Please read these Terms of Use (these “Terms” or “Terms of Use”) carefully. These Terms form a legally binding contract between you and rabbit inc. ("rabbit," “Company,” “we,” “us,” or “our”) and govern your access to and use of rabbit OS3 ("OS3"), the rabbit agent application, the rabbit r1 and other rabbit-branded devices, our websites, and the related software and services we provide (collectively, the “Services”). Our Privacy Policy, available at https://www.rabbit.tech/privacy-policy, is incorporated into these Terms by reference.
By creating an account, installing the rabbit agent, pairing a device, clicking “I agree,” or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install, access, or use the Services.
SPECIAL NOTICE — AI THAT CONTROLS YOUR DEVICES. OS3 can operate your computer and online accounts, including reading files, moving the mouse, typing, opening applications, browsing the web, installing tools, and completing transactions. OS3 acts only on your instructions, and every operation on your devices or through your third-party accounts is initiated from your device and is treated as an action taken by you. Please read Section 4 (Device Control, File Access and Operating-System Permissions) and Section 5 (AI Models, Output and Your Responsibilities) carefully, and supervise the Services while they run.
TECHNICAL PREVIEW. OS3 and the rabbit agent are currently offered as a technical preview / beta. They are experimental, probabilistic, and may produce incorrect or unintended results. They are not intended for production, enterprise, regulated, safety-critical, or unattended use. See Sections 3.2 and 5.6.
1. Definitions
In these Terms:
“OS3” :the cloud-based multi-agent operating system and rabbit agent operated by rabbit that receives your instructions through various channels, coordinates agents, Skills, models and connected devices, and returns results to you.
“rabbit agent”: the small software application you install and run locally on a compatible computer that pairs that computer with your OS3 account and enables OS3 to operate it.
“Node” :a computer, server, or supported rabbit-branded device on which the rabbit agent is installed, that is paired to your account, and that OS3 can operate. You may register multiple Nodes under one account.
“r1” / “Product” :the rabbit r1 handheld device, any successor or similar rabbit-branded hardware , and rabbit-branded accessories that may connect to the Services.
“Channels” :the ways you can send instructions to OS3, including the OS3/rabbit.tech website in a browser, Telegram, SMS/text messaging, and other channels rabbit may add.
“LLM” :a third-party or self-hosted large language model (and, where applicable, a large action model or other AI model) that interprets instructions and generates content or task steps.
“Custom Model”:a model you configure yourself using your own API key or endpoint ("Bring Your Own Key" or “BYOK”).
“Skill”: a packaged capability, workflow, connector, agent, script, or automation that OS3 can install and invoke to carry out tasks, including recorded automations referred to as “Lessons.”
“DLAM” :the device-control capability that enables models to operate a Node by simulating human keyboard and mouse input and, only where a task requires dynamic on-screen information, by reading screen content.
“Input” :the text, voice, files, images, instructions, and other content you submit or authorize the Services to access.
“Output” :the content, commands, or actions generated or performed by an LLM or the Services in response to Input.
"Memory": information OS3 extracts from your conversations to maintain continuity across tasks and Channels, together with the embeddings used to recall it and references to the source conversations from which it was derived.
“User Content” :all content, data, files, and materials you create, upload, submit, store, or make available through the Services, including Input, your Lessons, and your configuration, but excluding account/registration information.
“Third-Party Services” :third-party models, applications, software, websites, tools, APIs, content, and services that you configure, connect, or invoke through the Services.
"Service": has the meaning given in the introduction to these Terms.
2. Acceptance, Eligibility and Accounts
2.1 Acceptance and authority
You may accept these Terms only if you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract. If you are using the Services on behalf of an organization, you represent and warrant that you are authorized to bind that organization, and "you" refers to that organization (including its authorized employees and users). You accept these Terms by clicking "I agree" or by accessing, browsing, or otherwise using the Services. If any provision is unacceptable to you, do not use the Services.
2.2 Eligibility and age
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. If you are between 13 and the age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to these Terms. The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 (or under the digital age of consent applicable in an EU/EEA Member State). You represent that you meet these conditions and that you have not previously been suspended or removed from the Services.
2.3 Accounts, credentials and paired Nodes
You may register an account using an email address and password (managed through our identity provider) and may pair multiple Nodes and Channels to that account. You must provide accurate, current information and keep it up to date.
You are responsible for the security of your API keys themselves, including generating, rotating, and revoking them; rabbit stores them encrypted as described in the Privacy Policy but does not have visibility into your key management practices with model providers.
You may not share, lend, rent, sell, or otherwise permit any person who is not authorized to use your devices or accounts to access the Services through your account. You must only install the rabbit agent on, and pair, devices and accounts that you own or are authorized to control. Notify us immediately at support@rabbit.tech if you suspect unauthorized use.
2.4 Changes to these Terms
We may update these Terms as the Services and applicable law evolve by posting a revised version with a new “Last Updated” date and, for material changes, by notifying you through the Services, by email, or via a Channel. If you are a consumer in the EU/EEA/UK, material changes will not be imposed retroactively and you will be given a reasonable opportunity to cancel your account before they take effect; continued use after the effective date constitutes acceptance where permitted by mandatory law. If you do not agree to a change, you must stop using the Services.
3. The Services
3.1 What the Services do
OS3 runs in the cloud and you send an instruction through a Channel, OS3 coordinates the relevant agents, Skills, models, and Nodes, and it returns a result. The rabbit agent runs locally on your computer and carries out local file access and device operations as directed by OS3. When a task requires a file or application on a Node, the rabbit agent accesses the specific local resource needed; the relevant content and your instruction are processed through rabbit's servers and sent to the selected LLM provider, which generates the Output that OS3 returns to you. If the model determines that a third-party tool or Skill is needed, OS3 and/or the rabbit agent may download and install it on the Node as described in Section 6.
You can register multiple computers and servers (for example, a home computer, an office computer, and a server) as Nodes under one account and control them from a single entry point, including remotely across networks through a paired Channel. The Services also support connected rabbit hardware; content you upload from a paired r1 may be sent to LLM for processing.
3.2 Technical preview; no safety-critical use
The Services (including OS3, the rabbit agent, DLAM, and Skills) are provided as a public technical preview and experimental service. They are under active development, may contain defects or security vulnerabilities, may behave unpredictably or perform unintended actions, and may be modified, suspended, or discontinued at any time.
You should not use the Services in production, enterprise, regulated, safety-critical, compliance-sensitive, or unattended/mission-critical environments.
The Services do not provide, and Output must not be treated as, medical, health, nutritional, legal, tax, financial, investment, insurance, housing, employment, education, or other professional advice or diagnosis, and must never be used to diagnose, prevent, treat, or cure any health condition. rabbit is not a licensed professional in those fields. You are solely responsible for decisions you make based on the Services.
3.3 Connectivity, equipment and third-party charges
OS3 runs in the cloud and requires a working internet connection, without connectivity it will not operate, and Nodes cannot receive instructions. You are responsible for compatible devices, operating systems, and network access, and for any data, mobile, SMS, electricity, internet, LLM subscription, API, or other fees charged by your carriers or third-party providers.
3.4 Changes, suspension and availability
We do not guarantee that any particular feature will always be available. We may modify, improve, limit, suspend, or discontinue any part of the Services where reasonably necessary. We may suspend or terminate access immediately for security, legal, or abuse-prevention reasons. For other material changes to paid Services, we will provide reasonable advance notice and, where applicable, a pro-rata refund for prepaid periods affected. To the maximum extent permitted by applicable mandatory law, we are not liable for temporary interruptions arising from scheduled maintenance or reasons beyond our reasonable control.
3.5 Limited license
Subject to your compliance with these Terms, rabbit grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable, royalty-free license to access and use the Services and the rabbit agent for your own lawful, personal (or authorized internal business) purposes, and, where applicable, to install and run the rabbit agent on Nodes you own or control. This license does not include any right to resell, commercially exploit, rent, timeshare, offer as a service bureau, copy, modify, distribute, publicly perform, or create derivative works of the Services, except as expressly permitted. All rights not expressly granted are reserved by rabbit and its licensors.
4. Device Control, File Access and Operating-System Permissions
Because OS3 can operate your computer and online accounts, this Section explains, on a standalone basis, how device control and permissions work and the security principles behind the Services. Please read it in full.
4.1 A local program is required,the cloud orchestrates
You access OS3 through your browser, Telegram, and other Channels we add. For OS3 to control a device, you must install the rabbit agent on that device and pair it (for example, by running the pairing command shown during setup in the device’s terminal). Once paired, that device becomes a Node that OS3 can operate. Until you give OS3 a task, the rabbit agent is idle and inactive.
4.2 Two separate layers of permissions
- Operating-system-level permissions: When the rabbit agent needs to control your computer (including reading files, moving the mouse, typing, or using screen and input capabilities), the operating system presents its own permission dialog, the same kind of prompt you would see for any application that controls the screen or input devices. You grant each such permission on your own machine. These prompts come from the operating system, not from OS3, so you always approve them locally. If you decline, OS3 cannot perform that action on the device.
- OS3-level permissions: while carrying out a task, OS3 separately identifies operations it assesses as risky (for example, payments, purchases, sending messages, deleting files, or changing system settings) and asks you whether to proceed.You may select one of the following permission modes and you may change your selected mode at any time through your account settings; changes take effect for subsequent tasks and do not retroactively affect actions already completed:(a) Ask Every Time. OS3 will request your express confirmation before each action that uses your connected accounts or your computer. Public searches performed on the open internet do not require your permission and are carried out automatically.(b) Full Access. OS3 may carry out your requests across all connected applications and computers without further asking for your confirmation. Full Access includes, without limitation, the authority to send messages, post content, change or delete data, initiate financial transactions, and make payments on your behalf. You acknowledge that selecting Full Access means OS3 will not pause for confirmation before such actions, and you assume full responsibility and risk for any errors, unauthorized or erroneous actions, or unintended consequences arising from OS3's execution of your instructions.(c) Ask for New Permissions. OS3 will remember the permissions you have previously granted and will request your express confirmation only when a task requires a new type of permission not previously authorized.Your saved permissions remain available if you switch back to Ask for New Permissions. Website sign-in flows and your computer's own operating-system permission prompts may still require your assistance and are outside OS3's control. You may revoke any previously granted permission at any time through your account settings; upon revocation, OS3 will not exercise that permission in subsequent tasks.This layer is part of OS3, so you can approve or decline from the web interface or a paired Channel such as Telegram — you need not be physically at the controlled device. If you decline, OS3 will attempt an alternative way to complete the task rather than simply stopping.
4.3 What installing the rabbit agent does and does not involve
- Nothing leaves your computer until you ask for something. The rabbit agent runs locally on your machine. With it installed and no task running, the contents of that machine stay on it,rabbit does not copy, store, use, or sell the contents of your computer, and it does not scan or upload your hard drive.
- A task reaches only what that task needs. When you start a task, OS3 accesses only the specific files and data required to carry it out and the LLM determines what those are. That content is processed through rabbit’s servers together with the prompts needed for the task and is sent to the LLM provider you connected, where it is handled under that provider’s terms. rabbit keeps no copy of the file itself, and the original file remains on your computer.
- You are the one who approves. OS3 acts only in response to your instructions and does not initiate tasks on its own. Sensitive actions require your confirmation, and system-level permissions are requested separately by your operating system on your own machine. You can interrupt or stop a task at any time.
- Conversations are stored but your files are not. As with any cloud-based assistant, your conversations with OS3 and the Memory built from them are stored on rabbit’s servers to provide continuity across Nodes and Channels. The files on your computer are not stored by rabbit as files, and your configuration data is held in the rabbit agent’s local directory rather than in the cloud.
4.4 How DLAM operates your device
The device-control layer is designed to operate a Node by presenting itself to the operating system as a human input device (effectively a cloud-driven keyboard and mouse that simulates human input) rather than by continuously capturing your full screen to a vision model or by injecting into other applications’ processes. It reads dynamic on-screen content (a visual fallback) only when a task requires information that is displayed on screen and not otherwise available. Because it simulates input, you should treat OS3 as a user seated at that machine: it can act within the permissions you grant and within the accounts that are signed in.
4.5 Sensitive and irreversible actions, supervision and stop controls
OS3 pauses and asks for your confirmation before actions that are consequential or difficult to reverse. The table below is illustrative and not exhaustive; OS3 may also pause for other actions it assesses as risky. You remain responsible for supervising tasks and for reviewing actions before confirming, and you can cancel or interrupt a task at any time.
You should maintain current backups of important data, keep your operating system and security software updated, close or lock sessions and accounts you do not want OS3 to use, and not leave consequential tasks unattended. You bear final responsibility for reviewing and deciding on material or irreversible operations such as bulk file deletion, modification of critical system configurations, and execution of financial transactions.
4.6 Your authorization to access devices and accounts
You hereby authorize rabbit, OS3, and the rabbit agent to access, operate, and transmit instructions to the Nodes, files, applications, and Third-Party Services that you configure or instruct the Services to use, and you confirm that you own or lawfully control those devices and accounts and have the right to grant this authorization. Access and actions performed at your direction through your own signed-in accounts constitute authorized access and use as between you and rabbit, and are initiated from your device in your name. You will not configure or control any device, account, system, or data that you do not own or are not authorized to access, and you will not use the Services to monitor, track, or access any person or system without all legally required consent.
4.7 Screen and sensitive information
When a task uses the visual fallback or operates signed-in applications, content displayed on your screen may be processed transiently, including login credentials, financial information, personal data, or confidential materials. You are responsible for preventing unnecessary exposure of sensitive information (for example, by hiding or closing irrelevant windows or sessions and by not asking OS3 to process data you should not entrust to it). Operational and diagnostic logs may, during the technical preview, incidentally contain limited task text.
5. AI Models, Output and Your Responsibilities
5.1 The Services are an AI tool and interaction medium
The Services are an artificial-intelligence productivity tool and an interaction medium between you, LLMs, tools, Skills, and your devices. Based on your Input, an LLM understands your intent and generates text, code, or command instructions; the rabbit agent then invokes local devices or Third-Party Services to perform operations. All Output is generated by the selected model based on your Input. Operations involving files, systems, or locally installed software on a Node are executed on that device according to your input, confirmation, authorization, or configuration. The accessing and operating of local devices and Third-Party Services, and your installation and use of tools and Skills, are regarded as your own actions, and you are responsible for them and their consequences.
5.2 Custom (BYOK) Models
When you configure a Custom Model with your own API key or endpoint, your API key is stored encrypted on rabbit's servers and used solely to authenticate and route your Input to the model provider you designate. OS3 provides the interface and routing infrastructure; your Input is transmitted to that model provider, and the Output is returned to rabbit's servers and delivered to you.
You warrant that you obtained the model lawfully, you bear all costs it charges (such as token and subscription fees) and should monitor usage, because tasks may make repeated calls. You must comply with that provider’s terms and disputes with that provider are between you and it. We may review configured model sources and may suspend, restrict, or block a Custom Model where required by law or where we reasonably believe it presents unlawful, infringing, or security risks.
5.3 Output may be inaccurate, no professional advice
AI and LLMs are probabilistic and evolving. Output may be incorrect, incomplete, out of date, biased, hallucinated, or unsuitable, may resemble existing content, and the same Input may produce different results. You must independently evaluate, verify, and test Output and execution results before relying on or acting on them, and use human judgment, particularly for consequential matters.
5.4 Prompt injection, parallel processing and unpredictable behavior
The Services may be affected by prompt injection, poisoned or malicious content, compromised web pages or Skills, and other external attacks, and may use parallel processing (sub-tasks) to perform several operations at once; where parallel processing touches sensitive files, data, or accounts, OS3 will alert or prompt you. You should treat content, links, and instructions originating from web pages, documents, emails, or third-party Skills as untrusted data, not as commands that override your instructions or these Terms.
5.5 AI transparency
In accordance with applicable transparency requirements, you are informed that you are interacting with an AI system and that Output is artificially generated. The identity of the model used may be shown in the interface. You may not remove, alter, or conceal AI-origin or safety markings applied by the Services, and when you share AI-generated content you should keep its origin clear.
5.6 Device-operation (DLAM) preview risks
The device-control capabilities described in Section 4 are experimental and inherently non-deterministic. By using them you expressly acknowledge that they may misinterpret instructions; perform incorrect, incomplete, or harmful actions; delete, modify, or corrupt data; alter system configuration or security settings; expose confidential information; or interact with financial or other sensitive accounts. You are solely responsible for monitoring these capabilities while they operate, reviewing and supervising their actions, stopping them when necessary, maintaining backups, implementing appropriate security controls, and ensuring lawful use. You will not use them in an unattended, unsupervised, or mission-critical manner. rabbit does not monitor, pre-approve, or verify every device action, and does not guarantee that the capabilities will prevent unauthorized access, security incidents, or data loss.
6. Skills, Third-Party Tools and Web Information
6.1 Skills and third-party tools
You may install and use extensible Skills and tools. We recommend using Skills provided or recommended by rabbit. If you install third-party Skills not provided or recommended by us, including Skills sourced from GitHub or elsewhere, you should guard against malicious prompt injection, unauthorized access, backdoors, and other security risks; verify a Skill’s security and applicability before authorizing it, and review the audit summary OS3 provides (what the Skill is, where it is installed, and its dependencies and permissions). You are responsible for the Skills and tools you install and bear the associated risks. Third-party Skills and tools are governed by their own licenses, terms, and policies.
6.2 Web search and third-party information
When the Services search or retrieve information, they may retrieve, display, or cite information published by third parties and may summarize it into Output. Such information is produced by the relevant third parties, its inclusion does not mean rabbit endorses it or vouches for its authenticity, accuracy, or legality. Output that summarizes third-party information may contain deviations and is for reference only, please verify it before use.
6.3 Third-Party Services and accounts
The Services may interoperate with Third-Party Services. Third-Party Services are not owned or controlled by rabbit, they are provided for convenience, on an “as is” and “as available” basis, and your access to them (including logging in, obtaining or publishing content, and executing transactions) is performed according to your instructions, initiated from your device in your name, and subject to that third party’s terms and privacy policy. You are solely responsible for complying with those terms and for assessing the source and trustworthiness of third-party communications, links, and requests. rabbit is not a party to, and is not liable for, transactions or interactions between you and third-party providers.
7. Access Channels and Connected Devices
7.1 Channels
You may interact with OS3 through the website, and, where you choose to pair them, Telegram, SMS, and other Channels we add. Pairing a Channel may require granting messaging permissions and linking identifiers. Messages and files you send through a Channel are treated as Input. Because you can control Nodes remotely across networks and geographies through a paired Channel, you must keep control of the paired messaging account and device. Anyone with access to that Channel may be able to issue instructions subject to OS3’s confirmation prompts. Unpair a Channel promptly if it is compromised.
7.2 rabbit hardware
rabbit hardware is governed by these Terms, the applicable limited warranty, and any terms included with the device. r1 and future devices may connect to OS3 and, in the future, start directly into OS3 as the startup interface.OS3 still runs in the cloud and requires an internet connection. You are free to unlock or modify your own r1, but doing so is undertaken at your own risk, may impair functionality and security, and permanently voids the limited warranty to the extent permitted by law. You may not tamper with, clone, or fraudulently use any SIM/eSIM or connectivity service associated with a Product.
7.3 Device and account scope
Features may vary by device, operating system, Channel, or version, and some features are released first on particular platforms (for example, the browser-based experience before native device support). Functionality is subject to the version you use and the announcements we make.
8. Acceptable Use and Prohibited Conduct
You are solely responsible for your conduct and your User Content while using the Services, and for their consequences. You will use the Services only for lawful purposes and in compliance with these Terms and all applicable laws. Without limitation, you may not, and may not enable or assist any third party to:
- use the Services to commit or facilitate any crime, fraud, phishing, impersonation, deception, financial abuse, money laundering, or unauthorized financial or other personal-information collection;
- access, or attempt to access, any device, account, system, network, or data that you do not own or are not authorized to access, or circumvent, disable, or bypass any security, authentication, or access-control mechanism;
- use the Services to surveil, monitor, track, stalk, or record any person, device, or location without all legally required consent, including covert screen, audio, webcam, or location capture;
- upload, transmit, or install any virus, worm, Trojan, malware, spyware, ransomware, backdoor, or other harmful code, or run denial-of-service, spam, mass-automated, or resource-exhaustion activity;
- interfere with, disrupt, degrade, overburden, reverse engineer (except as permitted by mandatory law), decompile, disassemble, scrape, crawl, data-mine, mirror, or frame the Services, or probe, scan, or test their vulnerability, or access another user’s account or data;
- use the Services to create or distribute content that is unlawful, infringing, defamatory, harassing, abusive, threatening, discriminatory, sexually explicit, or that sexualizes minors, or content that infringes intellectual-property, privacy, publicity, or other rights;
- use the Services to generate or disseminate false or misleading information, non-consensual impersonations, or content designed to manipulate elections, markets, or emergency response, or to harass or deceive;
- use the Services to violate any Third-Party Services terms, employer or institutional policies, or any person’s rights, or to make automated requests or take actions against third parties at abusive scale;
- use the Services for life-sustaining, safety-critical, military/weapons, or high-risk purposes prohibited by Section 3.2, or in connection with nuclear facilities, aviation, or hazardous environments;or
- use the Services for any illegal purposes;
- remove, alter, or obscure copyright, trademark, proprietary notices, or AI-origin markings; resell or commercially exploit the Services without authorization; or use a stolen or lost device;
- export, re-export, or use the Services in violation of export-control or sanctions laws ;
- cause or induce any third party to engage in any of the foregoing.
We may investigate suspected violations and take appropriate action, including warning, restricting, suspending, or terminating access or accounts, disabling or removing Skills or User Content, blocking Nodes or Channels, preserving and reporting information to law enforcement or regulators, and pursuing available remedies. Reporting or enforcement does not make us responsible for monitoring the Services, which we undertake only to the extent required by law.
9. Your Content, Lessons, Memory and Feedback
9.1 Ownership of User Content
As between you and rabbit, you retain ownership of the User Content you lawfully provide and, to the extent permitted by law and subject to model-provider rights, the Output generated for you. rabbit claims no ownership of the original files on your Nodes. You must have all rights necessary to provide User Content and to authorize its processing.
9.2 License to rabbit
You grant rabbit a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, transmit, process, display, and use User Content solely as necessary to operate, secure, support, and provide the Services to you, to comply with law, and for any purpose for which you separately give consent. This license ends when the content is deleted or when your account closes, except for copies retained in backups, logs (for the limited periods stated in the Privacy Policy), or as required by law. This is a limited-service license, not a transfer of ownership, and rabbit does not sell your conversation or file content.
9.3 Lessons and recorded automations
You may create and share recorded automations (Lessons), and other users may replay them, causing the recorded actions to execute on their own devices. By replaying a Lesson, you accept its actions and understand rabbit is not responsible for errors, omissions, or consequences. You are solely responsible for ensuring Lessons you create or share contain no personally identifiable or sensitive information (such as payment-card numbers, phone numbers, email addresses, credentials, full names, addresses, or government identifiers), no secrets or API keys, and no unlawful or harmful steps. You acknowledge that third-party AI models may process Lessons and that sharing a Lesson may disclose it to those providers and other users.
9.4 Memory
OS3 may build Memory from your conversations to provide continuity and personalization.. Memory is part of the data the Services store in the cloud, your files are not.
9.5 Feedback
If you submit ideas, proposals, suggestions, or feedback ("Feedback"), you do so on a non-confidential basis and grant rabbit a perpetual, irrevocable, non-exclusive, royalty-free right to use and exploit it to operate and improve the Services, without obligation or compensation.
9.6 Your representations
You represent and warrant that:
- you own or have the necessary rights and consents to your User Content and to grant the licenses above;
- your User Content and its processing do not infringe any third-party right, including intellectual-property, privacy, or publicity rights;
- where your User Content contains personal information, you have a lawful basis and, where required, have obtained informed consent (and separate consent for sensitive information);
- your User Content is not fraudulent, tortious, or unlawful. You are responsible for the consequences of sharing User Content, Lessons, or Output with others.
10. Intellectual Property
The Services, including the website, software, interfaces, graphics, design, data, algorithm, models, documentation, look and feel, and related intellectual property (the “Service IP”), are owned by rabbit or its licensors and protected by copyright, patent, trade-secret, trademark, and other laws. These Terms grant only the limited license in Section 3.5 and no ownership interest. rabbit and its licensors reserve all rights not expressly granted.
The rabbit name, logos, and marks are trademarks of rabbit. Other product and service names are the trademarks of their respective owners. Display of a third party’s name or mark (for example, the Custom Model you configured) is for identification only and does not imply affiliation or endorsement. You may not use rabbit’s marks without prior written consent.
Subject to these Terms and the applicable model-provider terms, rights in your Input and in Output belong to you or the relevant rights holder, and using the Services does not change that ownership. Rights in Output from a Custom Model are governed by your agreement with that model provider.
You should review that provider’s terms before using such Output commercially. rabbit does not grant any copyright license to Service IP beyond Section 3.5.
11. Privacy
Our collection, use, sharing, retention, and international transfer of personal information, and the privacy rights available to you under the EU/UK General Data Protection Regulation, U.S. state privacy laws (including the CCPA/CPRA), and other applicable law, are described in our Privacy Policy at https://www.rabbit.tech/privacy-policy. By using the Services, you acknowledge those practices. The Privacy Policy includes the categories of data collected, the role of Custom Models, the limited role of operational logs, data-retention periods, international-transfer safeguards, and how to exercise your rights or contact our Data Protection Officer and EU/UK representative.
12. Fees, Payments and Cancellation Rights
12.1 Fees and pricing
The Services are currently provided free of charge. Certain hardware products (including, without limitation, the r1 device) are offered for purchase on a separate basis, and any such hardware purchase is subject to its own terms and conditions presented to you at the time of checkout.
We reserve the right to introduce paid features, subscription plans, or other premium services in the future. Before any paid feature or subscription becomes available to you, we will provide you with a separate dedicated page describing the applicable fees, billing terms, and payment methods. You will be required to expressly review and consent to such terms before completing any purchase or subscription. You are not obligated to purchase any paid feature or service.
Current pricing is displayed at the point of sale or during checkout. We will provide advance notice of any fee changes before they apply. You are responsible for all charges you incur and for any applicable taxes. Promotional offers are made at our discretion and are subject to their stated terms.
12.2 Third-party and usage charges
Charges from Custom Model providers, carriers, internet and SMS providers, and other Third-Party Services are separate and are billed directly by those providers and rabbit is not responsible for them.
12.3 EU/EEA/UK and Swiss withdrawal right
If you are a consumer in the EU/EEA, the UK, or Switzerland, you generally have 14 days to withdraw from a contract for paid digital services or digital content without giving a reason, starting on the day of conclusion. You lose that right once performance has begun with your prior express consent and your acknowledgment that you thereby lose the withdrawal right; for free technical-preview Services there is no charge and nothing to refund. Where a paid service is supplied continuously, you may cancel under the subscription rules presented at purchase, and you retain all statutory cancellation and refund rights that cannot be waived. To withdraw, use the account settings or contact support@rabbit.tech using the model withdrawal form available from the European Commission.
12.4 U.S. billing and refunds
For U.S. customers, subscriptions renew automatically until cancelled, and refunds, if any, are handled per the billing terms presented at purchase or our hardware return policy, as applicable. Hardware returns and warranties are governed by the separate limited warranty and return policy.
13. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES (INCLUDING HARDWARE, TO THE EXTENT NOT COVERED BY THE SEPARATE LIMITED WARRANTY) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, NON-INFRINGEMENT, AVAILABILITY, SECURITY, ACCURACY, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY OUTPUT WILL BE ACCURATE, RELIABLE, APPROPRIATE, OR COMPLETE, THAT DEVICE ACTIONS WILL BE AS INTENDED, OR THAT DEFECTS WILL BE CORRECTED.
YOUR USE IS AT YOUR OWN RISK. YOU ARE RESPONSIBLE FOR VERIFYING OUTPUT AND DEVICE ACTIONS, FOR BACKING UP YOUR DATA AND SYSTEMS, AND FOR SECURING YOUR ACCOUNTS AND CREDENTIALS. WE ARE NOT RESPONSIBLE FOR DAMAGE TO YOUR PROPERTY (INCLUDING YOUR COMPUTER, DEVICE, OR DATA), UNAUTHORIZED TRANSACTIONS, OR LOSS OF DATA RESULTING FROM THE SERVICES. THIRD-PARTY SERVICES, SKILLS, MODELS, AND CONTENT ARE PROVIDED BY THE RELEVANT THIRD PARTIES WITHOUT WARRANTIES FROM RABBIT.
MANDATORY CONSUMER RIGHTS. If you are a consumer in the EU/EEA, the UK, or Switzerland, nothing in these Terms excludes or limits liability, warranties, or guarantees that cannot be excluded or limited under mandatory law, including your statutory rights regarding conformity of digital content and services and defective goods. The disclaimers above apply only to the extent permitted by the law of your country of residence.
14. Indemnification
To the fullest extent permitted by applicable law, you agree to defend (at rabbit’s election), indemnify, and hold harmless rabbit, its affiliates, and its and their officers, directors, employees, contractors, agents, and licensors (the “rabbit Entities”) from and against any third-party claims, and related liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees), arising out of or in connection with:
- your use of the Services or use under your account, Nodes, Channels, or credentials;
- device or account actions performed at your direction, including transactions and access to Third-Party Services;
- your User Content, Lessons, or Output you use or share;
- your violation of these Terms, applicable law, or any third-party right (including intellectual-property, privacy, publicity, confidentiality, or property rights);
- your Custom Models, Skills, or third-party tools; or
- your inclusion of personal or sensitive information in the Services.
We may assume exclusive defense and control of any matter subject to indemnification, in which case you will cooperate, and you may not settle any claim against a rabbit Entity without its prior written consent.
15. Limitation of Liability
15.1 United States and other non-EU users
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER RABBIT NOR THE RABBIT ENTITIES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, REVENUES, SAVINGS, GOODWILL, BUSINESS OPPORTUNITY, OR DATA, SERVICE INTERRUPTION, DEVICE DAMAGE, OR SYSTEM FAILURE, OR THE COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER THEORY, AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
SUBJECT TO THE FOREGOING AND TO ANY LIABILITY THAT CANNOT BE LIMITED BY LAW, THE TOTAL AGGREGATE LIABILITY OF RABBIT AND THE RABBIT ENTITIES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US$100) AND (B) THE FEES YOU PAID RABBIT FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT. SOME U.S. STATES DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THOSE STATES, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
15.2 EU/EEA, UK and Swiss consumers
If you are a consumer habitually resident in the EU/EEA, the UK, or Switzerland:
- nothing in these Terms limits or excludes rabbit’s liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for willful misconduct or gross negligence, for breach of statutory data-protection obligations, for defective-product liability under mandatory law, or for any other liability that cannot be limited or excluded by law;
- rabbit is liable for foreseeable damage caused by its failure to exercise reasonable care or perform its obligations, except that (i) for paid Services, such liability for ordinary negligence is limited to the fees you paid in the twelve (12) months preceding the event for the affected Service, and (ii) for free-of-charge Services, liability for ordinary negligence is limited to damage that is typically foreseeable at the time these Terms were concluded; and (c) these limits do not affect your mandatory consumer rights or your right to bring proceedings in your country of residence .
15.3 Major and irreversible operations, model deviations
You bear final and complete responsibility for reviewing and deciding on major matters (including credit, financing, wealth management, insurance, legal, medical, and education decisions) and for operations that may have material or irreversible consequences, such as bulk deletion of files, modification of critical system configurations, and execution of financial transactions. Because operations are based on model interpretation of your Input, a model may misunderstand instructions, produce execution deviations, or behave unexpectedly; subject to Sections 15.1 and 15.2 and to mandatory law, rabbit is not liable for losses caused by such misunderstanding, deviations, or unexpected automated behavior where it has acted with reasonable care and provided the confirmation controls described in Section 4.
15.4 Risk allocation
Each provision allocating risk, disclaiming warranties, or limiting liability is severable and independent and reflects a fair allocation of risk forming an essential basis of the bargain. The limitations apply even if a limited remedy fails of its essential purpose, and nothing limits liability that cannot be limited under mandatory law.
16. Term, Suspension and Termination
These Terms take effect when you accept them or first access the Services and continue while you have an account or use the Services. You may stop using the Services and delete your account at any time in Settings or by contacting support@rabbit.tech.
We may suspend, restrict, or terminate your access, account, Nodes, Channels, or use of particular features, and remove or disable User Content or Skills, where you breach these Terms, where required by law or a third-party right, or for security, fraud, abuse, safety, or operational reasons, with notice where practicable (and immediately where delay is necessary to protect the Services or others).
Upon termination, your license ends and you must cease use and uninstall the rabbit agent. Sections that by their nature survive will survive. After termination or expiration, and where functionality permits, you may request export or retrieval of your data within a reasonable period as described in the Privacy Policy. We then delete or anonymize personal data except as retained to comply with law, resolve disputes, prevent fraud, or maintain security. Uninstalling the rabbit agent removes the local application and its local configuration directory but does not by itself delete your cloud account or conversation history, which must be deleted separately. If access is terminated for your violation, we may restrict export to the extent permitted by law, without prejudice to your statutory rights to access, copy, and delete personal information.
17. Governing Law and Dispute Resolution
17.1 United States residents — binding arbitration and class waiver
If you reside in the United States, these Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of California, without regard to conflict-of-law rules, and the Federal Arbitration Act governs the arbitration provision.
Except for qualifying claims brought in small-claims court and except as provided below, you and rabbit agree that any dispute will be resolved by binding, confidential, individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or Commercial Rules if the arbitrator determines those apply), before a single arbitrator, with the seat in Los Angeles County, California. Either party may seek interim or injunctive relief in the state or federal courts of Los Angeles County, California.
YOU AND RABBIT WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A CLASS, REPRESENTATIVE, COLLECTIVE, OR PRIVATE ATTORNEY-GENERAL ACTION, AND THAT CLASS-WIDE ARBITRATION AND CONSOLIDATION ARE WAIVED. If the class-action waiver is found unenforceable as to a claim, that claim is severed and proceeds in court, with the rest arbitrated.
Before arbitration, the claimant sends a written notice and the parties attempt good-faith resolution for 30 days (send to rabbit inc., Attn: Legal Department, 1626 Montana Avenue, Suite 162, Santa Monica, CA 90403). The arbitrator may award relief available in court, plus reasonable fees to the prevailing party where permitted.
“Opt-out.” You may opt out of this arbitration Section within 30 days of agreeing to these Terms by sending a letter to the address above, Attn: Legal Department – Arbitration Opt-Out, with your full name, account email, and a statement that you opt out of arbitration. If you opt out, arbitration and the class waiver do not apply to you and disputes proceed under Section 17.1’s governing law and the courts below; all other Terms remain in effect.
Subject to the above, you and rabbit submit to the personal and exclusive jurisdiction of the state and federal courts located in Los Angeles County, California for any non-arbitrated dispute.
17.2 EU/EEA, UK and Swiss consumers
If you are a consumer habitually resident in the EU/EEA, the UK, or Switzerland: (a) you benefit from the mandatory provisions and consumer-protection laws of the country in which you reside, and nothing in these Terms (including Section 17.1’s arbitration and class-action waiver) deprives you of those protections; (b) you may bring proceedings against rabbit in the courts of your habitual residence or domicile, and rabbit may bring proceedings against you only in the courts of your domicile.
17.3 Informal resolution
Regardless of location, we encourage you to contact support@rabbit.tech first so we can try to resolve most concerns informally and promptly.
18. Copyright Claims (DMCA)
We respect intellectual-property rights and respond to valid copyright claims under the U.S. Digital Millennium Copyright Act (DMCA) and equivalent applicable laws. If you believe material on or through the Services infringes your copyright, send a notification that includes: (1) your contact information and a physical or electronic signature; (2) identification of the copyrighted work and of the allegedly infringing material, including its URL or location; (3) a statement of good-faith belief and, for DMCA notices, the statements required by 17 U.S.C. § 512(c)(3), including that the information is accurate and, under penalty of perjury, that you are authorized to act; and (4) notice to: rabbit inc., Attn: Copyright Agent, 1626 Montana Avenue, Suite 162, Santa Monica, CA 90403, or the designated copyright-agent address published on our website. Knowingly false claims may result in liability. We may terminate repeat infringers and may share notices with the affected user. EU/EEA/UK right holders may also rely on the notice-and-action procedures required by applicable law.
19. Export Controls, Sanctions and International Use
The Services are operated from the United States and may be subject to U.S. and other export-control, import, and sanctions laws. You will comply with all such laws and will not access or use the Services in violation of them, including in or for the benefit of an embargoed or sanctioned jurisdiction or person, or for restricted end uses. You represent that you are not located in, or a national or resident of, a comprehensively embargoed jurisdiction and are not on any restricted-party list. The Services may not be available or appropriate in all locations, and access from jurisdictions where it is unlawful is prohibited; we may limit availability at any time. You are responsible for complying with local law when accessing the Services from outside the United States.
20. General Provisions
These Terms, together with the Privacy Policy and any additional terms expressly incorporated, constitute the entire agreement between you and rabbit regarding the Services and supersede prior understandings. If any provision is held invalid or unenforceable, it is modified to the minimum extent necessary and the remainder remains in full force. Headings are for convenience only; “including” means “including without limitation.”
You may not assign these Terms without rabbit’s prior written consent; rabbit may assign them in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law, with notice where required by mandatory law. No waiver is effective unless in writing and signed by the waiving party. Nothing creates an agency, partnership, or joint venture. These Terms are for your and rabbit’s benefit and, except for the rabbit Entities under Sections 14–15, create no third-party beneficiary rights.
We will not be liable for failure or delay caused by events beyond reasonable control (force majeure), including natural disasters, war, terrorism, government action, internet or provider failures, pandemic and labor disputes. Notices to you may be provided electronically (including by email, in-Service notice, or via a paired Channel) and satisfy any requirement that they be in writing. We are not obligated to provide support; where we do, it is subject to our published policies and discretion. If you are a California resident, you may contact the Complaint Assistance Unit of the California Department of Consumer Affairs as described at https://www.dca.ca.gov.

Appendix A-r1 Hardware-Specific Terms
Relationship to the Main Terms. This Appendix A forms part of the rabbit Terms of Use (the "Main Terms") and applies only to users who own, purchase, or use a rabbit r1 handheld device or other rabbit-branded hardware (each, a "Product"). Capitalized terms not defined in this Appendix have the meanings given in the Main Terms. In the event of a conflict between this Appendix A and the Main Terms, this Appendix A controls solely with respect to the Product-specific matters it addresses.
Scope. This Appendix contains only provisions specific to the r1 hardware that are not otherwise set out in the Main Terms. General provisions governing the Services, including device control (DLAM), acceptable use, disclaimers, limitation of liability, indemnification, privacy, fees, and dispute resolution, are found in the Main Terms and apply to the Product to the extent not supplemented by this Appendix.
1. Modification, Unlocking and Jailbreaking of the Product
Of course, you are free to "unlock," "jailbreak," or otherwise modify your r1, but if you choose to do so, you acknowledge and agree that you are solely responsible for any damage to the Product and that doing so permanently voids our limited warranty. See the "Warranty" section of the "limited warranty & return policy" for more details.
2. Radio Frequency and Signal Modification
You may not install any amplifiers, enhancers, repeaters, signal boosters, or other devices that modify or otherwise affect the radio frequencies used to provide the Service without express permission from rabbit.
3. Promotions, Sweepstakes and Contests
Company may from time to time provide certain promotional opportunities, sweepstakes, and contests to Users. All such promotions will be run at the sole discretion of Company, and can be activated, modified, or removed at any time by Company without advance notification and the liability of any of Company's partners pursuant to such promotional opportunities, sweepstakes and contests shall be limited pursuant to these Terms. Any such promotional opportunities, sweepstakes and contests shall be subject in all respects to any additional rules and/or terms and conditions of entry related thereto.
4. Product Manual, Wellness and Health-Related Disclaimer
If you have purchased any Product, you hereby acknowledge and agree that you have read, and shall comply with, the user manual provided with any such Product. You understand that, by using the Website and the Service, you may be exposed to a variety of hazards and risks, foreseen or unforeseen, including risks that arise as a result of using any Product. You understand that injuries or damage could occur by natural causes or activities of other persons, whether as a result of negligence or otherwise. To the fullest extent permitted by applicable law, you voluntarily assume all risk of loss, damage, and injury to person or property that may arise from, or that is related to, your use of the Service, whether such risk is known or unknown to you.

5. Third-Party Components; No Warranty for Third-Party Manufacture
NO WARRANTY FOR THIRD-PARTY COMPONENTS. The Product may be manufactured, in whole or in part, by a third party. Accordingly, we do not provide any warranties with respect to the Products offered on the Website, except for those warranties provided in rabbit's Limited Warranty and any statutory rights for defective Products.
6. Support for the Product
NO SUPPORT. We are under no obligation to provide support for the Website, any Product or the Service. In instances where we may offer support, the support will be subject to rabbit's published policies and in our sole discretion.
7. Automatic Connection of r1 to OS3 Upon General Availability
7.1 OS3 General Availability.
On the date on which rabbit makes OS3 generally commercially available to the public (the "OS3 GA Date"), if you have consented to the automatic connection and pairing of your r1 device to your OS3 account, rabbit may enable such automatic connection without requiring a separate manual pairing step.
7.2 Confirmation by Acceptance of the Main Terms.
By clicking "I agree" (or otherwise accepting the Main Terms in the manner described in Section 2.1 of the Main Terms), you confirm and acknowledge that:
- your r1 device will automatically connect to OS3 on or after the OS3 GA Date; and
- you may access and use the Services under the Main Terms through your r1 device.
Such acceptance constitutes your affirmative consent to the automatic connection described in this Section A.7.
7.3 Use of Services via r1.
Once your r1 is connected to OS3, you may use your r1 to send instructions to OS3, receive Output, upload files and other content, and otherwise access the Services, in each case subject to the features and functionality rabbit makes available on r1 from time to time. Not all Services may be available through r1, and rabbit may limit, modify, or discontinue r1-compatible features at any time.
7.4 Right to Disconnect or Opt Out.
You may disable the automatic connection, unpair your r1 from OS3, or opt out of the automatic connection at any time through your OS3 account settings or the device settings on your r1. Disconnecting or unpairing your r1 will not affect your right to access OS3 through other Channels (including the website, Telegram, or SMS).
7.5 Data Processing.
Information processed in connection with your r1's connection to OS3,including device identifiers, connection and usage data, and content you choose to upload from or through r1, is governed by the rabbit Privacy Policy. By accepting the automatic connection, you acknowledge that such information may be transmitted to and processed by rabbit and its service providers as described in the Privacy Policy.
7.6 Technical Requirements and Connectivity.
Automatic connection requires an active internet connection and may require a firmware or software update to your r1. You are responsible for any carrier, data, or connectivity charges associated with your r1's connection to OS3. rabbit is not responsible for connection failures or limitations caused by your network, mobile carrier, device settings, or failure to install required updates.
7.7 No Guarantee of Continuous Availability.
rabbit does not guarantee that the automatic connection or the Services accessible through r1 will be available, uninterrupted, or error-free at all times. rabbit may suspend, modify, or discontinue the automatic connection feature for security, legal, or operational reasons, with or without notice.
