Terms of Service

The following Terms of Service apply to the WidgetStar service (the "Service"). Our Privacy Policy is available separately.

By registering for, or using WidgetStar, you agree to the Terms of Service and Privacy Policy. If you do not agree, please do not use the Service.

Definitions

The terms "us", "we", "our", and "Kicya" refer to the owner of the Service, Kicya LLC, a Wyoming limited liability company.

The terms "you", "your", and "user" refer to the person who registers for or uses the Service.

The term "WidgetStar" refers to the Service provided by Kicya.

The term "widget" refers to any embeddable component provided through the Service (for example, hit counter, chat, reactions, contact form, webring, or comments) that you place on your own website.

The term "visitor" refers to any person who views or interacts with a widget on a website where it has been embedded.

Accounts

You must be at least 13 years old, or the minimum age of digital consent in your country if higher, to register for an account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

Recurring Payments

If you purchase a paid subscription, payments may be processed as recurring charges through our third-party payment provider, Stripe. By subscribing to a paid plan, you authorize us and Stripe to charge your selected payment method automatically according to the billing cycle shown at the time of purchase (for example, monthly) until the subscription is canceled.

All payment processing, billing, refunds, and dispute handling related to card transactions are performed by Stripe and are subject to Stripe's own terms and policies. By completing a purchase, you also agree to the Stripe Services Agreement and related legal terms available at https://stripe.com/legal.

You are responsible for ensuring that your payment information is accurate and up to date. Failure to successfully process a recurring payment may result in suspension or termination of the paid subscription. To prevent your card from being billed, cancel your subscription before its renewal date.

Refunds

Refunds are provided on a case-by-case basis and may be denied at the discretion of Kicya. If you are not satisfied with the service, please contact us using the contact form. Nothing in this section limits any non-waivable rights you may have as a consumer under the laws of your country of residence, including any statutory right of withdrawal that may apply.

Acceptable Use

You may embed widgets only on websites that you own or are authorized to manage. You agree not to use the Service, and not to embed widgets on any website, for any of the following:

  • Anything against your local laws, the laws of the United States, or the laws of the country where the Service is hosted.
  • Spam, search engine manipulation, or low-quality backlinking.
  • Malware, phishing, or anything intended to maliciously collect a person's information.
  • Harassment, threatening, bullying, "witch hunting", or content made to slander, "expose", or "doxx" other people.
  • Impersonation of others.
  • Any activity intended to disrupt, damage, overload, or gain unauthorized access to the Service or to the infrastructure or accounts of other users, including denial-of-service (DoS or DDoS) attacks.
  • Using a widget to collect, display, or transmit the personal information of visitors in a way that is unlawful or that the visitor has not been made aware of.

We may impose reasonable technical limits on requests, storage, or bandwidth to protect the Service and its users.

User and Visitor Content

Widgets such as chat, comments, the contact form, and reactions allow visitors to submit content that passes through the Service. You are solely responsible for all content associated with your widgets, including content submitted by your visitors, and for moderating that content.

You agree not to publish or expose the personal information of visitors (for example, email addresses or IP addresses) collected through a widget, except as necessary to operate your website and in accordance with your own privacy policy and applicable law.

WidgetStar does not monitor or pre-screen content and does not assume responsibility for user-generated or visitor-generated material. By using the Service, you represent that you have the legal right to display the content associated with your widgets and that such content does not violate applicable law.

Your Responsibilities to Your Visitors

Because widgets run on your website and may collect information from your visitors, you act as the party responsible for that data with respect to your visitors. You agree that you will, where required by applicable law:

  • Maintain your own privacy policy that discloses your use of WidgetStar widgets and the information they collect.
  • Inform your visitors about, and where required obtain their consent for, any collection or processing of their data through the widgets, including any cookies or similar technologies the widgets use.
  • Have a valid legal basis for the collection and processing of visitor data through the widgets.

With respect to visitor data collected through the widgets, WidgetStar acts on your behalf and processes that data to provide the Service to you.

Compliance

The Service is operated in compliance with the laws of the United States of America. Users are required to use the Service in accordance with the laws of the United States of America, and their local laws.

Termination of Service

Kicya reserves the right to terminate your access to the Service at any time. Examples of when your access may be terminated include:

  • Violation of these Terms of Service or the Acceptable Use section above.
  • Content associated with your widgets that is against the law.
  • Creating more than 1 account.
  • Activity that is deemed harmful to the Service or its users.

Disclaimer

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Kicya be liable for any claims, damages, or other liabilities, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Service or the use or other dealings in the Service. The terms of this section will survive any termination of this agreement.

DMCA

Kicya LLC respects the intellectual property rights of others. Per the DMCA, we will respond expeditiously to claims of copyright infringement on the Site if submitted to our Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, we will take whatever action we deem appropriate within our sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright-protected content.

If you believe that your intellectual property rights have been violated by us or by a third party, please provide the following information to the designated Copyright Agent listed below:

  • A description of the copyrighted work or other intellectual property that you claim has been infringed;
  • A description of where the material that you claim is infringing is located;
  • An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not us, can contact you;
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law;
  • A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf;
  • Your electronic or physical signature.

Kicya LLC may request additional information before removing any allegedly infringing material. In the event we remove the allegedly infringing materials, we will immediately notify the person responsible for posting such materials that we removed or disabled access to the materials. We may also provide the responsible person with your email address so that the person may respond to your allegations.

Limitation of Liability

Under no circumstances, including negligence, will Kicya or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of or inability to use the Service. This includes, but is not limited to, reliance on any information obtained through the Service, as well as damages resulting from mistakes, omissions, interruptions, deletion of files or emails, loss of or damage to data, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not caused by acts of God, communication failures, theft, destruction, or unauthorized access to Service records, programs, or services. You acknowledge that this provision applies whether or not Kicya is notified of the possibility of such damages, and it covers all content, merchandise, or services available from Kicya or its affiliates. Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law. The terms of this section will survive any termination of this agreement.

Governing Law

These Terms of Service and any dispute arising from or related to the use of the Service shall be governed by and interpreted in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Changes to the Terms of Service

Kicya reserves the right to update these Terms of Service at any time. Any changes will be posted on this page and continued use of the Service after changes are posted constitutes acceptance of the updated terms.
