One of the biggest mistakes Jake Kingsley from Department for Environment, Food and Rural Affairs sees around Digital Waste Tracking is companies treating it as an IT project.... It isn't. It's a fundamental change to how operations run. That set the tone for our webinar on Tuesday with Jake and William Rundle from Nexus ReGen. Jake set out what Phase 1 requires. The reporting duty sits with permitted and licensed receiving sites: each load received, reported through the Report Receipt of Waste service by the end of the second working day, either through API-connected software or the temporary spreadsheet route. Phase 2 then connects carriers, brokers and the wider chain, and that is where most of construction comes in. Will covered duty of care and waste crime, and where the two meet. Section 34 hasn't materially changed since 1990, but the enforcement around it has. Three key points came out of Will's session... 𝟏. 𝐓𝐡𝐞 𝐦𝐚𝐭𝐞𝐫𝐢𝐚𝐥 𝐥𝐞𝐚𝐯𝐞𝐬 𝐬𝐢𝐭𝐞. 𝐘𝐨𝐮𝐫 𝐥𝐢𝐚𝐛𝐢𝐥𝐢𝐭𝐲 𝐝𝐨𝐞𝐬𝐧'𝐭. Everyone in the chain holds the duty in full, from excavation until long after the wagon has gone. Subcontracting the work does not subcontract the duty. 𝟐. 𝐓𝐡𝐞𝐫𝐞 𝐢𝐬 𝐧𝐨 𝐬𝐮𝐜𝐡 𝐭𝐡𝐢𝐧𝐠 𝐚𝐬 𝐲𝐨𝐮𝐫 𝐬𝐡𝐚𝐫𝐞. "Joint and several" means any one party can be pursued for all of it. Nobody divides it up. The regulator decides who to pursue. 𝟑. 𝐓𝐡𝐫𝐞𝐞 𝐭𝐡𝐢𝐧𝐠𝐬 𝐠𝐞𝐭 𝐜𝐨𝐧𝐟𝐮𝐬𝐞𝐝, 𝐚𝐧𝐝 𝐨𝐧𝐥𝐲 𝐨𝐧𝐞 𝐨𝐟 𝐭𝐡𝐞𝐦 𝐜𝐨𝐮𝐧𝐭𝐬. What your policy says. What actually happens on site. What you can prove happened. An officer asking questions only ever looks at the third one, and most businesses have never tested whether they could produce it. Thank you to everyone who joined us. Most of what gets called "waste" on a construction site is really just material in the wrong place. Good topsoil, aggregate, asphalt or concrete sitting in a skip, not because it's useless, but because nobody at the next site over knew it was there. Maybe I’m showing my age here, but does anyone else still love getting something good through the post? Nexus ReGen has just become a member of the Home Builders Federation (HBF). For us, it’s a really exciting one. HBF represents the companies responsible for the vast majority of new homes built across England and Wales, so becoming a member puts us right amongst an industry we’re already working closely with, and gives us more opportunities to learn, contribute and get involved. But weirdly, one of my favourite things about joining so far? The welcome pack that landed on my desk. 👇 I realised how much I enjoyed receiving an actual, physical thing.... The weight of it. Flicking through it rather than scrolling through it. There’s something about receiving a physical pack that makes joining feel more tangible and more considered, like you’re actually part of something. I do realise the irony here as I work for a tech company and we’ve deliberately moved away from paper wherever we can. Most things we send, share, sign, present or read are digital (and for good reason!) But when you’ve made the decision to pay to join an organisation, getting something physical through the door just feels… nice. And from a marketing perspective, it’s reminded me that perhaps in our rush to digitise absolutely everything, physical things have actually become more memorable, not less. The Environment Agency visited 42 waste sites between March and July. Every one of them held a permit. 17 came away with that permit suspended, facing revocation, or both.
