This week, U.S. District Judge Arun Subramanian denied Live Nation’s motion for summary judgment in the DOJ and states’ Sherman Act case, allowing key monopolization claims to proceed to trial. That outcome aligns with what PPI’s Diana Moss wrote in December in ProMarket. She explained why Live Nation-Ticketmaster’s motion rested on flawed assumptions about market definition, competitive effects, and exclusive contracts, and why the government’s case should survive summary judgment. The court’s ruling permitting the core ticketing and tying claims to move forward underscores that analysis. As the case advances, the focus will remain on whether dominant firms can leverage their position across the live events supply chain in ways that harm competition and consumers.
