-1- 00 A METHOD OF MANAGING A COMMUNICATION FOR A MOBILE TELECOMMUNICATION DEVICE 0 FIELD OF INVENTION The present invention relates to a method of managing telecommunications.
The present invention has particular but not exclusive application for managing a telephone call or a Short Message Service (SMS) message or Multimedia Message 00 Service (MMS) message received and sent by a mobile phone or Personal Digital Assistant (PDA).
0 BACKGROUND OF THE INVENTION Mobile phones and PDAs have become more versatile over the years and these telecommunication devices can now be used to receive and send different types of communications. The different types of communications that are available include telephone calls, SMS messages, email messages, MMS messages and internet access.
Recordings of telephone conversations and copies of SMS messages, MMS messages or email messages can be kept on a mobile phone or a PDA. This enables the person using the mobile phone to keep a record of their communications with various parties. As the recordings of telephone calls and copies of SMS messages, MMS messages or email messages can be edited and or deleted from the mobile phone or PDA, the record of the communications between the parties involved may not be complete.
Where there is a need to provide an account of the communications between parties, an incomplete record of communications will provide an inaccurate history of 00 S the interactions between the parties. An incomplete record of communications may also be misrepresentative of the interactions between the parties. An incomplete Z record of communications between parties is particularly problematic when the recorded communications are being used as evidence in legal proceedings.
The ability to edit recorded communications from a mobile phone or PDA by deleting certain telephone conversations or deleting part of a telephone conversation enables tampering of the recorded communications. With the possibility of 00 tampering of the recorded communications, the communications are not considered a reliable or accurate account of the interactions.
0 A software product called Mobile-Secuware has been sold and is installed on mobile phones to record all communications on the mobile phone. However, the recorded communications can be deleted from the mobile phone installed with Mobile-Secuware and the software product does not safeguard against editing of recorded communications.
At present there is no tamper-proof method of recording telecommunications on mobile devices.
OBJECT OF THE INVENTION It is an object of the present invention to provide an alternative method of managing a communication for a mobile telecommunication device that overcomes at least in part one or more of the above mentioned problems.
SUMMARY OF THE INVENTION In a first aspect the present invention broadly resides in a method of managing a communication for a mobile telecommunication device including 00 0 receiving or sending a communication via specified contact details from or to a person respectively or mobile premium service; Z determining whether the specified contact details is on a list of contact details of relatively significant persons or mobile premium service; recording the communication if the specified contact details are on the list of contact details of relatively significant persons or mobile premium service, the recording is initiated before a connection is established for the communication; and oo00 storing the recorded communication in a storage means wherein the recorded communication cannot be edited or deleted.
0 The specified contact details are defined in this specification to include a displayed telephone number, a withheld or private telephone number, a public telephone number or an email address or mobile premium service number. The contact details for a person can include more than one telephone number and email address for that person.
The relatively significant persons are defined in this specification to be persons that are regarded as significant to an owner or an authorized user of the mobile telecommunication device and all mobile premium service numbers. The relatively significant persons may include a person associated within legal proceeding or a business associate.
The list of contact details of relatively significant persons preferably include those details of persons that are regarded as significant to an owner or an authorized user of the mobile telecommunication device, withheld or private telephone numbers or mobile premium service and public telephone numbers.
Preferably the storage means is secured from tampering, editing and unauthorized deleting.
00 0 The storage means preferably permits the owner or the authorized user to only read the recorded communication.
Z The storage means is preferably a form of data storage memory.
The recorded communication is preferably copied and forwarded to one or more defined recipients. The defined recipient is a computer, server, electronic storage device or one or more persons who are not relatively significant persons.
The defined recipient preferably provides remote safe storage of the recorded oo00 information.
The communication is preferably an audio based communication, an image 0 based communication, a text based communication, or a combination of audio and image based communication.
The communication preferably includes a telephone call, a short message service (SMS), a multimedia message service (MMS), instant messaging a video call, an internet connection, an email or a diary event that is manually entered into the mobile telecommunication device.
Prior to transmitting or accepting the communication but after the relevant send or answer button has been pushed, the contact details are preferably checked against the list of contact details of relatively significant persons and mobile premium service numbers. If the contact details are on the list of contact details of relatively significant persons or mobile premium service, then the communication is preferably recorded.
Preferably, when the communication is accepted and transmitted a date and a time of establishing the communication is recorded. The recorded date and the time is preferably associated with the recorded communication.
00 0 The recorded communication preferably provides a continuous and complete history of an interaction with an individual on the list of contact details of relatively S significant persons or mobile premium service.
In a second aspect the present invention broadly resides in a method of managing a communication for a mobile telecommunication device including receiving or sending a communication via specified contact details from or to a person respectively or mobile premium service; 00 determining whether the specified contact details is on a list of contact details of relatively significant persons or mobile premium service numbers; 0 recording the communication if the specified contact details are on the list of contact details of relatively significant persons or mobile premium service, the recording is initiated before a connection is established for the communication; storing the recorded communication in a storage means wherein the recorded communication cannot be edited or deleted; and forwarding the recorded communication to one or more defined recipients that remotely stores the recorded communication.
All the above mentioned features of the first aspect of the present invention apply to the second aspect of the invention.
The defined recipient is preferably a computer, server, electronic storage device or one or more persons who are not relatively significant persons. The defined recipient preferably provides remote safe storage of the recorded information.
The forwarding of the recorded communication preferably occurs immediately after the recorded communication connection has terminated. Alternatively or in addition to the recorded communication is preferably forwarded after a specified time 00 interval. The time interval is preferably any suitable period between every (Ni minutes and once a week. The forwarding of the recorded communication preferably 0 S occurs twice. Preferably communication is forwarded and stored immediately when it is an SMS or diary event. The recorded communication is preferably forwarded daily from the device to the designated recipient thereby validating that the forwarding and confirmation processes are active.
The mobile telecommunication device preferably receives confirmation from oo00 the designated recipient after the defined recipient has saved a copy of the recorded communication. Preferably the mobile telecommunication device confirms that the 0 communication has been stored by changing the icon colour displayed in the events menu. Alternatively the mobile telecommunication device preferably receives a confirmation message from the designated recipient after the defined recipient has saved a copy of the recorded communication.
With confirmation of the receipt of a copy of recorded communication by the defined recipient, the recorded communication on the mobile telecommunication device is preferably deleted automatically or via the administrator. Alternatively, the mobile telecommunication device shows a prompt message to save or not save the recorded communication when the mobile telecommunication device receives a confirmation of receipt of the recorded message from the defined recipient. The owner or authorized user can then choose whether to save the recorded information on the mobile telecommunication device.
The abovementioned methods may optionally include a confirmation function whereby the mobile device contacts the defined recipient on a regular basis to confirm the active status of the device to forwarding communications. With the confirmation function, a confirmation message is preferably sent from the defined 00 S recipient to the mobile device if the mobile device has not sent a message for a prescribed period of time. A prescribed period of time can be from a day to a month.
S The authorized user can respond or the device can automatically respond to the confirmation message from the defined recipient. If there is no response, the defined recipient preferably notifies the administrator or other suitable persons to verify the wellbeing of the authorized user. Verification of the wellbeing of the authorized user is preferably by voice call.
oo00 The abovementioned methods may optionally include an alert function whereby the authorized user activates a network or GPS signal on the mobile device 0 enabling it to be tracked and located by police or other suitable persons. Preferably the authorized user will authorize the activation of the alert function on the mobile device by receiving and replying to a message that they have requested the alert function and accepted the charges for using the function.
In a third aspect the present invention broadly resides in a program that encodes the method of managing a communication for a mobile telecommunication device as described above.
Preferably the program is a software program.
Preferably all the features described above relating to the abovementioned methods apply to the program.
Preferably, the program is installed on the mobile telecommunication device via online download or by any other suitable means. The program preferably operates without or with minimal input from the authorized user or owner. The program preferably continuously monitors incoming and outgoing communications.
The operation of the program preferably cannot be turned off by the owner or authorized user.
00 The operation of the software program preferably shuts down when a (Ni malfunction occurs and the malfunction is recorded with a date and time of the 0 Z malfunction.
A malfunction message is preferably sent by the mobile telecommunication device to the designated recipient when the operation of the software program is restored. Preferably, the malfunction message is stored by the defined recipient.
The installation and operation of the software program is preferably controlled oo00 by the administrator.
Preferably, the administrator is the licensor of the software program.
0 The recorded communication in the storage means of the mobile telecommunication device is preferably accessible only to the administrator.
The administrator, authorized user or owner preferably enters the contact details on the list of contact details of relatively significant persons to apply with the software program. Mobile premium numbers are preferably issued with a program license.
The administrator or software program preferably sends an advice notification that communications will be recorded after entry of the contact details on the list of contact details of the relatively significant persons.
Preferably, the advice notification informs the individual on the list of contact details of relatively significant persons that the communication received from and sent to the individual will be recorded.
When a communication is received from new contact details recording of the communication is preferably initiated by activation of a record function key of the mobile telecommunication device.
00 0 Preferably, manual activation of the record function key initiates recording of any communication.
Z The new contact details are preferably added to the list of contact details of relatively significant persons.
Preferably, the addition of the new contact details to the list of contact details of relatively significant persons is done by the owner or the authorized user.
When a communication is received from a new phone number or email oo00 address, a prompt message from the software program preferably asks whether the new email address or phone number is to be added to the list of contact details of 0 relatively significant persons.
Preferably, only the administrator is allowed to delete specified contact details from the list of contact details of relatively significant persons.
Where an important event occurs, the software program is preferably programmed to send an alert to the defined one or more recipients informing them of the occurrence of the event. Events include the notification of the performance of an act, breach of a court order, receiving a message from a specified contact or registering for a mobile premium service and a diary reminder.
Where the program is registered for use by a minor, the method of adding or removing persons of interest preferably requires the approval of the minor's legal guardian.
The method of adding a person of interest is preferably the same for the registered minor as per any other authorized user except that the legal guardian will be notified that a request to add a number, name, email address etc, has been made by the minor.
10 oo00 0 With a minor who is an authorized user, their addition of a number, name, email address etc, preferably automatically generates a request to the guardian by Z SMS, MMS, email or any other suitable means.
The guardian can then preferably respond by either approving the addition and send an authorized message to the defined recipient, approve the addition and withhold notification to the defined recipient, or deny the request.
The approval for the addition of the number will be preferably received by the oo00 application and handles the return as appropriate. The legal guardian contact details are held within the license file of the software and is preferably checked when 0 incoming communication is received. If the incoming message is from the guardian the preformatted communication is preferably handled by the software. The guardian and minor preferably receive confirmation whether or not the number, name, email address etc has been added to the list of contact details of relatively significant persons.
The programming for a mobile device can also include the feature of confirming and logging communications with premium service numbers. The premium service numbers can be listed as contact details of relatively significant persons by directly listing or automatic listing as a result of their number prefix.
When a person receives a communication from a recognized premium service number, a message will preferably appear asking whether they wish to respond to the communication. The message may also provide a warning that any response may incur a fee and or register them with the provided service. With the identification of a communication being from or to a premium service number, the communication, duration, start and finish times are preferably recorded. Where a minor receives or sends a communication with a premium service number the legal 11oo00 guardian is preferably notified of the event. The legal guardian is preferably notified by an SMS message.
0 In one form, the abovementioned methods and software programming preferably only records communications that are transmitted over a network. The method and programming records internet connection time, bytes transferred, duration of communication, time of communication messages sent and retrieved, 00 and any other communication that may incur a charge. The recorded information is preferably forwarded to the defined recipient and can be reviewed to verify network 0 communications and network charges incurred The mobile telecommunication device preferably includes a mobile phone, a Personal Digital Assistant (PDA), a Voice over Internet Protocol (VolP) protocol or a computer.
In a fourth aspect the present invention broadly resides in a method of logging communications of a mobile telecommunication device including collecting a plurality of recorded communications using the method as described above; and assembling the plurality of recorded communications to form a complete history of the interaction with the individual on the list of contact details of relatively significant persons.
BRIEF DESCRIPTION OF THE DRAWINGS In order that the present invention can be more readily understood reference will now be made to the accompanying drawings which illustrate preferred embodiments of the invention and wherein: 12oo00 Figure 1 is a flow diagram showing an incoming phone call and a SMS message for a mobile phone according to preferred embodiments of the present 0 S invention; and Figure 2 is a flow diagram showing an outgoing phone call and a SMS message for the mobile phone according to other preferred embodiments of the present invention.
00 DETAILED DESCRIPTION OF THE PREFERRED EMBODIMENTS In order that the present invention can be more readily understood and put 0 into practical effect, the method of managing a communication via a mobile phone in different situations will now be described by way of using examples. Please note that the invention is not limited to these examples.
Example 1 The steps that occur when the mobile phone receives an incoming telephone call are described in this example. In this case, the incoming telephone call is received from a person who has a specified contact telephone number that is displayed on the mobile phone.
When an incoming telephone call is received from the person with a displayed telephone number, a software program installed on the mobile phone determines whether the displayed telephone number is a contact telephone number on a list of contact telephone numbers of black-listed persons (that is relatively significant persons).
If the displayed telephone number is a number from a black-listed person, a recording of the telephone call is initiated before a connection for the communication 13 oo00 S is established. In order to accept the incoming telephone call, the authorized user of the mobile phone presses the answer button on the mobile phone to establish a S connection for the incoming telephone call. The pressing of the answer button initiates recording of the communication before the communication has been accepted. When the telephone call is accepted a date and time of establishing the communication is recorded by the mobile phone. On completion of the telephone call, the communication is disconnected and the recording then stops. The recorded oo00 incoming telephone call is stored in a secured memory in the mobile phone as an audio file. The date and time of the incoming telephone call is also stored as part of 0 the recorded telephone call.
If the displayed telephone number of the incoming telephone call is not a number of a black-listed person, initiation of a recording is not necessary before the telephone call is accepted. The incoming telephone call is accepted and connected as a normal incoming telephone call without recording the communication. An option to record the incoming telephone call that is not from a black-listed person is available by manually activating the record function key of the mobile phone.
The secured memory of the mobile phone is not accessible to the authorized user or owner of the mobile phone. The recorded telephone call cannot be edited as the authorized user or owner are prevented from selectively deleting the recorded phone call or deleting part of the recorded phone call from the secured memory of the mobile phone.
The secured memory of the mobile phone has the capacity to store a number of recorded telephone calls. The recorded telephone calls are forwarded to a designated computer server that remotely stores the recorded telephone calls. The forwarding of the recorded telephone calls occurs after the audio file has been 14oo00 S closed and the connection has been terminated and after a defined time period that is specified by the authorized user. For example, forwarding of recorded telephone S calls can be set to occur every Wednesday at 8.00am of each week. This is used to send all communication from the device as a backup mechanism.
Since the recorded telephone calls cannot be edited, a log of telephone calls with the black-listed person is formed. All the recorded telephone calls with the black-listed person are collected and assembled to form a complete history of the oo00 interaction with the black-listed person.
After copies of the collection of recorded telephone calls have been saved by 0 the computer server, the mobile phone receives a confirmation message from the computer server to provide notification that a successful back-up of the recorded telephone calls has occurred. With receipt of the confirmation message, the mobile phone shows a prompt message to save or not save the recorded communication.
The owner or authorized user can then choose whether to save the recorded information on the phone.
The steps described above for managing an incoming telephone call for a mobile phone are actuated automatically by the software program installed on the mobile phone. The installation and operation of the software program is controlled by an administrator, such as the licensor of the software program. The operation of the software program cannot be turned off by the authorized user of the mobile phone. All telephone calls to the mobile phone are therefore monitored by the software program.
The administrator, owner or authorized user enters the contact telephone numbers on the list of contact details of black-listed persons within the software oo00 S program. Only the administrator is allowed to delete contact details of black-listed persons from the list.
Z The administrator or the software program automatically when activated sends an advice notification to the contact telephone number on the list of contact telephone numbers of black-listed persons informing them that communications received from and sent to their contact telephone number are recorded.
When there is a malfunction in the operation of the software program that oo00 results in shut-down of the software program, the date and time of shut-down are reported with a malfunction message. The malfunction message is sent by the 0 mobile phone to the server when operation of the software is restored. The malfunction message is stored by the external computer system. The malfunction message is sent only if the duration of the shut-down is about or greater than minutes.
Example 2 The steps that occur when the authorized user of a mobile phone makes or sends an outgoing telephone call to another telephone are described in this example.
The authorized user enters the specified contact telephone number of the person they are calling using the key pad of the mobile phone. Once the telephone number is entered, a determination is made by the software program described above as to whether the entered telephone number is a telephone number on a list of black-listed persons.
If the entered telephone number is a listed telephone number of a black-listed person, a recording of the telephone call is initiated before a connection for the 16 oo00 S communication is established. In order to transmit the outgoing telephone call the authorized user uses the call function as they would normally to dial the entered S number of the outgoing telephone call. Prior to dialing and establishing the communication, the telephone call is recorded with the activation of the call. When the outgoing telephone call is made or sent a date and time of establishing the communication is recorded by the mobile phone. On completion of the outgoing telephone call, the communication is disconnected and the recording then stops.
oo00 The recorded outgoing telephone call is stored in the secured memory of the mobile phone as an audio file. The record of the date and time of the telephone call is also 0 stored as part of the recorded outgoing telephone call. A number of recorded outgoing telephone calls can be stored in the secured memory of the mobile phone.
The recorded outgoing telephone call is forwarded to a designated computer server to store the recorded outgoing telephone calls. The forwarding of the outgoing telephone calls occurs in a similar way to the forwarding of incoming telephone calls as described above in Example 1.
After copies of the outgoing recorded telephone calls have been saved by the computer server, the mobile phone receives a confirmation message from the computer server to provide notification that a successful back-up of the outgoing recorded telephone calls has occurred. The confirmation message allows the forwarded recorded outgoing telephone calls to be deleted from the telephone memory.
The steps for managing an outgoing telephone call for the mobile phone are actuated by the same software program described above that manages the incoming telephone call.
17oo00 0 If the outgoing telephone call is made to a contact telephone number that is not a telephone number of a black-listed person, no recording of the communication S takes place. The outgoing telephone call is transmitted without initiation of a recording. The outgoing telephone call is transmitted and connected as a normal outgoing telephone call.
Example 3 00 In this example, the steps that occur when the mobile phone receives an incoming telephone call from an undisclosed telephone number are described. A 0 private telephone number and a public phone number are considered for this example to be telephone numbers that are undisclosed.
The software program described above is programmed to treat undisclosed telephone numbers as if the undisclosed telephone number is a contact telephone number from a black-listed person. A recording of an incoming call from an undisclosed telephone number is therefore always initiated before a connection for the telephone call is established. The steps that occur after the recording is initiated are all similar to the steps described above in Example 1 for an incoming telephone call from a displayed telephone number.
Example 4 In this example, the steps that occur when the mobile phone receives an incoming telephone call from a new telephone number that is displayed on the mobile phone are described.
18 oo00 When an incoming telephone call is received from a person with a displayed (Ni telephone number that is new, the authorized user initiates recording of the 0 Z telephone call by manually activating the record function key of the mobile phone.
The steps that occur after the recording is initiated are all similar to the steps described above in Example 1 for an incoming telephone call from a displayed telephone number that is a contact telephone number on the list of contact telephone numbers of black-listed persons.
oo00 In addition to the steps described above, a prompt message of the software program asks whether the new telephone number is to be added to the list of contact 0 telephone numbers of black-listed persons. The authorized user presses a response key of the mobile phone to enter the new contact telephone number to the list. An advice notification is sent to the new contact telephone number to advice recording of all telephone calls received from and made to the new telephone number.
Example The steps that occur when the mobile phone receives and sends a SMS are described in this example.
The steps to manage an incoming SMS are similar to the steps described above in Example 1 for managing an incoming telephone call except that the recording of the communication is in the form of duplicating or copying the SMS as a text file. The text file is stored in the storage memory of the mobile phone.
The steps to manage an outgoing SMS are similar to the steps described above in Example 2 for managing an incoming telephone call except that the authorized user types the text of the outgoing SMS before or after entering the telephone number of the person to which the SMS is being sent. The recording of 19- 00 O the communication is in the form of copying the SMS as a text file once the message has been sent from the device.
0 Example 6 In this example, the steps that occur when the mobile phone receives and sends an email message or a MMS message are described.
As an email message is a message having text, the steps to manage 00 incoming and outgoing email messages are similar to the steps described above for incoming and outgoing SMS messages in Example 0 The steps that occur to manage incoming and outgoing MMS messages are similar to those for incoming and outgoing email messages except that in addition to a text file, the MMS message has an image file, an audio file, a video file or a combination of these types of files attached to the emails.
Example 7 Some mobile phones have software that enables the user of the mobile phone to enter a diary note into their mobile phone. The steps to manage a diary note entry are similar to those described for an outgoing SMS.
The authorized user selects the diary function from the menu system. The user enters the diary note and presses the store function key. The communication is stored with other communication fileS.
The diary file is sent at the defined delivery time for communication.
After copies of the collection of communications have been saved by the computer server, the mobile phone receives a confirmation message from the computer server to provide notification that a successful back-up of the recorded 20 oo00 S communication has occurred. The confirmation message allows the software to delete recorded telephone calls that a copy of which has been forwarded and stored Z remotely.
ADVANTAGES
The preferred embodiment of the invention is to a method and software programming for a method of managing a communication for a mobile oo00 telecommunication device such as a mobile phone or PDA to record a communication when it has been sent from or to a significant person, being 0 significant relative to the device owner, so that a detailed and precise record can be made of the communications.
An advantage of the preferred embodiment of the present invention includes making a recording of a communication that cannot be edited or deleted.
Another advantage of the preferred embodiment of the present invention is the ability to make a log of communications with an individual. The log of communications includes a collection of recorded mobile phone calls, SMS, MMS and email with the individual. Since the recorded communications cannot be edited the content of the recorded communications forms a complete history of an interaction with the individual and may be used as evidence in legal proceedings.
VARIATIONS
