They do not communicate with you. I have been trying to talk with my account manager for months and he has not returned any of my phone calls or emails. I want out of the contract with them and they’re not addressing it. I even went to the Better Business Bureau and they lied to them and told them that they addressed the issue which they did not. I’m thinking about getting myself a lawyer so that we can just breach the contract and I pay for whatever it is to get out of the contract. I do not like them, and I suggest other carriers do not go with them.

Stay away from this company they play games and will not do what you ask of them. They don't answer emails,they don't help you, and everything is a penalty. They will not write me a letter of release and I have been ask for 3 weeks now.

First of all, I am absolutely positive that all of the five star reviews for this company are from bots or from Fleetsmarts Bluewater capital company themselves. They locked our company into a contract without any signature which forced us to have to opt out of our factoring contract with our previous provider. They are predatory and will not hold true to any of their contractual requirements. The entire customer service is outsourced to the Middle East, which creates the perfect recipe to be sent in a circle anytime you need assistance or clarification on why they have created mysterious fees or increased your factoring percentage. Originally we were supposed to receive a 2% factoring fee after we were forced into a contract with them. Needless to say that percentage has changed multiple times currently we are being charged 10.5% on all loads with no explanation every time we call customer service they say that they are attempting to get a manager on the phone and they are never successful which leads me to believe that the managers don’t even exist. Run from this company as fast as you can they will take as much money out of your company as they possibly can and tell you that they are sorry in a Middle Eastern accent. This company has caused a great deal of stress and financial misfortune and there doesn’t seem to be any way to get out. Our only hope is that after the two-year contract is up that they won’t try to hold us hostage longer, but I doubt they will let us go without more scamming. This is a SCAM COMPANY. RUN!!

UCC release or termination
This company is stupid without my permission and sign any contract. They hold my UCC and did not release more than 20 days. I just listened their offer and said I will be thinking about it and then they holding my UCC now I’m thinking to how to get out from them.

UCC-1 filed without consent and no contract. I have reached out to FleetSmarts for a termination letter and they are completely ghosting. I filed a UCC-3 and a UCC-5 with the State, and filed complaints with the BBB and Utah fraud division. They cannot legally file a UCC-1 without signed written consent.

I have reached out to Fleetsmart for a termination letter, which Mathew Ama, the supervisor, tried to extort me into cash payment and signing a contract to just 'test them out for 60 days.' Phoenix Freight & Logistics LLC is being subjected to extortion by US Business Services, aka FleetSmart.
FleetSmart filed an unauthorized and fraudulent UCC-1 Financing Statement against my business without consent, without any agreement, and without any legal basis under UCC §9-509. After contacting FleetSmart to demand removal of this unauthorized filing, FleetSmart refused to terminate the UCC-1 unless my company pays money and officially signs a contract with them. This constitutes: extortion, coercion for financial gain, fraudulent encumbrance, abuse of the UCC system, deceptive and unfair business practices, and a wrongful attempt to obtain funds by threatening harm to my business's credit, financing, reputation, and operations. A company cannot legally file a fraudulent lien, then demand payment to remove it.
This is a criminal act in many states and a violation of federal law concerning unfair and deceptive business practices. My business has never signed any agreement, never received funds, never authorized any lien, and never granted US Business Services permission to file a UCC-1. US Business Services' filing was fraudulent from the beginning, and their demand for payment to release it is illegal extortion.
They are changing their LLC name every year to avoid detection, as I have discovered from the extensive Better Business Bureau complaints. I am requesting an investigation and enforcement, as this conduct is causing ongoing harm to my business.

Fleetsmarts is the type of company that you don't want to get into business with they have and I qote "illmoral practices but not illegal " they will sell you a dream and deliver nothing and I haven't factored a load with this company since August of last year and they won't give me my letter of Release. Don't do business with them.

I had an issue with my factoring and the customer service representative that I spoke with I believe his name was Zeus really went above and beyond to help me with my concern.

I would not recommend this factoring company.

They charge extra fees for many small things that most factoring companies don't. For example, if a broker hasn't paid within 30 days, they immediately send an email demanding that you either pay for an extension or accept a chargeback. They won't even wait a few extra days for payment, even though delays from brokers are common in the trucking industry.

They also charge an additional **4.5% on every invoice** if you don't use their fuel card. On top of that, if you take a loan from them, they add another **6% per invoice** until the loan is fully repaid. These hidden costs add up very quickly and make their factoring service much more expensive than it appears.

I've worked with other factoring companies, and none of them operate this way. Before signing up, read the agreement very carefully and make sure you understand all of the additional fees.

Fleetsmarts.net is a SCAM COMPANY!! THEY WILL FORCE YOU IN TO A CONTRACT THAT YOU DO NOT WANT. WILL LIES AND TRY TO FORCE YOU TO STAY WITH THEM. FLEET SMART PLEASE REPLACE "SIERRA LOGISTICS! WE DO NOT WANT TO WORK WITH YOU!!! WE DID NOT SIGN A DOCS! SENT A RELEASE OF TERMINATION NOW!! THEY WILL SIGN A ESIGN WITHY OUR NAME AND FORCE A SIGNATURE.

While some sections state “no long-term commitment,” other parts of the agreement introduce obligations that effectively bind you depending on how the products are structured or used.

Overall, the contracts are complex, heavily one-sided, and rely on fine print that may not be obvious upfront. Proceed with caution and ensure you fully understand the long-term implications before entering into any agreement with this company.

Does anyone have any ideas for how to get out of this scam company, Fleetsmart/Blue Water Capital? I am trying to get a release letter from them, but every time I call, they tell me to send a letter to a buyout link. We need to file a lawsuit against this business. I think they are putting a lot of small businesses out of business.
