Àlex Hinojo: 🇪🇺 On EU and Open Access The European Research Area is stuck in a half-open state. 10 years of soft-law guidance, funder mandates, and national strategies have generated undeniable progress, but they've also created a deeply fragmented landscape across the 27 EU Member States. Researchers now face a chaotic patch-work of conflicting embargo periods, copyright frameworks, and compliance workflows. While the US, UK & Japan move aggressively toward mandatory immediate #openaccess, Europe risks falling behind due to lack of policy alignment. If we want knowledge to flow freely EU's true Fifth Freedom, voluntary guidelines will no longer suffice. Fragmented national regimes generate legal uncertainty and administrative drag at a moment when speed and collaboration matter most. We need a structural shift that aligns incentives, eliminates publisher-deferred embargoes, and sets immediate open access as the baseline across the entire ERA, as confirmed by the newest European Commission report on the topic. Real policy impact requires both legal backing and operational muscle. We must build: - Statutory secondary publication rights with zero embargoes. - Machine-actionable Data Management Plans rather than static PDFs. - Standardized CC BY licensing and robust, certified FAIR repositories connected directly to EOSC . - A decisive shift in funding away from hyper-commercialized APC models toward community-led, non-profit Diamond Open Access. Open Science must be explicitly integrated into research assessment under CoARA - Coalition for Advancing Research Assessment principles. Policy without infrastructure is just rhetoric. The upcoming ERA Act offers a once-in-a-generation vehicle to lock this in. EU leadership must focus on three core legislative priorities: 1) Establish a uniform, EU-wide Secondary Publication Right to give every researcher a clear legal basis for immediate self-archiving. 2) Embed strict, standardized Open Access and machine-readable data requirements directly into next #HorizonEU. 3) Scale sustainable, publishing venues like Open Research Europe and global Diamond OA initiatives. The direction of travel is settled—the only remaining question is whether Europe will assemble a unified framework or remain bound by national fragmentation. More Europe, please. #MoreEurope

The French social media ban for under 15s was blocked in court. It did exclude non-commercial encyclopedias, knowledge resources and open-source sharing platforms, but the court still found it came too close to a blanket ban infringing on fundamental rights, such as freedom of expression and communication. Different places on the internet operate under different models and pose different risks. And they should be treated differently. https://lnkd.in/dEih3YZf
