
A further object is to provide a capsule as above described wherein the circular line of weakening between the strip and the disc consists of alternating connecting bridges and open or thin membrane portions, the first of the posts on - each side of the generally triangular shaped opening being spaced 113~i579 apart at an angle extending outwardly from the center of the disc of about 40. In preferred a-rangement the two spaced-apart ends diverge inwardly at an angle of about 40 and the inwardly widening opening is of generally triangular configuration.
A still further object of the invention is to provide a capsule as above described wherein the inner surface of the skirt portion is provided with three spaced-apart circumferential ridges adapted to engage beneath an exterior collar provided on a bottle neck, the ridges having upper and lower inclining surfaces, the inclination of the upper surface being greater than the inclina-tion of the lower surface facilitating positioning of the capsule on a bottle and preventing inadvertent removal.

The inventive concept will now be more fully described and understood with reference to the accompanying drawings, wherein:

DETAILED DESCRIPTION OF ACCOMPANYING DRAWINGS
Reference will now be had to the accompanying drawings wherein like reference numerals refer to like parts.
The capsule according to the invention is shown gen-erally in Figures 1, 2 and 3, by the numeral 2. The capsule consists of a lower skirt or bottle-neck engaging portion 4, a removable guarantee strip or band 6, and an upper central disc portion 8.

and during molding lines of weakening are provided between the skirt 4 and the guarantee str~p 6 (as shown at 10) and also be-tween the guarantee strip 6 and the central disc 8 (as shown at 12). The line of weakening 10 is formed in conventional manner and consists of spaced bridges 14 extending between and connecting the skirt 4 with the guarantee strip 6 with the areas 16 between the bridges either being open, providing a circular line of perforations, or closed by a thin weak layer or membrane of molded material.
The line of weakening 12 joining the guarantee strip 6 and the central upper disc 8 consists of spaced posts or bridges 18 joining the two components with the areas (not numbered) be-tween the joining posts either being open or closed with a very thin layer or membrane of molded material depending upon the pre-ciseness of the molds used during the manufacture of the capsule.
The present invention avoids the difficulties inherent in the prior art guarantee band arrangements as discussed above with reference to Canadian Patent 815,366 by simplified construc-tion and by facilitating the removal of the guarantee band through the use of a thumb or a fingernail without requiring any tools while at the same time avoiding minimizing any possible damage to the capsule closure during transport and handling.
To achieve these advantages and as shown in Figures 1 and 2, a vertical space or gap 20 is left between the ends of the guarantee strip 6 to facilitate removal. The top surface 22 of the guarantee strip extends radially inwardly a distance to meet the disc 8 along the line of weakening 12, and to facilitate removal of the guarantee strip by a finger or a thumbnail, the edges 24 at the ends of the guarantee strip and top surface diverge inwardly in V-shaped or generally triangular configuration, providing an inwardly widening opening enabling a thumb or finger-nail to be slipped behind the edges 24 of the guarantee strip to provide a firm grasp and facilitate removal of the guarantee 1~3~`57~

strip. The exact dimensions of the gap 20 and the angled guaran-tee strip edges 24 are not critical to the inventive concept, but in practice, a gap width of about 3/32 inches to 1/8 inch is com-pletely satisfactory with the edges of the guarantee strip diverg-ing inwardly at an angle of about 40 as shown by angle ~ in ! Figure 2.

To enable simplified insertion of a fingernail and easy removal of the guarantee strip, the first connecting posts 18 or ; bridges between the disc 8 and strips 6 adjacent the gap 20 are spaced apart at anangle of about 40 as shown by angle~ in Fig-ure 2. This positioning of the first post does not weaken the ' connection between the strip 6 and disc 8 to any appreciable degree, but these spaced apart posts do facilitate access and removal of the guarantee strip.
According to the present invention, either or both the : guarantee strip 6 or the disc 8 can be removed to provide access to cork 26 which may then be removed in conventional manner. Be-cause of the spacing of the posts 18 on each side of the gap 20 and the angling of the edges of the strip 6, access to the adja-cent edge of the disc 8 is possible using a thumbnail, and it is possible to remove the disc 8 by tearing along the line of weak-ening 12, while leaving the guarantee strip 6 still attached to the skirt portion 4.
Because of the central positioning of the disc 8 and the line of weakening 12 removal of the disc and the cork 26 at the same time are possible by simply inserting a corkscrew direct-ly through the disc and into the cork and withdrawing the cork-screw in the usual manner. This procedure will leave the strip 6 , intact with the neck portion 4.
Alternatively, however, the guarantee strip may be re-moved, and this is easily accomplished by inserting a thumb or fingernail into the gap 20 and then simply tearing the guarantee strip 6 from the skirt 4, and which also results in a removal of still connected disc 8, thus enabling full access to the cork 26 for removal.
A further feature of the capsule according to this invention is shown in Figures 3 and 4, and which shows the pro-vision on the inside surface of the skirt portion 4 of inwardly directed ridges 28 which upon application of the capsule 2 to a cork-stopped bottle become positioned beneath the rounded collar 30 on the bottle to prevent against removal of the capsule from the bottle. As shown in Figure 4, three of these ridges 28 are provided at spaced distances around the interior circumference , of the skirt 4, and each of these ridges 28 have upper 32 and lower 34 surfaces with the slope or incline of the upper sur-face 32 being greater than the slope or incline of the lower sur-face 34.
This enables a capsule to be smoothly positioned on a bottle neck due to the shallower incline of surface 34, but the greater inclined surface 32 snugly bears against the lower sur-face of the bottle collar 30 to guard against inadvertent re-moval.
These ridges enable the capsule to be easily applied to the bottle and after snapping beneath the bottle collar the ridges resist and prevents removal. The ridges are spaced apart to permit expansion in case of variations in the dimensions of the bottle neck which inevitably occurs. Three spaced apart ridges are shown in Figure 4, and this is the preferred embodi-ment, although it will be appreciated that four of any number of ridges could be used without departing from the scope of the inventive concept.

Claims (5)

THE EMBODIMENTS OF THE INVENTION IN WHICH AN EXCLUSIVE
PROPERTY OR PRIVILEGE IS CLAIMED ARE DEFINED AS FOLLOWS:
1. A bottle capsule of plastic material comprising integrally molded skirt, guarantee strip and upper circular disc, the guarantee strip being joined along its lower edge to the skirt by a circumferential line of weakening, the strip having an upper radially inwardly extending surface meeting the central disc along a circular line of weak-ening, the strip having two spaced-apart ends which diverge inwardly providing an inwardly widening opening in the radially inwardly extending surface to facilitate removal of the strip or disc.
2. A capsule according to claim 1, wherein the cir-cular line of weakening between the strip and the disc consists of alternating connecting bridges and open or thin membrane por-tions, the first of the posts on each side of the generally tri-angular shaped opening being spaced apart at an angle extending outwardly from the center of the disc of about 40°.
3. A capsule according to claim 1 or 2, wherein said two spaced-apart ends diverge inwardly at an angle of about 40°.
4. A capsule according to claim 1 or 2, wherein the inwardly widening opening is of generally triangular configura-tion.

5. A capsule according to claim 1 or 3, wherein the inner surface of the skirt portion is provided with three spaced-apart circumferential ridges adapted to engage beneath an exterior collar provided on a bottle neck, the ridges having
