By using Faceparty, its services (either directly or via any Partner Sites), you agree that we may collect, hold, process, share and use your information (including personal information) for the purpose of providing you with our services (and our partner’s services) and for developing our business in accordance with this Privacy Policy, our Cookie Policy and our Terms & Conditions.

The Owners and the Management Company are all each Data Controllers for the purposes of this Policy. To the greater extent, the Data Controllers have appointed the Management Company to be responsible for many of the day-to-day decisions in relation to your data, its processing and any implications thereof.
We have appointed a Data Protection Officer who is responsible for making sure your data is treated safely and in accordance with this Policy, our Terms & Conditions, our other policies and the law. How & What do we Know?
Depending upon your use of our products and services, we may collect some or all of the following personal and non-personal data:
Account Creation:
When you create an account on Faceparty you provide us with the information that we need to create your account, which may include:
• Your Member Name
• Your First Name and/or Nick Name
• Your Email Address
• Your Phone Number
• Your Country and other Geographic and Location Details
• Your Gender
• Your Sexuality
• Your Date of Birth
• The Password you use to set-up your account
• Your Privacy Settings
• Your Marketing Preferences
• Your participation in Partner Sites and Products

• The Site ID you joined from (i.e. if not directly from Faceparty)
We also collect your Age, which we calculate automatically from your Date of Birth. Your Age, Gender, Member Name, Name, Country, Location and Sexuality all appear on your public profile and are therefore available to the public (i.e. our other members) to see. Your email, phone number and password remain totally private.
You can edit and manage this data when you log on to your Account.
We also store a Member ID, which is a unique number that we create, which we use to identify you on our system.
Profile Creation:
When you create an account on Faceparty you provide us with lots of voluntary information in order to create your public Profile. This information is made available to the public (i.e. our other members) by being displayed on your Profile. This data may include, but is not limited to:
• Your Current Mood
• Any Languages Spoken
• Your Eye Colour
• Your Hair Colour & Style
• Your Body Type & Measurements
• Your Ethnic Origin
• Your Relationship Status & Preferences
• Whether you have Piercings or Tattoos
• Whether you Smoke, Drink Alcohol or Take Drugs
• Your favourite Food, Music, Sports, Movies etc.
• Your Hobbies & Interests
• Whether you have any Pets
• Your Bad Habits & Personality Traits
• Personality Tests, Certificates, Stamps & Seals
• Your Religious & Political Beliefs
• Your Employment, Career Goals & Education Summary
• Your Interests in respect to Traveling
• Your answers to leading questions, such as “If I won the lottery…” etc.
• Your Sexual Interests
• Any Disabilities
• Freetext information that you provide, including Headlines, Descriptions and Blogs.
• Anything else you chose to provide to us
You are in full control of this information and can edit or delete it at any time when you log on to your Account. Please remember that this information is made available to the general public and as such you must only post information that you are happy for everyone to know about you.
Special Category Data:
Some of the information you provide to us is legally classified as Special Category Data (i.e. data which is particularly sensitive or could give rise to discrimination), which includes:
• Your Sexuality & Sexual Preferences
• Your Ethnicity
• Your Disabilities
• Your Religious & Political Beliefs
• Modern Gender Description
• Certain Dietary Preferences
• Speaking of Certain Languages
• Information relating to any Diseases
• The results of any Personality Tests you take

In addition, your behaviour and certain site settings could be indicative of certain facts, meaning that associated data is potential Special Category Data. For example, if you have used Faceparty exclusively to like the profiles of a particular gender, it could be indicative of your sexuality. This data can include:

• Your Browsing & Search Options
• Who you Like, Message, Add as "Hot" etc.

Some of the data we create automatically may become Special Category Data. For instance, if we propose matches of a certain gender or ethnicity based upon what we have learned from your behaviour.
We treat all Special Category Data with extreme care. However, because most of the data you provide is used to make your public Profile, DO NOT PROVIDE ANY SPECIAL CATEGORY DATA IF YOU ARE NOT PREPARED FOR IT TO BE PUBLICLY AVAILABLE.
If we need to collect evidence of any criminal or anti-social behaviour that you engage in, such as bullying or harassment of another member, that evidence becomes Special Category Data.
Account & Application Settings:
When you create an account, or install our app, you can manage your settings, preferences and consents from within the app, or on our website. We collect and store this information, so that we can provide you with our services in the appropriate way. The data we collect includes, but is not limited to:

• Whether you have any Pictures, Videos & MP3s and of what type
• The total number of Files you have uploaded and of each type
• The total number of Friends, Faves, Pests and Liked or Disliked Profiles

• Security Information (such as if we detect someone is trying to hack your Account)

• What Adverts you have seen and interacted with
Images, Videos & Other Files:
We will have a copy of the Images, Videos, Music and other files that you submit or upload, along with their File Names, Type, Size, Dimensions, Titles, Descriptions, EXIF Data, Gallery Name and Gallery Description. We will also have any webcam screen captures that you take and any files that you exchange (send or receive) in our Chat or Messaging features.
We also store information about each file, such as how they are categorised, which staff member categorised them, whether they have been marked for deletion, how many times each image has been viewed, liked, favourited, bookmarked etc. and by whom.
We also store your webcam, video and audio streams if you engage in such features.
If you Edit your Images (or other Content) or use any Filters or Special Effects, we will also have that information (it is required to apply the Filters etc.).
Social Media:
If you want to share elements from your other Social Media on your Profile (such as your Instagram, YouTube or Twitter feeds), we will store the information that we need to do this.
If you import data from another Social Network (or any other Internet account, such as Gmail) then we will have the data that you import, which could include things such as your Photos or Email Address (whatever you provide to us).
If you use features to Log In to Faceparty via another Social Network (or vice versa) we will store the data we need to make that possible too.
If you share Social Media Content to or from Faceparty, we will have all of the data we need to manage and facilitate that. This will vary depending on what Social Network it is.
Interactivity Data:
We store information pertaining to your interactions (or potential interactions) with others, including:
• Whether you have any Alerts (and how many)
• The Messages that you Send and Receive
• The Comments that you Post and Receive
• The Chat that you Send and Receive
• Whether and when your Messages / Chat / Comments have been Read or Deleted
• Whether and when you have New Messages / Chat / Comments / Replies (and how many)
• The Forum Topics and Posts that you make
• Which Profiles, Topics, Posts, Images and Content that you like or dislike (and who Likes or Dislikes yours)
• How many Views your Profile, Content, Topics or Posts have
• Who and what you Follow (and who Follows you and your Content)
• Who you have Tagged in Content (and who has Tagged you) this includes Tagging yourself
• The Groups that you Create or Join (and all of the data you provide to do so)
• Any Tags that you Search or Apply
• Who you add as a Friend, a Pest, a Fave or add as Hot
• Who you are Linked Friends with
• Whether you are a Friend of a Friend (and how many steps removed)
• Virtual Gifts you Send or Receive
• Your Popularity & Interactivity Score
• Information about whether you have Interacted with Someone before
• Your Current Rating, who you Rate and what, and who Rated you
• Which members you share Common Interests with
• Who you have Visited and who has Visited you
• Proposed Matches and associated data
• Which of your Friends, Faves etc. are Online Now
• Location Profiling
Emails, Calls & Customer Service:
We collect all of the information that you send to us electronically, by email, by post or by phone. This includes the dates and times that you contact us and your contact details, as well as the message and attachments that you send. If you contact us electronically, we will also capture your Member ID and IP Address. If you contact us by phone, we will also capture the number that you called from.
If you report a member to us, using the tools that we have made available, we will receive a copy of the form you completed, the name of the member you are reporting and your own IP address and Member Name.
Competition Entries:
If you enter a competition, or a giveaway, we will have a copy of the data you submit (i.e. your competition entry), along with your Account Details, Name, Location and Contact Information. We may use your Account Details to extract other information about you, which is required for the purposes of the competition. Additional policies may apply.
Events & Guestlists:
If you attend an event that we organise, we will store any Purchasing Information relating to your ticket/s if applicable, your Full Name, Title, Event Name, Event Location, Event Date, Qty of Tickets, Ticket Numbers, Your Email and/or Contact Details, Mailing Address (for tickets), Names of your Guests, Special Event Passwords if applicable.
If meals, drinks, transportation or accommodation are to be provided, then details of that will be held too.
Whether or not you are attending an event may appear on Faceparty, in the "Who’s Going" section.
If you organise an event via Faceparty, the information relating to the event and your guest list will be stored.
Merchandise:
If you purchase anything from Faceparty, we will store your Purchasing Information and a list of the items you purchased along with any quantities, prices, sizes and personalisation options. We will also have your delivery details (your Name and Address), Delivery Method, Courier Tracking Numbers, your Email and your Order Numbers.
Payments & Subscriptions:
When you purchase something on Faceparty we may receive and hold data about your purchases which may include the Date of Transaction, Unit Costs, Amount Paid, Payment Method, Payment Currency & Country (for Tax/VAT Purposes), Transaction IDs, Payment Reference Numbers, Card Type, Card Number, Expiry Date, Security Digits (Never Stored), Your Full Name, Payment Email, Full Address and Post Code, IP Address, Device Identifier & Details, Bank Name, Bank Authorisation Status, Card Issuer, Bank Country, Authorisation Codes & Status, Verifications (Address, CV2 etc.), Phone Number (If provided), Cheque Numbers and Bank Account Details (i.e. for Direct Debits).
When you subscribe to a Premium Feature we will hold data about that, such as what features you have, Rebill Dates and how many days you have remaining.
We will also store details about any Refunds and Cancellations.
If you make a payment via SMS, we will also keep a record of your phone number, the billing data and a record of the billing message we sent you.
SMS Messages:
If you contact us via SMS, including sending a message to an automated service, we will keep a record of your Phone Number, your Country, the Date & Time, the Message you sent and any Billing Records if applicable.
We keep copies of all inbound and outbound SMS messages.
Account Verification:
We store whether you have confirmed and/or verified your Email Address, Phone Numbers and/or Mailing Address. We may also store a Verification Code or Token required in order to fulfil this.
We also store information as to whether you have proven certain elements of your profile to be true, such as your likeness. In these instances, we will store the data which is required. For example, we may keep a copy of your ID or if we ask you to do something particular in a photo (such as touch your nose then stick your tongue out) in order to prove it is you, we will keep the evidence of you doing that along with the request, date and time that you did it. We will also store information about whether you passed or failed the Verification process.
Automatically Created Data:
Some data is created automatically by our systems, including but not limited to:
• A Session ID (which we use to identify you)
• ID Numbers we assign to your data, so our software can work
• IDs which tell us what Apps and Partner Sites you participate in
• The Distance you are to other Members
• A value that determines whether you have completed your Profile, or uploaded a Pic
• A flag that determines if you are a New Member
• A flag that determines if it is your Birthday (This appears publicly)
• Flags that alert possible illegal content or activity (such as Spamming)
• Cookies (see our Cookie Policy)
• Random Profile Text (we extract certain data from your profile, to make a "Mini Headline")
• Security Data (i.e. data created if someone tries to hack into your account etc.)
• Log-in records (including failed login attempts)
Location & Geographic Information:
We collect data about your current location, your primary location and other locations that you or your device provide to us or that we calculate. This data includes IP Location Lookups, Post Codes and Zip Codes, Full or Part Addresses, Cities and Towns, Counties and States, Geolocation Data, Latitude & Longitude.
Biometric Data:
We may use biometric data to automatically identify you in Photos, to prevent other people uploading Pictures of you without your permission, to automatically Tag you in Content and to operate Face Tracking and Face Manipulation features.
Surveys, Research & Feedback:
We collect the data you provide to us in surveys etc. which we use to improve our services.
Third Party Data:
We also collect some data about you from Third Parties (Third Party Data) which includes:
• Other Companies in our Group (for instance, to make it quicker for you to join by pre-populating your data)
• Banks and Payment Processors (for instance, data about whether your payments were successful)
• Couriers & Postal Organisations (i.e. data about whether your parcel was delivered)
• Other Companies who have obtained your permission to share data with us, such as Advertisers or other Companies you have bought products from
• Reputable Companies who provide Addresses and Locations from Post Code or Zip Code lookups, such as Royal Mail
• Companies, such as Google, who provide us with Location Data from your IP Address, Postal Address or Latitude and Longitude Coordinates
• Information sent to us by your Browser or Device
• Providers of Credit Information
• Social Networks and similar websites which allow you to Log On to Faceparty via their service, or that allow you to import or export their data about you to Faceparty or vice versa, or allow you to share any Content that you have uploaded to them on to your Faceparty Profile and vice versa
• Market Research Companies who supply data to us, such as surveys you have completed
• Analytics Companies, who provide us with data about your use of our Products and Services
• Data that other Members upload about you (for instance a photo of you at their wedding)
• Data provided to us by the Police or another government agency, for the purposes of an investigation
• Any data that you make available to us via a Third Party
• Data from our Partners, such as information about how you used our services on their websites etc.
• Data from Suppliers about whether you partake in the services that we arrange for you, such as if we book you a hotel as a competition prize and you don’t show up, the hotel can contact us to let us know (so that we can investigate and check that you are safe)
• Technical Providers, Suppliers and Contractors all provide data to us. For example, if you have a technical fault and a contractor was paid to investigate it, they will give us data to pass on to you and our technical team, so the problem can be solved
• Outsourced Customer Service (for example a call centre) will provide us with details of your complaint, correspondence or query
• Ticket Agencies (for example if you purchased a ticket to an event) will let us know the details of your ticket purchase and contact information
• Mailing List Companies, such as Mail Chimp, will let us know if you have opted in or out of any marketing that we use their service for
• Advertising and Acquisition Information from our Ad Serving Partner
• Publicly available information from Social Networking and other websites, for example likes, shares, tweets and posts about Faceparty, which we can use to understand needs and improve our services
• Reputable Data Pairing Providers, such as Acxiom, who may provide us with data which is publicly available, such as from the electoral roll, or with your consent from surveys or other brands and companies that you engage with. This data may include basic demographic information (such as your age and gender), regional location, household status and information (i.e. if you own or rent your property), financial information, information about your life stage (such as if you are married or have children), media habits (such as which shows and magazines you prefer), your purchasing ability, information about your career and education, credit information and personal interests (such as your hobbies and how often you like to eat out)
Other Data:
We might also add our own data, which relates to you and your Account, for example:
• Notes about your Behaviour and Account
• Messages sent to you from our Admin Staff
• Free Trials or Free Days of Subscriptions
• Flags that mark you as Banned (and how long for)
• Data that Blocks you from certain Features
• A Flag that schedules your Account for Deletion
• Data that prevents you from Interacting with certain people
• Data that promotes a popular Post, Group, Image etc.
• Data that blocks your IP Address, Email, Device Identifier
• Data that prevents you from uploading certain Content
• Flags that categorise whether your data is family friendly or NSFW etc.
• The creation of "Do Not Contact" lists
• Other data necessary for the proper management and running of your Account
We will also store data that relates to any further Policies or Terms and Conditions that you agree to, during the use of our Products and Services.
If you apply for a job at Faceparty, we will also have the information you provide to us for that purpose.
How do we Use your Data?
Our use of your personal data will always have a lawful basis, either because it is necessary for our performance of a contract with you, because you have consented to our use of your data (i.e. subscribing to emails), because it is in our legitimate interests, or because it is a legal requirement. Specifically, we may use your data for the following purposes:

• To automatically detect your face in images, to facilitate auto-tagging, fun features and security features
• To feature members at random and through set criteria on our home page etc.

• Analysing your use of our Products and Services and gathering feedback to enable us to continually improve our Products, Services and your user experience
• To produce brochures and marketing information for our Company/s and our Products and Services
• For Tax, VAT and Accountancy purposes
• To fix Bugs and develop New Features
• For Profiling purposes (to build up a picture of you and the types of products and services which may be of interest to you)
• To provide Data Pairing Services
• To calculate the effectiveness of our Marketing, including managing any commission

Third Parties (such as Google, YouTube or Instagram) whose content appears on Faceparty may use third party Cookies, as detailed in our Cookie Policy. Please refer to our Cookie Policy for more information. Please note that we do not control the activities of such Third Parties, nor the data they collect and use and advise you to check the Privacy Policies of any such Third Parties.
You have the right to withdraw your consent to us using your personal data at any time, and to request that we delete it.
Use of your Data in Marketing and Advertising:
With your permission and/or where permitted by law, we may also use your data for marketing purposes which may include contacting you on Faceparty, by email, telephone, text message and/or by post with information, news and offers on our Products and Services and in some instances those of our Partners and Advertisers. We will not, however, send you any unsolicited marketing or spam and will take all reasonable steps to ensure that we fully protect your rights and comply with our obligations under the GDPR and the Privacy and Electronic Communications (EC Directive) Regulations 2003.
We can offer many of our products and services for free because they are funded by advertising revenue. Marketing and advertising are therefore a key part of our activities. This section shows you some of the kinds of marketing and advertising we carry out and how your data is used:
Email Marketing:
We will use your email address to send you email marketing (including our newsletter, notifications, competitions, information about new products or upcoming events, special offers, details about our Partners and information from our advertisers) where you have signed up to receive these from us.
You can opt out of receiving marketing emails (and control in detail what you can or can’t receive) in the My Settings area of your account. It may take a short while for these changes to take effect and any change will not affect any marketing emails that have already been scheduled to be sent in the future.
If you opt out of email marketing, we will still need to email you service communications from time to time, such as important matters relating to your account.
Personalised Advertising & Marketing:
We sometimes use your personal data to personalise an advert or piece of marketing for you. For instance, we might include your name within the advert.
You can opt out of this kind of advertising and marketing in the My Settings are of your account.
Data Pairing:
We want our adverts to be relevant and of interest to you, so we do all we can to build up a better picture of you and your interests. To do this we use reputable Third Party Data Pairing Providers, such as Acxiom, who may provide us with data which is publicly available, such as from the electoral roll, or with your consent from surveys or other brands and companies that you engage with. This data may include basic demographic information (such as your age and gender), regional location, household status and information (i.e. if you own or rent your property), financial information, information about your life stage (such as if you are married or have children), media habits (such as which shows and magazines you prefer), your purchasing ability, information about your career and education, credit information and personal interests (such as your hobbies and how often you like to eat out).
We carry out vetting and ongoing monitoring of our Third Party Data Pairing Providers to ensure they comply with their data protection obligations and keep personal data secure.
Data Pairing works by sharing information we hold about you with the Third Party Data Pairing Provider, or one of their customers, so they can combine the data to build up a better picture about you. We use this data to show you adverts which are more relevant to your interests or explicitly relevant to you. We also share your data with other companies for Data Pairing purposes, so they can make their own products and/or advertising campaigns better (for example, in mutual exchanges etc.).

Profiling & Targeted Advertising:
We use and combine all of the data we hold about you to create a picture of what you are like and we use this data (your Marketing Profile) to show you adverts and Content that has been more tailored to you. This could be our own Products and Services, or those of our Third Party Advertisers who want to target a certain category of customer. For instance, an advertiser may want to market a new lipstick to women aged 18-30. However we don’t provide any information that would enable you to be identified personally to the advertiser; more typically the advertiser would say "Please show this to women aged 18-30" etc. If the advertiser serves the advert themselves we use a process called "Pseudonymisation" so that you remain anonymous.
You can opt out of targeted adverts at any time from the My Settings area of your Account.
We and our advertisers use Cookies to assist in targeted advertising. Please see our Cookie Policy for more information.
Marketing our Services on Other Platforms:
We may promote our own Products and Services on Third Party Platforms, such as Social Media websites, where the Third Party will show our adverts which have been aimed or tailored specifically to you. This usually works by sending an encrypted token to the Third Party Platform which is then matched against their own records, in order to identify if you are a user.
You can opt out of this kind of marketing in the My Settings area of your Account. You may still see marketing for Faceparty and our Products and Services, but it won’t be tailored or aimed specifically to you.
Postal Marketing:
If you have provided us with your postal details and if we have legitimate reasons to mail you, we may send you mail that we think may be of interest to you, such as Party Invites. You can opt-out at any time, by following the instructions in the post that you receive or by asking us not to send you mail.
SMS Marketing:
If you have provided us with your cell or mobile phone number, we will use your phone number to send you marketing messages by text message where it was made clear that we will do so. You can opt-out at any time by texting "STOP".
Third Party Advertising:
Sometimes we will also share your Marketing Profile, or part of it, with reputable Third Parties, such as other leading websites or advertising agencies, to help them target their own advertising on their own platforms. This helps to make sure that these Third Parties have as full a picture of you as possible and they can therefore target relevant adverts to you on their own platforms that you will find interesting and helpful.
This Data Pairing applies where you have also shared your personal data with that third party in the course of using their service. The data held by the two sources is combined. These Third Parties are thereafter responsible for how they use the data we share with them and how they advertise to you using that data.
You can opt out of Data Pairing in the My Settings area of your Account.
Push Notifications:
If you download our App, some of the communications we send to you, including marketing communications and alerts of new messages, may be sent by Push Notifications. Push Notifications are messages that pop up on your device. You can chose whether or not to receive Push Notifications from the app and device settings.
If you use an Android device, your device will automatically opt you in for Push Notifications and you will need to turn these off if you don’t want to receive them. If you use an Apple device, you will be asked if you want to receive them when you set up your app. You can always edit or change your mind at any time in your device and app settings.
Settings:
You can opt in or out of marketing at any time, using the controls in the My Settings area of your account, or by using the "Unsubscribe" or "Update Settings" links in the emails that we send you (to opt out of emails) or by texting "STOP" by reply to an SMS message (to opt out of SMS messages) or by following the instructions in any physical mail-out (for postal marketing).
We will always respect your preferences, but please note that it can take a short while for your preferences to take effect (usually no more than 2-3 days) and any changes made will not affect marketing that has already been scheduled to be sent out.
Even if you opt-out of certain types of targeted advertising, you will still see adverts – they just may not be tailored to your interests.
To opt out of Push Notifications, you need to do this from your app and/or device.

We only process your data when we are lawfully entitled to do so. Our legal basis for each category of data is defined below:
Creating & Maintaining your Account & Public Profile: Contract
We process the data you provide to us (manually or automatically) in order to create and provide your Account, your Public Profile and Location Services in accordance with our Contract. Some additional Location Services may rely on your Consent, for example if you are not logged on, but you will be made aware of this at the time.
Photos, Videos & Other Media: Contract
You may stream, upload, manage and store Photos, Videos and Other Files (including any Content you share or import from other Social Media sites) in accordance with the Contract you enter when you join Faceparty or one of our Partner Sites. We process this type of data under the Contract.
Messaging & Interaction: Legitimate Interests
To make sure we can provide you with the best messaging and interactive services that we can and to enable you to interact with our other members in the ways that you enjoy.
Searching, Browsing & Matches: Legitimate Interests
To be able to provide you with members who we think will be of interest to you, based upon the information you provide. If you ask us to remember your Search Options, that data will be stored on our servers until you overwrite the search with new options.
General Account Management & Provisioning: Legitimate Interests
Certain data related tasks, such as knowing what language you speak, importing your data, providing you with a Member ID, calculating your age and birthday, assessing what size screen you have etc. are all essential in the provisioning and management of your account.
Email Marketing: Consent
We will only send you marketing emails and newsletters when you have consented to receiving them. There may occasionally be an exception, where we will rely on Legitimate Interests to contact you by email. You can manage your Consents in the My Settings area of your Account, or by following the link in any email.
Service Emails: Legitimate Interests
We will send you occasional service emails. For example, to let you know when you have a new message from another member, or to alert you of a security breach. You can turn Message Alerts or Rating Alerts off in the My Settings area of your Account, or by following the link in any email.
Advertising & Marketing: Legitimate Interests
To provide advertising that is relevant to you and to ensure that you have the best experience possible of using Faceparty, our Partner Sites and Third Party Platforms, as well as to give the best service we can to advertisers and to generate more revenue so we can provide the best service possible. Advertising also enables us to keep certain features free.
Profiling & Data Pairing: Legitimate Interests
To build up a picture of you and the types of products and services which may be of interest to you, to customise your use of Faceparty, our Partner Sites and Third Party Platforms to make sure you have the best experience possible and to maximise effectiveness for our advertisers and Partners. Where we use profiling to assist other companies to target their advertising, we do this on the basis of the Third Party’s legitimate interests in ensuring they can deliver appropriate, relevant and effective advertising and content on their platforms.
Content Delivery & Edge Computing: Contract
To provide a faster and more reliable service, your data may be processed "on the edge" and on Content Delivery Networks in accordance with your Contract.
Development, Hosting, Technical & Backups: Legitimate Interests
To provide you with our Products and Services, to assist in developing new features, to improve existing features, to protect your data and to facilitate everything from a technical perspective.
Account Settings: Legitimate Interests
It is with Legitimate Interests that we store your settings and preferences, as they allow us to provide and administer our Products and Services to you.
Security & Verification: Legitimate Interests
It is in our legitimate interests to use your data to protect our Infrastructure and your Account and to make sure everything you do is lawful. In some instances it is also a Legal Requirement for us to fulfil these tasks.

We only share your data with the Police, the Court or other government agency where we are legally required to do so, or sometimes if it is essential to protect someone’s safety (Vital Interests).
Job Applications: Legitimate Interests
We use this data to assess your suitability for employment and to potentially offer you employment.
You have the right to object to us processing your data. Please see the section entitled "Your Rights" for details and more information. You can also delete your Account and opt out of marketing at any time.
Do We Share your Data?
We may share your data with other companies in our group in order to provide you with our Products and Services, to produce Marketing Materials and for Statistical, Analytical and Research purposes. This includes any subsidiaries and any future holding company and its subsidiaries.
We may sometimes contract with Third Parties to supply products and services to you on our behalf, or to undertake work on our behalf. These may include payment processing, call centres and customer service, content validation, download services, design services, web and app development, troubleshooting, database optimisation, security services, legal services, business services, chat and messaging services, analytics and market research, data pairing, targeting tools, web hosting and content delivery, media playing services, production and delivery of goods, search engine facilities, maps, address lookup and location services, event services, content providers, account login services, advertising, advert delivery, location services, SMS providers, financial and accounting services and marketing. In some cases, the third parties may require access to some or all of your data. Where any of your data is required for such a purpose, we will take all reasonable steps to ensure that your data will be handled safely, securely, and in accordance with your rights, our obligations, and the obligations of the third party under the law.
Data is shared with our Partner Sites (other sites we operate for ourselves or for others) which includes the search results and Profiles from Faceparty and vice versa. You can control how we do this from the My Settings area of your Account.
Because you make a Public Profile on Faceparty (or our Partner Sites), we share your Public Profile with the general public (such as Faceparty’s members).
If you share something on Social Media, the other Social Media will have the data that you shared and will know what date and time you shared it, where you were and what page you were on as you did so. We may also share some content with Social Media, in accordance with the section called "Marketing our Services on Other Platforms" above.
We share data with Third Party Data Pairing providers, for the purpose of data pairing as described above under the section "Data Pairing" and we also provide a Data Pairing service to Publishers, Advertisers and other Companies to make their products and advertisements better for them and for you (see section above called "Third Party Advertising").
We share data with Third Party media agencies and advertisers, in which case data will be shared in a pseudonymised form as described above in the section called "Profiling & Targeted Advertising".
We may compile statistics about the use of Faceparty including data on traffic, usage patterns, user numbers, sales, and other information. All such data will be anonymised and will not include any personally identifying data, or any anonymised data that can be combined with other data and used to identify you. We may from time to time share such data with third parties such as prospective investors, affiliates, partners, and advertisers. Data will only be shared and used within the bounds of the law.
We may sometimes use third party data processors that are located outside of the European Economic Area ("the EEA") (The EEA consists of the United Kingdom, all EU member states, plus Norway, Iceland, and Liechtenstein). Where we transfer any personal data outside the EEA, we will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the UK and under the GDPR. Examples of these Third Parties include:

In certain circumstances, we may be legally required to share certain data held by us, which may include your personal data. For example, where we are involved in legal proceedings, where we are complying with legal requirements, a court order, or a governmental authority. We may also need to share or grant access to your data to the ICO (the UK’s supervisory authority for data). For example, if they are checking that your data is stored correctly, or investigating a complaint.
We will also share your personal data with Third Parties where you have specifically consented to us sharing your data with them, where we are required or permitted to so by law or to protect or enforce our rights or the rights of a Third Party.
Where do we Store and Process your Data?
We store and process your data in a number of ways: on your device (such as in "Cookies" or "Temporary Internet Files"), in secure data centres (where our website is hosted), securely at our offices (for example, if you send us an email) and with trusted third parties (for example, banks and payment providers).
Some or all of your data may be stored outside of the European Economic Area ["the EEA"] (The EEA consists of the United Kingdom, all EU member states, plus Norway, Iceland and Liechtenstein). You are deemed to accept and agree to this by using Faceparty (and our products and services) and by submitting your data to us.
If we do store data outside of the EEA, we will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the United Kingdom and under the GDPR (and prior to May 25, 2018, the Data Protection Act 1998). Examples of how your data is used and processed outside of the EEA includes:
Content Delivery Networks:
Faceparty uses Content Delivery Networks (CDNs) to deliver our services to you, which means that certain elements of your data – but only data that you make publicly available (such as your photos) – are stored more locally to our users around the world. We only store this data in secure, certifiable and approved data centres, for up to 28 days. For example, we "cache" a copy of publicly available data in New York and in other cities across the world.
Content Validation:
In order to make sure that our members are kept safe and to help prevent members from breaking the law by uploading anything illegal, we manually check certain data that you upload. For instance, we check that your photos don’t contain anything obscene or offensive. This process is known as "Validating" and we outsource this service overseas. In order to protect your data:
• We only grant these suppliers access to data which could be seen by the public.
• We only allow this data to be viewed or exchanged over a secure and encrypted connection (known as "SSL").
• Access to this data is only possible from machines which have special software installed, which only we can distribute; without this software, our Validating system cannot be accessed.
• We only allow these suppliers to retain your data for a maximum of 48 hours. However, if there is a problem with the content that you have uploaded (for example, if they spot something which may be illegal) they may keep it for longer than 48 hours, but no longer than is necessary. This is to enable additional processing - for example, to show the content to a solicitor for a second opinion.
Edge Computing:
We sometimes use a computing technique known as "Edge Computing". This means that when you make a request to our servers (for example, when you visit a web-page or open the app), instead of our servers compiling your request at our main datacentre (which could be 1,000s of miles away from you), servers which are more local to you can do the clever work instead. This means we can provide you with our services in a much faster way.
Local Databases:
We reserve the right to replicate or relocate our core database anywhere in the world, in order to provide a secure, faster and more reliable service. "Replication" is common for popular apps and websites because it means your data can be accessed much faster (because a copy is more local to you) and because the storage of your data is much safer (for example, if a fire destroys your data in one location, your data remains safe at another). We will only replicate or relocate our main database to leading, secure, trusted and certified data centres. When you delete your data from one of our databases, it is automatically deleted from all of our databases. However, it may take a short while for all of our databases to "catch up" with any changes – but usually, this would be no longer than a few hours.
Third Party Suppliers:
Some data may be stored by reputable third parties outside of the EEA. For example, we use Google Analytics (a service to learn more about how people use Faceparty and to monitor Faceparty’s progress and popularity), Google ReCaptcha (a service to check you are real), Google Maps and Google Location Services. We also use local SMS providers to send text messages. If you login to Faceparty using another Social Network, they may be based outside of the EEA (such as in the USA). We usually manage our own email newsletters, but sometimes we use a Third Party service outside of the EEA, such as MailChimp (which is based in the USA). We may also use Data Pairing Providers outside of the EEA and we may outsource some Customer Service tasks overseas in the future. We only ever use reputable third party suppliers who understand, respect and uphold the requirements of our Privacy Policy and the GDPR.
Your Device:
Some data is processed on the device that you use Faceparty’s products and services on, such as your phone or computer. This means, for example, that if you live the United Kingdom and are on vacation in Australia, then some of your data will be processed in Australia, because you and your device are in Australia and so on. We also store Cookies on any device that you use Faceparty on (See our Cookie Policy for more info). For safety use an Incognito or Private browser when overseas.
Other People’s Devices:
Just as data can be stored and processed on your own device, it can be stored and processed on other people’s devices too. This is normal. For instance, it would not be possible for someone to view a picture you have uploaded, until their device has first received and processed your picture’s data. Only your Member ID and publicly available data (or data you have shared with them in private) can be processed on other people’s devices when they use Faceparty and its services.
How Long do we Keep your Data?
We only keep your personal data for as long as we need to in order to use it as described in this Privacy Policy and/or for as long as we have your permission to keep it.
Profile & Account:
You can edit or delete the entire contents of your public profile (and you can edit some of your contact information) whenever you log on to your account. This means that you are in full control of the content that appears on your public profile. When you edit or delete data from your profile, it is amended or deleted from our database in real-time, meaning that we won’t keep a copy of it. However, it may take a short while for our replicated databases to catch-up (see the section called Local Databases for more info).
You can delete your account at any time without having to give us a reason.
When your account is deleted, we immediately make it unavailable to the public. However, it remains hidden for a period of up to 28 days before your account is permanently deleted. This is both for technical reasons and as a security measure. For example, this enables us to prevent identity fraud – by keeping a copy of your member name, we can stop anyone else obtaining it and pretending to be you. It also means you can change your mind about deleting your account during this period, if you want to.
After your account is permanently deleted, any remaining information about you (subject to some exceptions, as detailed in this Policy) is automatically anonymised, meaning it is no longer personal data.
You can close your account at any time by following the instructions in the My Settings section of your account.
We also have the right to delete your account without any notice to you. For example, if your account is suspected of being used in illegal activity, has breached our Terms & Conditions or appears to be blank and unused, we may do so.
We also reserve the right to delete your account if it goes unused for a long period of time. This will not affect your right to create a new account in the future, if you wish to do so.
We may need to keep your data after account closure for limited purposes, for example in order to respond to any complaints or claims that you make. If this is the case we will only keep the data for as long as we need to in order to fulfil those purposes.
Purchasing & Transaction Data:
By law we must keep information relating to any purchases you make for a minimum of 6 years. We will not use this data for any purposes other than your order fulfilment, analytical purposes, our legal requirements and for providing you with customer service.
Marketing Data:
We use separate and/or additional databases for your marketing data.
You can opt in or out of marketing at any time, using the controls in the My Settings area of your account, or by using the "Unsubscribe" or "Update Settings" links in the emails that we send you (to opt out of emails) or by texting "STOP" by reply to an SMS message (to opt out of SMS messages) or by following the instructions in any physical mail-out (for postal marketing).
When your account is deleted, if you have not opted-out of marketing, you will continue to receive marketing even though your account is deleted until you opt-out or unsubscribe. If you don’t want to receive marketing after your account is deleted, either unsubscribe before your account is deleted or use the "Unsubscribe" or "Update Settings" links in the marketing emails you receive (to opt out of emails) or by texting "STOP" by reply to an SMS message (to opt out of SMS messages) or by following the instructions in any physical mail-out (for postal marketing).
The marketing information we will store about you (after deleting your account, but while you still receive marketing) is limited to your contact details (any or all of the following: email address, mailing address and phone number), your name, your date of birth (to calculate your age), your gender and approximate location. This information is used solely for marketing and pairing purposes and will be permanently deleted when you opt-out of marketing if your account has already been deleted. If your account has not been deleted, the data will remain until your account is deleted and you opt-out of all marketing.
We may also store some additional marketing data. For example, if you have expressed an interest in receiving marketing for a particular event or product, we will store that information too, but only for as long as is required to fulfil your request. We will also keep evidence of your marketing preferences, as we are required to do by law, but only while you are set to receive our marketing – we’ll delete it afterwards.
Please note that it can take a few days for changes to our marketing databases to take effect and any changes will not affect marketing that has already been scheduled to be sent out. If you ask us to opt-out for you, rather than following the automated systems provided to you, please allow 28 days for us to process your request.
Please note: if you have created multiple accounts with the same email address (or phone or postal address), you may still receive marketing from us even after you have opted out of marketing from one account, if you are still opted in to receive marketing from another account. This is because we treat each account as a separate entity.
Pairing Data:
When your account is deleted and you have opted out of all marketing, or when you withdraw your consent, all of your Pairing data will either be deleted or anonymised automatically within 48 hours. You can opt out of Data Pairing in the My Settings area of your Account.
"Do Not Contact" Database:
If you have explicitly asked us never to contact you, for example via a particular email address, we need to keep a record of these contact details indefinitely to make sure that they are never used again. We do this only to create a "banned list". This is not the same as unsubscribing – the "Do Not Contact" database means your details can never be used by our system – i.e. they can never be entered again. For instance, if someone keeps creating accounts with someone else’s email address, this prevents them from doing so.
Banned Data:
We will keep certain data indefinitely if there is compelling reasons for us to do so. For example, if the details are required to ensure the safety of our customers, or for preventing a hacker. This "Banned List" can include but is not limited to Banned Member Names, IP Addresses, Email Addresses, MAC Addresses and Device IDs. We may also keep a copy of banned content, for example the data to an illegal image, to make sure that it cannot be uploaded again.
Edge Computing and Content Delivery Networks:
Even after your data has been deleted at its source, it may remain on our Content Delivery Networks for up to 28 days.
Load Balancers, Application Caches & Firewalls:
Your data may remain in the memory of our Load Balancers, Application Caches and Firewalls for a period of time after its deletion, but it will automatically be deleted next time the device is restarted.
Session Data:
When you log off, your session data is automatically deleted.
Server Logs & Backups:
The data stored in Log Files (for example Server Log Files, Chat Log Files and Database Log Files) is stored as standard for no more than 7 days. However, occasionally we need to store this data for longer. For example, if there is a technical fault which we need to solve. If we need to store this data for longer than 7 days, we will only keep the data for as long as is necessary to complete the task for which the data was stored. For example, as soon as the technical problem is solved, the data will be deleted.
We backup your data on a daily, weekly and monthly basis, so that we can ensure that your data, our Products & Services and our business/es are kept safe. This is a standard process and is essential for operating a service such as ours. Daily backups are kept for 7 days, weekly backups are kept for up to 6 months and monthly backups are kept indefinitely. Backups are kept in a secure location and exist so that we can roll-back from any serious issue that affects your data or our products and services.
Please note that if a server or database crashes and we have to restore it from backup, any changes you have made may be lost or undone. In these incidents you may need to re-apply your changes. We cannot accept responsibility for any changes lost or undone because a server or database crashes, as it is an unfortunate occurrence that is beyond our control.
We also take an annual snapshot of our databases to keep permanently in an archive, for research and technical purposes. This is kept securely and offline and is primarily used so that we can learn from the past and look back upon it, in order to draw ideas for the future. We do not keep your photos (or other media) in this archive and we anonymise your account data, so it is not personal to you.
Cookies & Temporary Internet Files:
Please refer to our Cookie Policy for information about our use of Cookies.
Whenever you use the Internet in a browser (unless you are using a Private or Incognito browser) your computer stores a local copy of some of the files that you have viewed. For instance, if you look at someone’s picture on Faceparty, your computer might store a copy of it locally in something called a "Cache", for an indefinite period. Please refer to your browser’s help files to learn how to "clear your cache".
Call Logs, Emails and Customer Service:
The reasons you could contact us varies immensely, so we cannot say for sure exactly how long each piece of correspondence will be kept for, because each is judged on its own merit. For instance, by law we are required to keep certain documents for a minimum of 6 years, whereas others can be deleted immediately.
All correspondence which could potentially be required as evidence in a dispute will be kept for a minimum of 6 years, on account of the Statute of Limitations in the United Kingdom. We often receive fan mail ...and we want to keep that for ever! So for safety, let's say we’ll keep correspondence between zero days and indefinitely – but this will not affect your right to be forgotten (see the section called "Right to be Forgotten / Right to Erasure" for more information).
Competitions, Testimonials and Profiles used in Marketing:
If you have provided us with a testimonial which we use in our marketing, or if you have won a competition and your name or photo has been published as a result, or your photo or profile has been used in a screenshot in an article or a marketing device, this will exist indefinitely even after your account has been deleted.
In certain circumstances you may have the right to be removed from any such marketing. Please get in touch if this applies to you and we’ll do our best to help.
Event Guestlists:
If you are invited to an event, your details will be kept on a guestlist for as long as is necessary to fulfil the requirements of the guestlist, which includes a period after the event to fulfil any post-event activities (such as checking you got home from an event safely). With the following exceptions, the data will be destroyed and shredded after its use.
Where we have legitimate interests, or if you have consented, certain kinds of event data may be kept indefinitely (for example, so you can be invited to the next event). You can withdraw your consent at any time and if so your data will be deleted within 28 days of you asking us to do so (but usually within 48 hours).
App Data and Device Consents:
When you manually log out of the Faceparty app your local data is automatically deleted, with the exception of some data that may remain in your browser’s cache. The consents you have made in relation to camera access and location settings will remain after you have logged out. For information on how to revoke local consents or to delete temporary internet files in your browser’s cache, please refer to your device’s handset.
Messages Sent to Others:
When you send a message, a chat, or a comment to another member, it will exist until they delete their copy. If your account is deleted, the messages you have sent will be anonymised (meaning you cannot be identified as the sender) but the rest of the message may remain intact. For this reason, please remember that if you put any personal information within the message / chat / comment itself, such as your phone number, that data may remain even after you delete your account. This is the same when you send someone a text message, an email or a postal letter.
Groups & Forum Posts:
When you create a group, or a forum topic, they may continue to exist after you delete your account (for example, if the group you created is popular and used by lots of other members). However, you will be fully anonymised as the creator.
Forum posts that you make may also remain after you have been deleted, but again you will be fully anonymised as the poster. Please refrain from posting personally identifiable information within your posts, so it can't be used to identify you after your account has been deleted. Notwithstanding, please get in touch if there is something that you really want to get removed and we will do our best to help, when we are lawfully entitled to do so.
Webcam and Audio Streams:
Webcam and audio streams are kept for a maximum of 28 days, unless you explicitly consent for them to be kept for longer.
Browsing Options:
If you ask us to remember your browsing or searching options, then they will only be remembered until you over-write or reset them (or until your account is permanently deleted).
Security Data:
Data collected in order to protect our infrastructure and member accounts is kept indefinitely and as long as needed.
Exceptions
Sometimes there may be compelling lawful reasons which over-ride the normal duration for which your data is stored. For example, if you have engaged in criminal activity we may need to keep your data indefinitely (if it is required to prevent further criminal activity) or for the duration of an investigation.
If ever there is a technical error in the processing or deletion of your data, meaning that your data remains in whole or in part on our servers by accident when it ought to be deleted, we will endeavour to delete it as soon as feasibly possible after it has been discovered and without unnecessary delay. An example of this occurrence may be that a temporary copy of an image that you have uploaded fails to be deleted because a server crashed mid-processing. The instance in this example is unavoidable, because so many millions of images are uploaded and all servers crash occasionally – but we will always do our best to keep on top of any such housekeeping.
Cookies:
We use Cookies, both to facilitate and improve your experience and to provide and improve our products and services. For more details, please refer to our Cookie Policy.
Children:
Faceparty is not suitable for children. Please report anyone who you suspect may be under age immediately.
No Primary Storage:
Faceparty has not been designed as a primary storage device for your data. If you upload a photo to Faceparty, or indeed any other type of file, make sure you keep the original elsewhere. We cannot take any liability for any lost, damaged or deleted data that you upload to Faceparty, or create on Faceparty, because Faceparty is not designed as a storage device.
If you share Faceparty Content (including your own Content) on other Social Networks, we can make no warrantee that the Content you have shared will remain on our servers for any period of time, nor that the links will remain active.
Data Risks / Misuse of Data:
Faceparty is a fun place to be and there’s loads of great people for you to meet! We want you to remember that whenever large groups of people are involved, there’s always a risk of troublemakers. Because on Faceparty (and our Partner Sites) you make certain data available to the public (such as our other members) you need to be aware of the risks. For this reason, we want you to consider the following before making any decisions about whether to join Faceparty and what data to make available to us and the public.
Spiders, Harvesters, Scarpers & Crawlers:
Search Engines, such as Google, use Spiders to crawl the web and populate their databases with content. We give you the tools to tell Search Engines not to allow spiders to capture your Profile, but some parts of your Profile and anything you make publicly available elsewhere on Faceparty is available to the spiders.
Not all spiders will respect your request to be ignored. For example, malicious tools could grab and collect information which is publicly available. We do all we can to minimise and prevent as much of this as possible, but we cannot offer you any form of guarantee. In short, only make stuff publicly available if you really don’t care who sees any such data nor what happens to it. Everything you make publicly available is at your own risk.
Malicious Profiles, Fake Profiles & Revenge Pics:
Sometimes people will steal pictures (and other data) that you make publicly available, so that they can pretend to be you, use it to create defamatory things about you (such as create fake profiles on Faceparty or other websites) or upload pictures of you that they have acquired in order to embarrass you (such as revenge pics). Unfortunately, these are very common occurrences on the Internet.
Sometimes there's no malice in it (i.e. a stranger who needed a picture to upload and grabbed the first one they saw, or a friend playing a prank) but it could be a jealous friend or an ex who intentionally wants to annoy you. We can't stop this kind of behaviour, because it isn't a Faceparty problem, but an unfortunate part of human nature. All we can do is help you to remove any such content after it has been uploaded. Simply use the tools to report offensive content on any profile.
Journalists, Pranksters, Enemies & Weirdos!
Remember that if you make something publicly available, you make it publicly available and therefore it is available to the public. In case you are unaware, not everyone is nice and not everyone has your best interests at heart. Anything you make publicly available can be screen-grabbed, copied, saved, manipulated, twisted and used against you. Again, only make stuff publicly available if you really don’t care who sees it and what happens to it. Everything you make publicly available is at your own risk.
Hackers:
We go above and beyond to make sure we use leading technology to protect your data, such as firewalls and encryption. However, even if we hid your data in the belly of a shark and guarded it with machine guns, there will always be someone capable of getting it, if they really want to. We do our best, but we can’t offer you any guarantees – nobody can. For safety, use different passwords for different websites and only provide data if you understand the risks and are happy to take them.
Password Sniffers & Email Hacking:
We have software to severely reduce the effectiveness of password sniffers, but if anyone can gain access to your email account, they can request a password reset and obtain access to your account. Keep your email account safe, have a long and complex password and don’t share your login details with anyone.
Other People’s Cache:
Even after you delete Content from Faceparty, and after it has been totally erased from our servers and infrastructure, Images and other Content could still exist in other people’s web browsers and devices in the "cache", for example as Temporary Internet Files. You cannot control this, you just need to understand the risks.
Stalkers, Pests & Obsessives:
These people exist and we can’t stop that. We give you the tools to block someone, or add them as a Pest (which stops them interacting with you). However, they will have access to the information you make publicly available. Be aware of the risks.
Other People’s Pictures (and other Content):
Other people can upload pictures of you. We ask that you only upload content of yourself or content that you have permission to upload. You can report any data that others upload against your will by using the Report links.
Web Archives:
There are global organisations that take snapshots (archives) of the Internet, from time to time. They only have access to publicly available data. If you opt-out of search engines, they will be instructed not to take a copy of your Profile. However, if you appear as a linked friend on someone else’s Profile, in a Group or Forum, in a Search Result or on our Home Page, they may have a copy of your data and Mini Profile (the data that appears in search results) along with any posts or comments you have made. We are working to anonymise this data and will work with you to remove any content they take which you don’t want to be publicly available.
The above risks apply to Faceparty, our Partner Sites and some of the Third Parties that your data is shared with. Please be assured that the levels we go to protect your data is above and beyond …we just want you to be informed. Remember, there are tonnes of great, amazing and fun people on Faceparty too!
Criminal Matters:
If anyone engages in, is reported of or realistically suspected of criminal conduct in relation to our Company/s, our Members or our Products and Services (for example harassment or attempted hacking), or is in serious breach of our Terms & Conditions, then we will retain all related evidence indefinitely, including but not limited to your public data, private data and private exchanges. In addition, this information will be stored at the offices of our legal representatives. This information will be used for investigation and possibly civil and/or criminal prosecution. The information may be made available to the Police and other law enforcement agencies. In the event of prosecution, a Police RIPA request or a Court order, the information may also be made available to the victim/s.
Private Exchanges:
If we discover that you've been spamming, have engaged in certain illegal activities or are in breach of certain Terms & Conditions, we reserve the right to view any data that you have exchanged on Faceparty (and our Partner Sites) and to be able to use it for investigation purposes and as evidence against you, including in a court of law. This means we can gain convictions against spammers and so forth. We will only do this when absolutely necessary and for the greater benefit and protection of the community.
Additional Policies:
Sometimes (for example, when using new features, entering a competition or attending an event) we may require you to accept additional terms or a supplementary Privacy Policy may apply. We will make this clear to you at the time.
Sale or Transfer of Our Business or Assets:
We may, from time to time, expand or reduce our business operations and this may involve the sale and/or the transfer of control of all or part of our business/es and/or assets. Any personal data that you have provided will, where it is relevant to any part of our business or asset that is being transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use that data only for the same purposes for which it was originally collected by us.
You consent to the Assignment, Novation or Transfer of (a) this Privacy Policy, (b) your Data, (c) your purchases/ payment details, and (d) your Member Account and Profile to the assignee of our business/es or any asset, should the assignee purchase or licence/license our website or app or part thereof. We guarantee that such Assignment, Novation or Transfer would only be made if the assignee is a Registered Data Controller and/ or PCI DSS Compliant.
In the event that any of your data is to be transferred in such a manner, you may or may not be contacted in advance and informed of the changes. When contacted you will not, however, be given the choice to have your data deleted or withheld from the new owner or controller outside of the existing rights you have. Your rights in relation to the data will remain as before; i.e. you can still delete your account or ask for any data to be deleted.
Because Faceparty is jointly owned between a number of companies, each company is a Controller and each will be entitled to a copy of your data if the companies split. For instance, if Faceparty splits into two new separate websites, each owned by a different company or group of companies who are current Controllers, then each website will have a copy of the data and you will (at the discretion of the Controller/s) be a member of both. Your rights will be ported in full to each new website, but on a separated legal basis; for instance, you can thereafter opt to be deleted from one and not the other (or from both, or neither), but if you want to opt out of both you will need to do so separately as the Controllers will no longer be linked. You will be notified if this happens.
Your Rights:
As a data subject, you have the following rights under the GDPR, which this Privacy Policy and our use of personal data have been designed to uphold:
• The right to be informed about our collection and use of personal data;
• The right of access to the personal data we hold about you (see the section entitled Data Access);
• The right to rectification if any personal data we hold about you is inaccurate or incomplete (simply edit your own data by logging on to your account, or contact us using the details at the end of this page);
• The right to be forgotten – i.e. the right to ask us to delete any personal data we hold about you;
• The right to restrict (i.e. prevent) the processing of your personal data. This includes how your data is used for marketing purposes;
• The right to data portability (obtaining a copy of your personal data to re-use with another service or organisation);
• The right to object to us using your personal data for particular purposes; and
• Rights with respect to automated decision making and profiling.
We will normally need to ask you to prove your identity before we can respond to any requests to exercise your rights. We may also need you to provide further information to help us undertake your request (for example, to help us locate the data your request relates to).
We will respond to any requests to exercise your rights as soon as we can and in any event within 30 days of receiving your request and upon the receipt of any necessary proof of identification and/or further information required. If your request is particularly difficult or complicated, or if you have a large volume of requests, we may take up to 90 days to respond. If this is the case, we will let you know as soon as we can and will explain why we need more time. We will pay the costs of responding to your requests. However, if you make repetitive, harassing or burdensome requests, you may be asked to pay the costs.
Data Access:
You can access, edit and manage all of your personal details and account data by logging on to your account.
You also have a right to ask us to send you a copy of the information we hold about you (subject to some exceptions). Right to be Forgotten / Right to Erasure:
In certain circumstances, you have the right to ask us to delete your personal data, for example if we have processed your data unlawfully or if we no longer need the data for the purposes set out in this Privacy Policy.
You can delete your account and your profile at any time – you don’t need to give us a reason. When your account is deleted, all of the personal information you provided to create your account and profile will automatically be deleted or be "anonymised" (meaning, that it will no longer identify you and it will cease to be personal data). Some exclusions apply. For instance, we are required by law to keep details of any payment transactions you have made (for tax inspection purposes) and as such we cannot delete that data.
If you ask us to delete your account for you, please allow up to 30 days for your request to be processed.
If you ask us to delete your personal data, but you do not want your account to be closed, it may not be possible or we may not be obliged to comply and we will need to keep processing your data in a personally identifiable way to keep your account open. However, remember that you can still close your account at any time.
Once your account has been deleted, your profile ceases to be available to the public and you can no longer log on. However, your data will remain on our servers for a period of time. Please see the section called "How Long do we Keep your Data?" for more information.
Please remember, that when you send a message or a comment to another member, then that data becomes theirs. After your account has been deleted, we will anonymise you as the sender, but the content of the message may or may not remain intact. If the message remains, your message will be the exclusive property of the recipient. For this reason, if you write personal content in a message to another member, we will not necessarily have the power (and you will not have the right) to delete it – only they can. This is the same if you send somebody an email, a letter or a gift outside of Faceparty. If you do not want someone to have the data that you send them, do not send it to them.
In a similar way, if you make public forum posts, we will anonymise you as the poster once your account is deleted, but the forum posts you have made may or may not remain. For this purpose, be sure not to place personally identifiable information within your post (such as your phone number). If you have done this by mistake, please get in touch and we’ll do our best to help.
For those who have deleted their account without exercising the right to erasure: If you have subscribed to our marketing emails, you will continue to receive these emails after your account is deleted, unless you unsubscribe from the emails first. You can always unsubscribe from our emails after your account is deleted, by using the "Unsubscribe" or "Update Settings" link in the emails.

Right to Restrict (incl. Marketing Preferences):
Restricting your personal data means that we will only store your personal data and won’t carry out any further processing on it, unless you consent or we need to process the data to exercise a legal claim, or to protect a third party or the public or for another legal obligation.
You can ask us to restrict the processing of your personal data in certain circumstances, for example if we no longer need the data but you require us to keep it in order to assist you in a legal claim, or if you think the personal data is inaccurate and we need time to correct it.
You can restrict and manage how your data is used for marketing purposes (including if we send you newsletters and email alerts) by using the controls available to you in the My Settings area of your account, or by following the instructions at the bottom of any of the emails that we send to you. If we ever engage in SMS marketing messages, you can opt out of them easily, by texting the word "STOP". Please note that it may take a short time for opt-outs to take effect.
You can control how your data is used for advertising in the My Settings area of your account.
If you are in the United Kingdom, you may wish to sign up with one or more of these preference services: The Telephone Preference Service ["the TPS"], the Corporate Telephone Preference Service ["the CTPS"] and the Mailing Preference Service ["the MPS"]. These may help to prevent you from receiving unsolicited marketing. Please note, however, that these services will not prevent you from receiving marketing commutations that you have consented to receive.
Data Portability:
Where our lawful basis for processing your data is either by consent or by contract, the data you provide comes with the right of Data Portability. This means that your public profile and the media that you upload are to be Portable.
At the time that this Privacy Policy was produced, the industry agreed method of Data Portability (for our industry sector) has yet to be devised. Until such protocols have been agreed, it is not possible for us to provide you with this data in the correct format. However, as soon as the protocols exist, we will endeavour to produce the software which will create your Portable Data as soon as we reasonably can. You will then be able to download your Portable Data from the My Settings area of your account.
In the meantime, you can still download a copy of your data by visiting your profile in a web browser and saving the page as HTML. You can do this by right clicking your profile and choosing "Save As…". You can also save your photos by the same method. Please contact us if you need any help or assistance.
Right to Object:
You have the right to object to us processing any personal data that we process where we are relying on legitimate interests as the legal basis of our processing.
You can withdraw your consent to receiving marketing emails, newsletters and certain cookies at any time in the My Settings area of your account, where you can also manage a number of other ways in which we process your data. You can also delete your account without having to give us any reason.
If you object to any other ways in which we process your data, we will do our best to comply with your requests. However, if you object to certain processing of your personal data, but you do not want your account to be closed, it may not be possible or we may not be obliged to comply with your request and we will need to keep processing your data in a personally identifiable way to keep your account open. For example, if you want to have a profile on Faceparty, but do not want your data to be processed in order to make your profile, it would not be possible to comply with your request. If we have compelling grounds to carry on processing your personal data, we will be able to continue to do so. However, remember that you can still close your account at any time and that you still have the right to erasure.

Automated Decision Making and Profiling:
Faceparty relies upon automated decision making and profiling, because both are essential to our core products and services. For example, if a straight man in London wants to use Faceparty’s dating services to meet compatible women in his local area, our software will use automated decisions and profiling to work out who is a straight woman and who is in his local area. Without the ability to do this, we’d be showing him lesbians in New York and gay guys in Berlin, when he only wants to meet potential women to date in London. Our lesbian members in New York (and the gay guys in Berlin) would also be having the same problem. In short, the main reason people join Faceparty is to take advantage of our automated decision making and profiling software.
You have rights with respect to any automated decision making and profiling. However, for obvious reasons as described in the previous paragraph, objecting to our use of automated decision making and profiling may only be possible by the deletion of your account. Any exceptions will have controls and opt-outs in the My Settings areas of your account.
You can opt in or out of any automated decision making (and profiling) in respect to any marketing emails you receive, and the advertising you are shown, using the controls in the My Settings area of your account. If you are no longer a member, you can unsubscribe or ask us not to use automated decision making and profiling by submitting a clear request by email to: [email protected].
Your Right to Withhold Information:
You may access certain elements of our Products and Services without providing any data at all (although certain data will be collected automatically as described in this policy). To benefit from all of our features and available functions, you will be required to submit or allow for the collection of certain data.

Keep it Under Your Hat!
Never tell anybody else your password ...if you do, they can share your password with others and access all of your private information. Use a different password for each website and service you join.
Be Aware of Scams:
Here's some essential tips, to help keep you safe from scams:
• We will never send you a message asking for your password or bank details. If this happens, no matter how genuine it looks, it's a scam [called "Phishing"].
• Make sure you have "anti-virus software" and a "firewall" installed [such as Norton or McAfee] ...and that you keep them up to date. This helps to protect your computer from hackers, viruses and other malware.
• If someone sends you an email with an image embedded, which is stored on their own server, they can secretly obtain your IP address. Never choose to enable images from strangers. If you don't have a good firewall, this is all that a hacker requires to be able to find you, hack you and to gain access to your computer and everything you type. Images that are attached to an email are OK [so long as you have good anti-virus software] ...so this threat only applies to images appearing in the body of an email itself.
• Only click or visit links pointing to websites that you know you can trust. If a link points to a hacker's server, you are giving them your IP Address and without the latest anti-virus and firewall software, you could be opening up your computer to hacking and malware.
• Never install software unless it came from a trustworthy source, or your anti-virus software says it's OK. This is because programs can secretly gather information and send it to hackers.
• Never give or lend your account to someone else.
• Be careful what information you share with people that you meet on-line, even if they seem genuine at first.
• Always use a different password for each app and website. This means that if someone finds out a password for one of your accounts, they can’t automatically gain access to your other accounts.
Not everyone on-line is out to scam you ...in fact, tens of thousands of people have met their loved ones through Faceparty! It's just important to be as clued-up as possible, when it comes to keeping your data safe, so you can have a better, safer time on-line :)
GENERAL NOTES:
For the purpose of interpreting this document, the words "info", "information" and "data" all refer to the same thing. "Faceparty" refers to the Faceparty Website, the Faceparty App, our Partner Sites and any Products & Services we provide to Third Parties. "Partner Sites" refers to both Apps and Websites that run off our software and database.
Don't provide us with any information at all if you aren't happy with the contents of our Privacy Policy, or the way in which your data will or could be used.
This Privacy Policy applies only to your use of our own Products, Services and Partner Sites. Faceparty may contain links to other websites, or contain embedded content from other companies and Social Media (such as YouTube or Instagram). Please note that we have no control over how your data is collected, stored, or used by other companies and websites and we advise you to check the privacy policies of any such companies and websites before providing any data to them.
We aren't responsible for any use or misuse of any information that you make publicly available.
We do everything we can to protect your Private Data and keep our technical infrastructure secure. However, we make no warranty or representation that our Products and Services (and the Infrastructure that operates our Products and Services) will meet your requirements, that they will be of satisfactory quality, that they will be fit for a particular purpose, or that it will be secure.
To the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of our Products or Services (including Partner Sites and the services provided by Third Parties). Users should be aware that they use Faceparty, our Partner Sites and our content at their own risk.
The headings of sections and paragraphs are included solely for convenience of reference and shall not control the meaning or interpretation of any of the provisions of this Policy. If any provision of this Policy is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Policy shall remain intact, operative and binding on the Parties.
You agree that this Privacy Policy will be governed by and construed in accordance with the laws of England & Wales of the United Kingdom and except with our explicit permission shall be subject to the exclusive jurisdiction of the courts of England & Wales.
Time for a Change?
Sometimes, we need to change our Privacy Policy. For example, a law might change or we might add new features to Faceparty. If we make any changes, we’ll let you know about them here. We’ll notify you about them, if the changes are significant.
You will be deemed to have accepted the terms of the Privacy Policy on your first use of Faceparty and/or our services following the alterations. We recommend you check this page regularly, to keep up-to-date. In the event of any conflict between this Privacy Policy and any prior versions thereof, the provisions of this Privacy Policy shall prevail unless it is expressly stated otherwise.
